8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter Z, Chapter 44, Education Code, is |
---|
10 | 10 | | amended by adding Section 44.908 to read as follows: |

11 | 11 | | Sec. 44.908. USE OF CAMPUS DISCRETIONARY FUNDS. (a) In |
---|
12 | 12 | | this section, "campus discretionary funds" means money raised at a |
---|
13 | 13 | | public school campus through vending machines or other sources |
---|
14 | 14 | | specifically associated with the campus. |
---|
15 | 15 | | (b) Campus discretionary funds may be used only to directly |
---|
16 | 16 | | benefit the general welfare and educational development and morale |
---|
17 | 17 | | of students enrolled at the campus. |
---|
18 | 18 | | (c) For purposes of Subsection (b), professional |
---|
19 | 19 | | development activities are not considered to directly benefit the |
---|
20 | 20 | | general welfare and educational development and morale of students. |
---|
21 | 21 | | SECTION 2. Section 44.908, Education Code, as added by this |
---|
22 | 22 | | Act, applies to any expenditure of campus discretionary funds that |
---|
23 | 23 | | occurs on or after the effective date of this Act, regardless of the |
---|
24 | 24 | | date on which the funds were raised. |
---|
25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2009. |
