66 AN ACT
77 relating to motor vehicles; providing penalties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 501.002(1), Transportation Code, is
1010 amended to read as follows:
1111 (1) "Certificate of title" means a printed record of
1212 title [an instrument] issued under Section 501.021.
1313 SECTION 2. Section 502.001(1), Transportation Code, is
1414 amended to read as follows:
1515 (1) "All-terrain vehicle" means a motor vehicle that
1616 is:
1717 (A) equipped with a saddle, bench, or bucket
1818 seats for the use of:
1919 (i) the rider; and
2020 (ii) a passenger, if the motor vehicle is
2121 designed by the manufacturer to transport a passenger;
2222 (B) designed to propel itself with three or more
2323 tires in contact with the ground; and
2424 (C) designed by the manufacturer for off-highway
2525 use [; and
2626 [(D) not designed by the manufacturer primarily
2727 for farming or lawn care].
2828 SECTION 3. Subchapter A, Chapter 520, Transportation Code,
2929 is amended by adding Section 520.003 to read as follows:
3030 Sec. 520.003. RULES. The department may adopt rules to
3131 administer this chapter.
3232 SECTION 4. Section 520.036, Transportation Code, is
3333 transferred to Subchapter B, Chapter 520, Transportation Code, and
3434 renumbered as Section 520.026, Transportation Code, to read as
3535 follows:
3636 Sec. 520.026 [520.036]. GENERAL PENALTY. (a) A person
3737 commits an offense if the person violates this subchapter in a
3838 manner for which a specific penalty is not provided.
3939 (b) An offense under this section is a misdemeanor
4040 punishable by a fine of not less than $50 and not more than $200.
4141 SECTION 5. (a) The change in law made by this Act applies
4242 only to an offense committed on or after September 1, 2009.
4343 (b) An offense committed before September 1, 2009, is
4444 covered by the law in effect when the offense was committed, and the
4545 former law is continued in effect for that purpose. For purposes of
4646 this subsection, an offense was committed before September 1, 2009,
4747 if any element of the offense was committed before that date.
4848 SECTION 6. This Act takes effect September 1, 2009.
