5	5	AN ACT
6	6	relating to the change of the name of Texas A&M
7	7	University--Kingsville to Texas A&I University.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. The heading to Subchapter D, Chapter 87,
10	10	Education Code, is amended to read as follows:
11	11	SUBCHAPTER D. TEXAS A&I UNIVERSITY
12	12	[A&M UNIVERSITY--KINGSVILLE]
13	13	SECTION 2. Section 87.301, Education Code, is amended to
14	14	read as follows:
15	15	Sec. 87.301. ESTABLISHMENT. (a) Texas A&I University [A&M
16	16	University--Kingsville] is a coeducational institution of higher
17	17	education located in the city of Kingsville. The university is a
18	18	component institution of The Texas A&M University System and is
19	19	under the management and control of the board of regents of The
20	20	Texas A&M University System.
21	21	(b) The board has the same powers and duties concerning
22	22	Texas A&I University [A&M University--Kingsville] as are conferred
23	23	on it by statute concerning Texas A&M University.
24	24	SECTION 3. Subdivision (1), Section 51.502, Education Code,
25	25	is amended to read as follows:
26	26	(1) "Eligible institution" means the college,
27	27	department, or other unit of engineering at any of the following
28	28	institutions of higher education:
29	29	(A) The University of Texas at Austin;
30	30	(B) The University of Texas at Arlington;
31	31	(C) The University of Texas at El Paso;
32	32	(D) The University of Texas at San Antonio;
33	33	(E) The University of Texas of the Permian Basin;
34	34	(F) Texas A&M University;
35	35	(G) Prairie View A&M University;
36	36	(H) Texas Tech University;
37	37	(I) Lamar University;
38	38	(J) University of Houston; and
39	39	(K) Texas A&I University [A&M
40	40	University--Kingsville].
41	41	SECTION 4. Subdivision (3), Section 61.003, Education Code,
42	42	is amended to read as follows:
43	43	(3) "General academic teaching institution" means The
44	44	University of Texas at Austin; The University of Texas at El Paso;
45	45	The University of Texas of the Permian Basin; The University of
46	46	Texas at Dallas; The University of Texas at San Antonio; Texas A&M
47	47	University, Main University; The University of Texas at Arlington;
48	48	Tarleton State University; Prairie View A&M University; Texas
49	49	Maritime Academy; Texas Tech University; University of North Texas;
50	50	Lamar University; Lamar State College--Orange; Lamar State
51	51	College--Port Arthur; Texas A&I University [A&M
52	52	University--Kingsville]; Texas A&M University--Corpus Christi;
53	53	Texas Woman's University; Texas Southern University; Midwestern
54	54	State University; University of Houston; University of Texas--Pan
55	55	American; The University of Texas at Brownsville; Texas A&M
56	56	University--Commerce; Sam Houston State University; Texas State
57	57	University--San Marcos; West Texas A&M University; Stephen F.
58	58	Austin State University; Sul Ross State University; Angelo State
59	59	University; The University of Texas at Tyler; and any other
60	60	college, university, or institution so classified as provided in
61	61	this chapter or created and so classified, expressly or impliedly,
62	62	by law.
63	63	SECTION 5. Subsection (c), Section 85.70, Education Code,
64	64	is amended to read as follows:
65	65	(c) The board shall lease for oil, gas, sulphur, or other
66	66	mineral development, as prescribed by this subchapter, all or part
67	67	of the land under the exclusive control of the board owned by the
68	68	State of Texas and acquired for the use of Texas A&I University [A&M
69	69	University--Kingsville] and its divisions. Any money received by
70	70	the board concerning such land under this subchapter shall be
71	71	deposited in the state treasury to the credit of a special fund to
72	72	be known as the Texas A&I University [A&M University--Kingsville]
73	73	special mineral fund, to be used exclusively for Texas A&I
74	74	University [A&M University--Kingsville] and its branches and
75	75	divisions. Money may not be expended from this fund except as
76	76	authorized by the general appropriations act.
77	77	SECTION 6. (a) A reference in law to Texas A&M
78	78	University--Kingsville means Texas A&I University.
79	79	(b) An appropriation for the use and benefit of Texas A&M
80	80	University--Kingsville is available for the use and benefit of
81	81	Texas A&I University.
82	82	SECTION 7. This Act takes effect September 1, 2009.
