44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the eligibility of a voter to vote in the general
77 election for state and county officers, including an election held
88 in conjunction with that election, if the voter's residence has
99 changed.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 63.0011, Election Code, is amended by
1212 adding Subsection (b-1) to read as follows:
1313 (b-1) In the general election for state and county officers,
1414 including an election held in conjunction with that election, if
1515 the voter's residence address is not current because the voter has
1616 changed residence within the county, the voter may vote, if
1717 otherwise eligible, in the election precinct in which the voter is
1818 registered if the voter resides in one or more of the political
1919 subdivisions participating in the election at that precinct. A
2020 voter eligible under this subsection shall receive a ballot that
2121 includes all candidates and measures that are included in the
2222 election at that precinct, notwithstanding Section 11.001(a)(2).
2323 SECTION 2. The change in law made by this Act applies only
2424 to an election ordered on or after September 1, 2009.
2525 SECTION 3. This Act takes effect September 1, 2009.
