| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 502, Transportation Code, |
|---|
| 10 | 10 | | is amended by adding Section 502.1587 to read as follows: |
|---|
| 11 | 11 | | Sec. 502.1587. REGISTRATION FEES. (a) The department by |
|---|
| 12 | 12 | | rule shall establish a schedule of motor vehicle registration fees |
|---|
| 13 | 13 | | based on the weight of the vehicle for all passenger motor vehicles, |
|---|
| 14 | 14 | | commercial motor vehicles, road tractors, trailers, motorcycles, |
|---|
| 15 | 15 | | mopeds, and motor buses. |
|---|
| 16 | 16 | | (b) The department by rule shall establish fees for the |
|---|
| 17 | 17 | | replacement and transfer of license plates and registration |
|---|
| 18 | 18 | | insignia. |
|---|
| 19 | 19 | | SECTION 2. Subchapter F, Chapter 504, Transportation Code, |
|---|
| 20 | 20 | | is amended by adding Section 504.5012 to read as follows: |
|---|
| 21 | 21 | | Sec. 504.5012. The department by rule shall establish fees |
|---|
| 22 | 22 | | and procedures for the issuance of specialty license plates for |
|---|
| 23 | 23 | | classic motor vehicles and trailers under this subchapter. |
|---|
| 24 | 24 | | SECTION 3. The following sections of the Transportation |
|---|
| 25 | 25 | | Code are repealed: |
|---|
| 26 | 26 | | (1) 502.159; |
|---|
| 27 | 27 | | (2) 502.160; |
|---|
| 28 | 28 | | (3) 502.161; |
|---|
| 29 | 29 | | (4) 502.162; |
|---|
| 30 | 30 | | (5) 502.163; |
|---|
| 31 | 31 | | (6) 502.164; |
|---|
| 32 | 32 | | (7) 502.165; and |
|---|
| 33 | 33 | | (8) 502.166. |
|---|
| 34 | 34 | | SECTION 4. The Texas Department of Transportation shall |

| 35 | 35 | | adopt rules as required by Sections 502.1587 and 504.5012, |
|---|
| 36 | 36 | | Transportation Code, as added by this Act, not later than September |
|---|
| 37 | 37 | | 1, 2010. |
|---|
| 38 | 38 | | SECTION 5. This Act takes effect September 1, 2009. |
