88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8353 to read as follows:
1111 CHAPTER 8353. CLEARWATER RANCH MUNICIPAL UTILITY DISTRICT NO. 1
1212 SUBCHAPTER A. GENERAL PROVISIONS
1313 Sec. 8353.001. DEFINITIONS. In this chapter:
1414 (1) "Board" means the district's board of directors.
1515 (2) "Director" means a board member.
1616 (3) "District" means the Clearwater Ranch Municipal
1717 Utility District No. 1.
1818 Sec. 8353.002. NATURE OF DISTRICT. The district is a
1919 municipal utility district created under Section 59, Article XVI,
2020 Texas Constitution.
2121 Sec. 8353.003. CONFIRMATION AND DIRECTORS' ELECTION
2222 REQUIRED. (a) The temporary directors shall hold an election to
2323 confirm the creation of the district and to elect five permanent
2424 directors as provided by Section 49.102, Water Code.
2525 (b) If the creation of the district is not confirmed at a
2626 confirmation election held under this section before December 31,
2727 2013:
2828 (1) the district is dissolved December 31, 2013,
2929 except that:
3030 (A) any debts incurred shall be paid;
3131 (B) any assets that remain after the payment of
3232 debts shall be transferred to Burnet County; and
3333 (C) the organization of the district shall be
3434 maintained until all debts are paid and remaining assets are
3535 transferred; and
3636 (2) this chapter expires September 1, 2016.
3737 Sec. 8353.004. CONSENT OF MUNICIPALITY REQUIRED. The
3838 temporary directors may not hold an election under Section 8353.003
3939 until each municipality in whose corporate limits or
4040 extraterritorial jurisdiction the district is located has
4141 consented by ordinance or resolution to the creation of the
4242 district and to the inclusion of land in the district.
4343 Sec. 8353.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4444 The district is created to serve a public purpose and benefit.
4545 (b) The district is created to accomplish the purposes of:
4646 (1) a municipal utility district as provided by
4747 general law and Section 59, Article XVI, Texas Constitution; and
4848 (2) Section 52, Article III, Texas Constitution, that
4949 relate to the construction, acquisition, improvement, operation,
5050 or maintenance of macadamized, graveled, or paved roads, or
5151 improvements, including storm drainage, in aid of those roads.
5252 Sec. 8353.006. INITIAL DISTRICT TERRITORY. (a) The
5353 district is initially composed of the territory described by
5454 Section 2 of the Act creating this chapter.
5555 (b) The boundaries and field notes contained in Section 2 of
5656 the Act creating this chapter form a closure. A mistake made in the
5757 field notes or in copying the field notes in the legislative process
5858 does not affect the district's:
5959 (1) organization, existence, or validity;
6060 (2) right to issue any type of bond for the purposes
6161 for which the district is created or to pay the principal of and
6262 interest on a bond;
6363 (3) right to impose a tax; or
6464 (4) legality or operation.

6666 SUBCHAPTER B. BOARD OF DIRECTORS
6767 Sec. 8353.051. GOVERNING BODY; TERMS. (a) The district is
6868 governed by a board of five elected directors.
6969 (b) Except as provided by Section 8353.052, directors serve
7070 staggered four-year terms.
7171 Sec. 8353.052. TEMPORARY DIRECTORS. (a) On or after the
7272 effective date of the Act creating this chapter, the owner or owners
7373 of a majority of the assessed value of the real property in the
7474 district may submit a petition to the Texas Commission on
7575 Environmental Quality requesting that the commission appoint as
7676 temporary directors the five persons named in the petition. The
7777 commission shall appoint as temporary directors the five persons
7878 named in the petition.
7979 (b) Temporary directors serve until the earlier of:
8080 (1) the date permanent directors are elected under
8181 Section 8353.003; or
8282 (2) the fourth anniversary of the effective date of
8383 the Act creating this chapter.
8484 (c) If permanent directors have not been elected under
8585 Section 8353.003 and the terms of the temporary directors have
8686 expired, successor temporary directors shall be appointed or
8787 reappointed as provided by Subsection (d) to serve terms that
8888 expire on the earliest of:
8989 (1) the date permanent directors are elected under
9090 Section 8353.003;
9191 (2) the date the requirements of Section
9292 8353.003(b)(1) are fulfilled; or
9393 (3) September 1, 2016.
9494 (d) If Subsection (c) applies, the owner or owners of a
9595 majority of the assessed value of the real property in the district
9696 may submit a petition to the Texas Commission on Environmental
9797 Quality requesting that the commission appoint as successor
9898 temporary directors the five persons named in the petition. The
9999 commission shall appoint as successor temporary directors the five
100100 persons named in the petition.

102102 SUBCHAPTER C. POWERS AND DUTIES
103103 Sec. 8353.101. GENERAL POWERS AND DUTIES. The district has
104104 the powers and duties necessary to accomplish the purposes for
105105 which the district is created.
106106 Sec. 8353.102. MUNICIPAL UTILITY DISTRICT POWERS AND
107107 DUTIES. The district has the powers and duties provided by the
108108 general law of this state, including Chapters 49 and 54, Water Code,
109109 applicable to municipal utility districts created under Section 59,
110110 Article XVI, Texas Constitution.
111111 Sec. 8353.103. AUTHORITY FOR ROAD PROJECTS. Under Section
112112 52, Article III, Texas Constitution, the district may design,
113113 acquire, construct, finance, issue bonds for, improve, operate,
114114 maintain, and convey to this state, a county, or a municipality for
115115 operation and maintenance macadamized, graveled, or paved roads, or
116116 improvements, including storm drainage, in aid of those roads.
117117 Sec. 8353.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
118118 project must meet all applicable construction standards, zoning and
119119 subdivision requirements, and regulations of each municipality in
120120 whose corporate limits or extraterritorial jurisdiction the road
121121 project is located.
122122 (b) If a road project is not located in the corporate limits
123123 or extraterritorial jurisdiction of a municipality, the road
124124 project must meet all applicable construction standards,
125125 subdivision requirements, and regulations of each county in which
126126 the road project is located.
127127 (c) If the state will maintain and operate the road, the
128128 Texas Transportation Commission must approve the plans and
129129 specifications of the road project.
130130 Sec. 8353.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
131131 OR RESOLUTION. The district shall comply with all applicable
132132 requirements of any ordinance or resolution that is adopted under
133133 Section 54.016 or 54.0165, Water Code, and that consents to the
134134 creation of the district or to the inclusion of land in the
135135 district.
136136 Sec. 8353.106. LIMITATION ON USE OF EMINENT DOMAIN. The
137137 district may not exercise the power of eminent domain outside the
138138 district to acquire a site or easement for:
139139 (1) a road project authorized by Section 8353.103; or
140140 (2) a recreational facility as defined by Section
141141 49.462, Water Code.
142142 Sec. 8353.107. DIVISION OF DISTRICT. (a) The district may
143143 be divided into two or more new districts only if the district:
144144 (1) has no outstanding bonded debt; and
145145 (2) is not imposing ad valorem taxes.
146146 (b) This chapter applies to any new district created by the
147147 division of the district, and a new district has all the powers and
148148 duties of the district.
149149 (c) Any new district created by the division of the district
150150 may not, at the time the new district is created, contain any land
151151 outside the area described by Section 2 of the Act creating this
152152 chapter.
153153 (d) The board, on its own motion or on receipt of a petition
154154 signed by the owner or owners of a majority of the assessed value of
155155 the real property in the district, may adopt an order dividing the
156156 district.
157157 (e) The board may adopt an order dividing the district only
158158 after the date on which the creation of the district is confirmed at
159159 an election under Section 8353.003.
160160 (f) An order dividing the district shall:
161161 (1) name each new district;
162162 (2) include the metes and bounds description of the
163163 territory of each new district;
164164 (3) appoint temporary directors for each new district
165165 or provide that the owner or owners of a majority of the assessed
166166 value of the real property in each new district may submit a
167167 petition to the Texas Commission on Environmental Quality
168168 requesting that the commission appoint as temporary directors the
169169 five persons named in the petition; and
170170 (4) provide for the division of assets and liabilities
171171 between or among the new districts.
172172 (g) On or before the 30th day after the date of adoption of
173173 an order dividing the district, the district shall file the order
174174 with the Texas Commission on Environmental Quality and record the
175175 order in the real property records of each county in which the
176176 district is located.
177177 (h) Any new district created by the division of the district
178178 shall hold a confirmation and directors' election as required by
179179 Section 8353.003(a). A new district that is not confirmed is
180180 subject to dissolution under general law.
181181 (i) Municipal consent to the creation of the district and to
182182 the inclusion of land in the district granted under Section
183183 8353.004 acts as municipal consent to the creation of any new
184184 district created by division of the district and to the inclusion of
185185 land in the new district.
186186 (j) Any new district created by the division of the district
187187 must hold an election as required by this chapter to obtain voter
188188 approval before the district may impose a maintenance tax or issue
189189 bonds payable wholly or partly from ad valorem taxes.

191191 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
192192 Sec. 8353.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
193193 district may issue, without an election, bonds and other
194194 obligations secured by:
195195 (1) revenue other than ad valorem taxes; or
196196 (2) contract payments described by Section 8353.153.
197197 (b) The district must hold an election in the manner
198198 provided by Chapters 49 and 54, Water Code, to obtain voter approval
199199 before the district may impose an ad valorem tax or issue bonds
200200 payable from ad valorem taxes.
201201 (c) The district may not issue bonds payable from ad valorem
202202 taxes to finance a road project unless the issuance is approved by a
203203 vote of a two-thirds majority of the district voters voting at an
204204 election held for that purpose.
205205 Sec. 8353.152. OPERATION AND MAINTENANCE TAX. (a) If
206206 authorized at an election held under Section 8353.151, the district
207207 may impose an operation and maintenance tax on taxable property in
208208 the district in accordance with Section 49.107, Water Code.
209209 (b) The board shall determine the tax rate. The rate may not
210210 exceed the rate approved at the election.
211211 Sec. 8353.153. CONTRACT TAXES. (a) In accordance with
212212 Section 49.108, Water Code, the district may impose a tax other than
213213 an operation and maintenance tax and use the revenue derived from
214214 the tax to make payments under a contract after the provisions of
215215 the contract have been approved by a majority of the district voters
216216 voting at an election held for that purpose.
217217 (b) A contract approved by the district voters may contain a
218218 provision stating that the contract may be modified or amended by
219219 the board without further voter approval.

221221 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
222222 Sec. 8353.201. AUTHORITY TO ISSUE BONDS AND OTHER
223223 OBLIGATIONS. The district may issue bonds or other obligations
224224 payable wholly or partly from ad valorem taxes, impact fees,
225225 revenue, contract payments, grants, or other district money, or any
226226 combination of those sources, to pay for any authorized district
227227 purpose.
228228 Sec. 8353.202. TAXES FOR BONDS. At the time the district
229229 issues bonds payable wholly or partly from ad valorem taxes, the
230230 board shall provide for the annual imposition of a continuing
231231 direct ad valorem tax, without limit as to rate or amount, while all
232232 or part of the bonds are outstanding as required and in the manner
233233 provided by Sections 54.601 and 54.602, Water Code.
234234 Sec. 8353.203. BONDS FOR ROAD PROJECTS. At the time of
235235 issuance, the total principal amount of bonds or other obligations
236236 issued or incurred to finance road projects and payable from ad
237237 valorem taxes may not exceed one-fourth of the assessed value of the
238238 real property in the district.
239239 SECTION 2. The Clearwater Ranch Municipal Utility District
240240 No. 1 initially includes all the territory contained in the
241241 following area: 1800.01 Acres of land, consisting of the 870.04
242242 acre tract described below as "TRACT 1", the 66.05 acre tract
243243 described below as "TRACT 2", the 90.12 acre tract described below
244244 as "TRACT 3" and 773.80 acre tract described below as "TRACT 4":
245245 TRACT 1: Being 870.04 acres out of the Spring Creek IRR. Co.
246246 Survey No. 22, A-1050, the S.F.I.W. Co. Survey No. 1, A-843, the
247247 Johannes Braumholz Survey No. 954, A-109, the Jeptha Boyce Survey
248248 No. 47, A-114, the R.R. Robarts Survey No. 963, A-765, the John
249249 Hasseldanz Survey No. 959, A-430, and the Wayne Barton Survey No. 3,
250250 A-112; Being a portion of a called 21,304.716 acre tract as
