| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 501.002(1), Transportation Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (1) "Certificate of title" means a printed record of |
|---|
| 12 | 12 | | title [an instrument] issued under Section 501.021. |
|---|
| 13 | 13 | | SECTION 2. Section 502.001(1), Transportation Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (1) "All-terrain vehicle" means a motor vehicle that |
|---|
| 16 | 16 | | is: |
|---|
| 17 | 17 | | (A) equipped with a saddle, bench, or bucket |
|---|
| 18 | 18 | | seats for the use of: |
|---|
| 19 | 19 | | (i) the rider; and |
|---|
| 20 | 20 | | (ii) a passenger, if the motor vehicle is |
|---|
| 21 | 21 | | designed by the manufacturer to transport a passenger; |
|---|
| 22 | 22 | | (B) designed to propel itself with three or more |
|---|
| 23 | 23 | | tires in contact with the ground; and |
|---|
| 24 | 24 | | (C) designed by the manufacturer for off-highway |
|---|
| 25 | 25 | | use [; and |
|---|
| 26 | 26 | | [(D) not designed by the manufacturer primarily |
|---|
| 27 | 27 | | for farming or lawn care]. |
|---|
| 28 | 28 | | SECTION 3. Subchapter A, Chapter 520, Transportation Code, |
|---|
| 29 | 29 | | is amended by adding Section 520.003 to read as follows: |
|---|
| 30 | 30 | | Sec. 520.003. RULES. The department may adopt rules to |
|---|
| 31 | 31 | | administer this chapter. |
|---|
| 32 | 32 | | SECTION 4. Section 520.036, Transportation Code, is |
|---|
| 33 | 33 | | transferred to Subchapter B, Chapter 520, Transportation Code, and |
|---|
| 34 | 34 | | renumbered as Section 520.026, Transportation Code, to read as |
|---|
| 35 | 35 | | follows: |
|---|
| 36 | 36 | | Sec. 520.026 [520.036]. GENERAL PENALTY. (a) A person |
|---|
| 37 | 37 | | commits an offense if the person violates this subchapter in a |
|---|
| 38 | 38 | | manner for which a specific penalty is not provided. |
|---|
| 39 | 39 | | (b) An offense under this section is a misdemeanor |
|---|
| 40 | 40 | | punishable by a fine of not less than $50 and not more than $200. |
|---|
| 41 | 41 | | SECTION 5. (a) The change in law made by this Act applies |
|---|
| 42 | 42 | | only to an offense committed on or after September 1, 2009. |
|---|
| 43 | 43 | | (b) An offense committed before September 1, 2009, is |
|---|
| 44 | 44 | | covered by the law in effect when the offense was committed, and the |
|---|
| 45 | 45 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 46 | 46 | | this subsection, an offense was committed before September 1, 2009, |
|---|
| 47 | 47 | | if any element of the offense was committed before that date. |
|---|
| 48 | 48 | | SECTION 6. This Act takes effect September 1, 2009. |
|---|
