| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 25, Government Code, is |
|---|
| 12 | 12 | | amended by adding Sections 25.2361 and 25.2362 to read as follows: |
|---|
| 13 | 13 | | Sec. 25.2361. VAN ZANDT COUNTY. Van Zandt County has one |
|---|
| 14 | 14 | | statutory county court, the County Court at Law of Van Zandt County. |
|---|
| 15 | 15 | | Sec. 25.2362. VAN ZANDT COUNTY COURT AT LAW PROVISIONS. (a) |
|---|
| 16 | 16 | | In addition to the jurisdiction provided by Section 25.0003, a |
|---|
| 17 | 17 | | county court at law in Van Zandt County has, concurrent with the |
|---|
| 18 | 18 | | district court, the jurisdiction provided by the constitution and |
|---|
| 19 | 19 | | general law for district courts, except that the county court at law |
|---|
| 20 | 20 | | does not have jurisdiction in capital felony cases. |
|---|
| 21 | 21 | | (b) The county clerk serves as clerk of a county court at law |
|---|
| 22 | 22 | | for cases and proceedings originally filed in the county court at |
|---|
| 23 | 23 | | law, and the district clerk serves as clerk of a county court at law |
|---|
| 24 | 24 | | for cases and proceedings originally filed in the district courts |
|---|
| 25 | 25 | | in the county. |

| 26 | 26 | | SECTION 2. Section 152.2401(a), Human Resources Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (a) The Van Zandt County Juvenile Board is composed of the |
|---|
| 29 | 29 | | county judge, the criminal district attorney of Van Zandt County, |
|---|
| 30 | 30 | | the judge of the County Court at Law of Van Zandt County, and the |
|---|
| 31 | 31 | | judge of the 294th Judicial District. |
|---|
| 32 | 32 | | SECTION 3. Chapter 969 (H.B. 4139), Acts of the 80th |
|---|
| 33 | 33 | | Legislature, Regular Session, 2007, which added Section 25.2361, |
|---|
| 34 | 34 | | Government Code, to be effective January 1, 2011, is repealed. |
|---|
| 35 | 35 | | SECTION 4. Notwithstanding Section 25.0009, Government |
|---|
| 36 | 36 | | Code, the initial vacancy in the office of judge of the County Court |
|---|
| 37 | 37 | | at Law of Van Zandt County shall be filled by election. The office |
|---|
| 38 | 38 | | exists for purposes of the primary and general elections in 2010. A |
|---|
| 39 | 39 | | vacancy after the initial vacancy is filled as provided by Section |
|---|
| 40 | 40 | | 25.0009, Government Code. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2010. |
