66 AN ACT
77 relating to the 39th Judicial District Juvenile Board.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 152.1101, Human Resources Code, is
1010 amended to read as follows:
1111 Sec. 152.1101. HASKELL COUNTY. (a) Haskell County is
1212 included in the 39th Judicial District Juvenile Board. The
1313 juvenile board [of Haskell County] is composed of:
1414 (1) the county judge of Haskell County;
1515 (2) the county judge of Kent County;
1616 (3) the county judge of Stonewall County;
1717 (4) the county judge of Throckmorton County; and
1818 (5) the 39th Judicial District judge[, the district
1919 judges in Haskell County, and the judge of any statutory court
2020 designated as a juvenile court].
2121 (b) The juvenile court judge may appoint two public members
2222 to serve on the board for a term set by the judge.
2323 (c) [(b)] The juvenile board shall elect one of its members
2424 as chairman at the beginning of each year.
2525 (d) [(c)] The commissioners court of each county shall pay
2626 the county judge of that county and the 39th Judicial District judge
2727 additional [judges on the board an] annual compensation of [salary
2828 set by the commissioners court at] not more than $6,000 [$1,200],
2929 payable in equal monthly installments from the general fund or any
3030 other available fund of the county, for the added duties imposed on
3131 the judges under this section. The public members serve without
3232 compensation.
3333 [(d) The chief juvenile probation officer may set the
3434 salaries and allowances of juvenile probation personnel with the
3535 approval of the board.]
3636 (e) If approved by the juvenile board, the commissioners
3737 court shall reimburse the juvenile court judge for the judge's
3838 actual and necessary expenses incurred in attending seminars and
3939 other educational or instructional meetings related to juvenile
4040 problems. The counties shall prorate the expenses allowed for the
4141 members of the juvenile board and for the juvenile court judge.
4242 (f) The commissioners court of each county shall jointly
4343 provide the necessary funds to pay the salaries of the juvenile
4444 probation personnel in the amount set by the juvenile board.
4545 (g) The commissioners court of each county shall jointly pay
4646 the expenses of the juvenile probation officers that are certified
4747 as necessary by the juvenile board chairman from the general fund
4848 and in the amount set by the juvenile board.
4949 (h) Sections 152.0004 and [Section] 152.0005(b) do [does]
5050 not apply to the juvenile board [of Haskell County].
5151 SECTION 2. Subchapter D, Chapter 152, Human Resources Code,
5252 is amended by adding Section 152.1381 to read as follows:
5353 Sec. 152.1381. KENT COUNTY. (a) Kent County is included in
5454 the 39th Judicial District Juvenile Board.
5555 (b) Section 152.1101 applies to the 39th Judicial District
5656 Juvenile Board.
5757 SECTION 3. Subchapter D, Chapter 152, Human Resources Code,
5858 is amended by adding Section 152.2231 to read as follows:
5959 Sec. 152.2231. STONEWALL COUNTY. (a) Stonewall County is
6060 included in the 39th Judicial District Juvenile Board.
6161 (b) Section 152.1101 applies to the 39th Judicial District
6262 Juvenile Board.
6363 SECTION 4. Sections 152.2301(a) and (b), Human Resources
6464 Code, are amended to read as follows:
6565 (a) Throckmorton County is included in the 39th Judicial
6666 District Juvenile Board. [The juvenile board of Throckmorton
6767 County is composed of the county judge, the district judges in
6868 Throckmorton County, and the judge of each statutory court
6969 designated as a juvenile court in the county. The juvenile court
7070 judge may appoint two public members to serve on the board for a
7171 period determined by the juvenile court judge.]
7272 (b) Section 152.1101 applies to the 39th Judicial District
7373 Juvenile Board. [The juvenile board shall elect one of its members
7474 as chairman at the beginning of each year.]
7575 SECTION 5. Sections 152.2301(c), (d), and (e), Human
7676 Resources Code, are repealed.
7777 SECTION 6. This Act takes effect September 1, 2009.
