| 7 | 7 | | relating to procedures required for the continued annexation of |

| 8 | 8 | | certain areas annexed by certain municipalities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 43, Local Government Code, |
|---|
| 11 | 11 | | is amended by adding Section 43.909 to read as follows: |
|---|
| 12 | 12 | | Sec. 43.909. REQUIRED INCLUSION OF AREAS IN ANNEXATION PLAN |
|---|
| 13 | 13 | | OF CERTAIN MUNICIPALITIES. (a) In this section, "strip annexation |
|---|
| 14 | 14 | | area" means an area annexed by a municipality the width of which at |
|---|
| 15 | 15 | | its widest point is less than 1,001 feet. |
|---|
| 16 | 16 | | (b) A municipality located in a county with an international |
|---|
| 17 | 17 | | border that has annexed more than 10 miles of strip annexation area |
|---|
| 18 | 18 | | shall include in its annexation plan each area located in its |
|---|
| 19 | 19 | | extraterritorial jurisdiction by virtue of the area being adjacent |
|---|
| 20 | 20 | | to a strip annexation area that was annexed after January 1, 2002, |
|---|
| 21 | 21 | | and before January 1, 2003. |
|---|
| 22 | 22 | | (c) The annexation of an area under Subsection (b) must be |
|---|
| 23 | 23 | | completed before the 31st day after the third anniversary of the |
|---|
| 24 | 24 | | date the area was included in the annexation plan. If the |
|---|
| 25 | 25 | | annexation is not completed within the period prescribed by this |
|---|
| 26 | 26 | | subsection, the municipality shall give its written consent to |
|---|
| 27 | 27 | | release the area from the municipality's extraterritorial |
|---|
| 28 | 28 | | jurisdiction by ordinance or resolution as provided by Section |
|---|
| 29 | 29 | | 42.023. |
|---|
| 30 | 30 | | SECTION 2. On or before January 1, 2010, a municipality |
|---|
| 31 | 31 | | described by Section 43.909, Local Government Code, as added by |
|---|
| 32 | 32 | | this Act, shall amend its annexation plan to include territory as |
|---|
| 33 | 33 | | provided by Section 43.909, Local Government Code, as added by this |
|---|
| 34 | 34 | | Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
