55 relating to the terms of temporary directors and to deadlines for
66 elections to confirm the creation of East Montgomery County
77 Municipal Utility Districts Nos. 8, 9, 10, 11, 12, 13, and 14,
88 Montgomery County Municipal Utility Districts Nos. 100 and 101, and
99 Liberty County Municipal Utility District No. 5.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 8112.021, Special District Local Laws
1212 Code, is amended by amending Subsection (d) and adding Subsections
1313 (e) and (f) to read as follows:
1414 (d) Temporary directors serve until [the earlier of:
1515 [(1)] the date the directors are elected under Section
1616 8112.023[; or
1717 [(2) the date this chapter expires under Section
1818 8112.003].
1919 (e) If permanent directors have not been elected under
2020 Section 8112.023 and the terms of the temporary directors have
2121 expired, successor temporary directors shall be appointed or
2222 reappointed as provided by Subsection (f) to serve terms that
2323 expire on the earlier of:
2424 (1) the date permanent directors are elected under
2525 Section 8112.023; or
2626 (2) the fourth anniversary of the date of the
2727 appointment or reappointment.
2828 (f) If Subsection (e) applies, the owner or owners of a
2929 majority of the assessed value of the real property in the district
3030 may submit a petition to the commission requesting that the
3131 commission appoint as successor temporary directors the five
3232 persons named in the petition. The commission shall appoint as
3333 successor temporary directors the five persons named in the
3434 petition.
3535 SECTION 2. Section 8113.021, Special District Local Laws
3636 Code, is amended by amending Subsection (d) and adding Subsections
3737 (e) and (f) to read as follows:
3838 (d) Temporary directors serve until [the earlier of:
3939 [(1)] the date the directors are elected under Section
4040 8113.023[; or
4141 [(2) the date this chapter expires under Section
4242 8113.003].
4343 (e) If permanent directors have not been elected under
4444 Section 8113.023 and the terms of the temporary directors have
4545 expired, successor temporary directors shall be appointed or
4646 reappointed as provided by Subsection (f) to serve terms that
4747 expire on the earlier of:
4848 (1) the date permanent directors are elected under
4949 Section 8113.023; or
5050 (2) the fourth anniversary of the date of the
5151 appointment or reappointment.
5252 (f) If Subsection (e) applies, the owner or owners of a
5353 majority of the assessed value of the real property in the district
5454 may submit a petition to the commission requesting that the
5555 commission appoint as successor temporary directors the five
5656 persons named in the petition. The commission shall appoint as
5757 successor temporary directors the five persons named in the
5858 petition.
5959 SECTION 3. Section 8114.021, Special District Local Laws
6060 Code, is amended by amending Subsection (d) and adding Subsections
6161 (e) and (f) to read as follows:
6262 (d) Temporary directors serve until [the earlier of:
6363 [(1)] the date the directors are elected under Section
6464 8114.023[; or
6565 [(2) the date this chapter expires under Section
6666 8114.003].
6767 (e) If permanent directors have not been elected under
6868 Section 8114.023 and the terms of the temporary directors have
6969 expired, successor temporary directors shall be appointed or
7070 reappointed as provided by Subsection (f) to serve terms that
7171 expire on the earlier of:
7272 (1) the date permanent directors are elected under
7373 Section 8114.023; or
7474 (2) the fourth anniversary of the date of the
7575 appointment or reappointment.
7676 (f) If Subsection (e) applies, the owner or owners of a
7777 majority of the assessed value of the real property in the district
7878 may submit a petition to the commission requesting that the
7979 commission appoint as successor temporary directors the five
8080 persons named in the petition. The commission shall appoint as
8181 successor temporary directors the five persons named in the
8282 petition.
8383 SECTION 4. Section 8115.021, Special District Local Laws
8484 Code, is amended by amending Subsection (d) and adding Subsections
8585 (e) and (f) to read as follows:
8686 (d) Temporary directors serve until [the earlier of:
8787 [(1)] the date the directors are elected under Section
8888 8115.023[; or
8989 [(2) the date this chapter expires under Section
9090 8115.003].
9191 (e) If permanent directors have not been elected under
9292 Section 8115.023 and the terms of the temporary directors have
9393 expired, successor temporary directors shall be appointed or
9494 reappointed as provided by Subsection (f) to serve terms that
9595 expire on the earlier of:
9696 (1) the date permanent directors are elected under
9797 Section 8115.023; or
9898 (2) the fourth anniversary of the date of the
9999 appointment or reappointment.
100100 (f) If Subsection (e) applies, the owner or owners of a
101101 majority of the assessed value of the real property in the district
102102 may submit a petition to the commission requesting that the
103103 commission appoint as successor temporary directors the five
104104 persons named in the petition. The commission shall appoint as
105105 successor temporary directors the five persons named in the
106106 petition.
107107 SECTION 5. Section 8116.021, Special District Local Laws
108108 Code, is amended by amending Subsection (d) and adding Subsections
109109 (e) and (f) to read as follows:
110110 (d) Temporary directors serve until [the earlier of:
111111 [(1)] the date the directors are elected under Section
112112 8116.023[; or
113113 [(2) the date this chapter expires under Section
114114 8116.003].
115115 (e) If permanent directors have not been elected under
116116 Section 8116.023 and the terms of the temporary directors have
117117 expired, successor temporary directors shall be appointed or
118118 reappointed as provided by Subsection (f) to serve terms that
119119 expire on the earlier of:
120120 (1) the date permanent directors are elected under
121121 Section 8116.023; or
122122 (2) the fourth anniversary of the date of the
123123 appointment or reappointment.
124124 (f) If Subsection (e) applies, the owner or owners of a
125125 majority of the assessed value of the real property in the district
126126 may submit a petition to the commission requesting that the
127127 commission appoint as successor temporary directors the five
128128 persons named in the petition. The commission shall appoint as
129129 successor temporary directors the five persons named in the
130130 petition.
131131 SECTION 6. Section 8117.021, Special District Local Laws
132132 Code, is amended by amending Subsection (d) and adding Subsections
133133 (e) and (f) to read as follows:
134134 (d) Temporary directors serve until [the earlier of:
135135 [(1)] the date the directors are elected under Section
136136 8117.023[; or
137137 [(2) the date this chapter expires under Section
138138 8117.003].
139139 (e) If permanent directors have not been elected under
140140 Section 8117.023 and the terms of the temporary directors have
141141 expired, successor temporary directors shall be appointed or
142142 reappointed as provided by Subsection (f) to serve terms that
143143 expire on the earlier of:
144144 (1) the date permanent directors are elected under
145145 Section 8117.023; or
146146 (2) the fourth anniversary of the date of the

148148 (f) If Subsection (e) applies, the owner or owners of a
149149 majority of the assessed value of the real property in the district
150150 may submit a petition to the commission requesting that the
151151 commission appoint as successor temporary directors the five
152152 persons named in the petition. The commission shall appoint as
153153 successor temporary directors the five persons named in the
154154 petition.
155155 SECTION 7. Section 8118.021, Special District Local Laws
156156 Code, is amended by amending Subsection (d) and adding Subsections
157157 (e) and (f) to read as follows:
158158 (d) Temporary directors serve until [the earlier of:
159159 [(1)] the date the directors are elected under Section
160160 8118.023[; or
161161 [(2) the date this chapter expires under Section
162162 8118.003].
163163 (e) If permanent directors have not been elected under
164164 Section 8118.023 and the terms of the temporary directors have
165165 expired, successor temporary directors shall be appointed or
166166 reappointed as provided by Subsection (f) to serve terms that
167167 expire on the earlier of:
168168 (1) the date permanent directors are elected under
169169 Section 8118.023; or
170170 (2) the fourth anniversary of the date of the

176176 persons named in the petition. The commission shall appoint as

178178 petition.
179179 SECTION 8. Section 8119.021, Special District Local Laws
180180 Code, is amended by amending Subsection (d) and adding Subsections
181181 (e) and (f) to read as follows:
182182 (d) Temporary directors serve until [the earlier of:
183183 [(1)] the date the directors are elected under Section
184184 8119.023[; or
185185 [(2) the date this chapter expires under Section
186186 8119.003].
187187 (e) If permanent directors have not been elected under
188188 Section 8119.023 and the terms of the temporary directors have
189189 expired, successor temporary directors shall be appointed or
190190 reappointed as provided by Subsection (f) to serve terms that
191191 expire on the earlier of:
192192 (1) the date permanent directors are elected under
193193 Section 8119.023; or
194194 (2) the fourth anniversary of the date of the
195195 appointment or reappointment.
196196 (f) If Subsection (e) applies, the owner or owners of a
197197 majority of the assessed value of the real property in the district
198198 may submit a petition to the commission requesting that the
199199 commission appoint as successor temporary directors the five
200200 persons named in the petition. The commission shall appoint as
201201 successor temporary directors the five persons named in the
202202 petition.
203203 SECTION 9. Section 8120.021, Special District Local Laws
204204 Code, is amended by amending Subsection (d) and adding Subsections
205205 (e) and (f) to read as follows:
206206 (d) Temporary directors serve until [the earlier of:
207207 [(1)] the date the directors are elected under Section
208208 8120.023[; or
209209 [(2) the date this chapter expires under Section
210210 8120.003].
211211 (e) If permanent directors have not been elected under
212212 Section 8120.023 and the terms of the temporary directors have
213213 expired, successor temporary directors shall be appointed or
214214 reappointed as provided by Subsection (f) to serve terms that
215215 expire on the earlier of:
216216 (1) the date permanent directors are elected under
217217 Section 8120.023; or
218218 (2) the fourth anniversary of the date of the
219219 appointment or reappointment.
220220 (f) If Subsection (e) applies, the owner or owners of a
221221 majority of the assessed value of the real property in the district
222222 may submit a petition to the commission requesting that the
223223 commission appoint as successor temporary directors the five
224224 persons named in the petition. The commission shall appoint as
225225 successor temporary directors the five persons named in the
226226 petition.
227227 SECTION 10. Section 8185.021, Special District Local Laws
228228 Code, is amended by amending Subsection (d) and adding Subsections
229229 (e) and (f) to read as follows:
230230 (d) Temporary directors serve until [the earlier of:
231231 [(1)] the date the directors are elected under Section
232232 8185.023[; or
233233 [(2) the date this chapter expires under Section
234234 8185.003].
235235 (e) If permanent directors have not been elected under
236236 Section 8185.023 and the terms of the temporary directors have
237237 expired, successor temporary directors shall be appointed or
238238 reappointed as provided by Subsection (f) to serve terms that
239239 expire on the earlier of:
240240 (1) the date permanent directors are elected under
241241 Section 8185.023; or
242242 (2) the fourth anniversary of the date of the
243243 appointment or reappointment.
244244 (f) If Subsection (e) applies, the owner or owners of a
245245 majority of the assessed value of the real property in the district
246246 may submit a petition to the commission requesting that the
247247 commission appoint as successor temporary directors the five
248248 persons named in the petition. The commission shall appoint as
249249 successor temporary directors the five persons named in the
250250 petition.
251251 SECTION 11. Sections 8112.003, 8112.026, 8113.003,
252252 8113.026, 8114.003, 8114.026, 8115.003, 8115.026, 8116.003,
253253 8116.026, 8117.003, 8117.026, 8118.003, 8118.026, 8119.003,
254254 8119.026, 8120.003, 8120.026, 8185.003, and 8185.026, Special
255255 District Local Laws Code, are repealed.
256256 SECTION 12. (a) The legal notice of the intention to
257257 introduce this Act, setting forth the general substance of this
258258 Act, has been published as provided by law, and the notice and a
259259 copy of this Act have been furnished to all persons, agencies,
260260 officials, or entities to which they are required to be furnished
261261 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
262262 Government Code.
263263 (b) The governor, one of the required recipients, has
264264 submitted the notice and Act to the Texas Commission on
265265 Environmental Quality.
266266 (c) The Texas Commission on Environmental Quality has filed
267267 its recommendations relating to this Act with the governor, the
268268 lieutenant governor, and the speaker of the house of
269269 representatives within the required time.
270270 (d) All requirements of the constitution and laws of this
271271 state and the rules and procedures of the legislature with respect
272272 to the notice, introduction, and passage of this Act are fulfilled
273273 and accomplished.
274274 SECTION 13. This Act takes effect immediately if it
275275 receives a vote of two-thirds of all the members elected to each
276276 house, as provided by Section 39, Article III, Texas Constitution.
277277 If this Act does not receive the vote necessary for immediate
278278 effect, this Act takes effect September 1, 2009.
