88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subchapter D, Chapter 87,
1010 Education Code, is amended to read as follows:
1111 SUBCHAPTER D. TEXAS A&I UNIVERSITY
1212 [A&M UNIVERSITY--KINGSVILLE]
1313 SECTION 2. Section 87.301, Education Code, is amended to
1414 read as follows:
1515 Sec. 87.301. ESTABLISHMENT. (a) Texas A&I University [A&M
1616 University--Kingsville] is a coeducational institution of higher
1717 education located in the city of Kingsville. The university is a
1818 component institution of The Texas A&M University System and is
1919 under the management and control of the board of regents of The
2020 Texas A&M University System.
2121 (b) The board has the same powers and duties concerning
2222 Texas A&I University [A&M University--Kingsville] as are conferred
2323 on it by statute concerning Texas A&M University.
2424 SECTION 3. Subdivision (1), Section 51.502, Education Code,
2525 is amended to read as follows:
2626 (1) "Eligible institution" means the college,
2727 department, or other unit of engineering at any of the following
2828 institutions of higher education:
2929 (A) The University of Texas at Austin;
3030 (B) The University of Texas at Arlington;
3131 (C) The University of Texas at El Paso;
3232 (D) The University of Texas at San Antonio;
3333 (E) The University of Texas of the Permian Basin;
3434 (F) Texas A&M University;
3535 (G) Prairie View A&M University;
3636 (H) Texas Tech University;
3737 (I) Lamar University;

4141 SECTION 4. Subdivision (3), Section 61.003, Education Code,
4242 is amended to read as follows:
4343 (3) "General academic teaching institution" means The
4444 University of Texas at Austin; The University of Texas at El Paso;
4545 The University of Texas of the Permian Basin; The University of
4646 Texas at Dallas; The University of Texas at San Antonio; Texas A&M

6363 SECTION 5. Subsection (c), Section 85.70, Education Code,
6464 is amended to read as follows:
6565 (c) The board shall lease for oil, gas, sulphur, or other
6666 mineral development, as prescribed by this subchapter, all or part
6767 of the land under the exclusive control of the board owned by the
6868 State of Texas and acquired for the use of Texas A&I University [A&M
6969 University--Kingsville] and its divisions. Any money received by
7070 the board concerning such land under this subchapter shall be
7171 deposited in the state treasury to the credit of a special fund to
7272 be known as the Texas A&I University [A&M University--Kingsville]
7373 special mineral fund, to be used exclusively for Texas A&I
7474 University [A&M University--Kingsville] and its branches and
7575 divisions. Money may not be expended from this fund except as
7676 authorized by the general appropriations act.
7777 SECTION 6. (a) A reference in law to Texas A&M
7878 University--Kingsville means Texas A&I University.
7979 (b) An appropriation for the use and benefit of Texas A&M
8080 University--Kingsville is available for the use and benefit of
8181 Texas A&I University.
8282 SECTION 7. This Act takes effect September 1, 2009.
