1010 Palo Pinto County; providing authority to impose a tax and issue
1111 bonds; granting a limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 3870 to read as follows:
1515 CHAPTER 3870. MAVERICK IMPROVEMENT DISTRICT
1616 OF PALO PINTO COUNTY
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 3870.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the board of directors of the
2020 district.
2121 (2) "Director" means a board member.
2222 (3) "District" means the Maverick Improvement
2323 District of Palo Pinto County.
2424 Sec. 3870.002. NATURE OF DISTRICT. The district is a
2525 special district created under Section 59, Article XVI, and
2626 Sections 52 and 52-a, Article III, Texas Constitution.
2727 Sec. 3870.003. CONFIRMATION AND DIRECTORS' ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect five permanent
3030 directors as provided by Section 49.102, Water Code.
3131 Sec. 3870.004. CONSENT OF MUNICIPALITY REQUIRED. The
3232 temporary directors may not hold an election under Section 3870.003
3333 until each municipality in whose corporate limits or
3434 extraterritorial jurisdiction the district is located has
3535 consented by ordinance or resolution to the creation of the
3636 district and to the inclusion of land in the district.
3737 Sec. 3870.005. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
3838 The district is created to serve a public purpose and benefit. By
3939 creating the district and in authorizing the county of Palo Pinto
4040 and other political subdivisions to contract with the district, the
4141 legislature has established a program to accomplish the public
4242 purposes set out in Section 52-a, Article III, Texas Constitution.
4343 (b) The district is created to accomplish the purposes of
4444 promoting, developing, encouraging, and maintaining employment,
4545 commerce, transportation, housing, tourism, recreation, economic
4646 development, safety, and the public welfare in the district, and to
4747 accomplish the purposes of:
4848 (1) a municipal utility district as provided by
4949 general law and Section 59, Article XVI, Texas Constitution;
5050 (2) a county development district as provided by
5151 general law and Section 52-a, Article III, Texas Constitution;
5252 (3) Section 52, Article III, Texas Constitution,
5353 related to the construction, acquisition, improvement, operation,
5454 or maintenance of macadamized, graveled, or paved roads, or
5555 improvements, including storm drainage, in aid of those roads; and
5656 (4) Section 52-a, Article III, Texas Constitution,
5757 related to the provision of public recreational facilities,
5858 including docks and boat access facilities, pedestrian ways and
5959 street lighting and parking, and the installation of signage and
6060 landscaping and the development of certain areas in the district
6161 that are necessary for the restoration, preservation, and
6262 enhancement of scenic beauty.
6363 Sec. 3870.006. INITIAL DISTRICT TERRITORY. (a) The
6464 district is initially composed of the territory described by
6565 Section 2 of the Act creating this chapter.
6666 (b) The boundaries and field notes contained in Section 2 of
6767 the Act creating this chapter form a closure. A mistake made in the
6868 field notes or in copying the field notes in the legislative process
6969 does not affect the district's:
7070 (1) organization, existence, or validity;
7171 (2) right to issue any type of bond for the purposes
7272 for which the district is created or to pay the principal of and
7373 interest on a bond;
7474 (3) right to impose a tax; or
7575 (4) legality or operation.

7777 SUBCHAPTER B. BOARD OF DIRECTORS
7878 Sec. 3870.051. GOVERNING BODY; TERMS. (a) The district is
7979 governed by a board of five elected directors.
8080 (b) Except as provided by Section 3870.052, directors serve
8181 staggered four-year terms.
8282 Sec. 3870.052. TEMPORARY DIRECTORS. (a) On or after
8383 September 1, 2009, the owner or owners of a majority of the assessed
8484 value of the real property in the district may submit a petition to
8585 the Texas Commission on Environmental Quality requesting that the
8686 commission appoint as temporary directors the five persons named in
8787 the petition. The commission shall appoint as temporary directors
8888 the five persons named in the petition.
8989 (b) Temporary directors serve until the earlier of:
9090 (1) the date permanent directors are elected under
9191 Section 3870.003; or
9292 (2) September 1, 2013.
9393 (c) If permanent directors have not been elected under
9494 Section 3870.003 and the terms of the temporary directors have
9595 expired, successor temporary directors shall be appointed or
9696 reappointed as provided by Subsection (d) to serve terms that
9797 expire on the earlier of:
9898 (1) the date permanent directors are elected under
9999 Section 3870.003; or
100100 (2) the fourth anniversary of the date of the
101101 appointment or reappointment.
102102 (d) If Subsection (c) applies, the owner or owners of a
103103 majority of the assessed value of the real property in the district
104104 may submit a petition to the commission requesting that the
105105 commission appoint as successor temporary directors the five
106106 persons named in the petition. The commission shall appoint as
107107 successor temporary directors the five persons named in the
108108 petition.

110110 SUBCHAPTER C. POWERS AND DUTIES
111111 Sec. 3870.101. GENERAL POWERS AND DUTIES. The district has
112112 the powers and duties necessary to accomplish the purposes for
113113 which the district is created.
114114 Sec. 3870.102. MUNICIPAL UTILITY DISTRICT POWERS AND
115115 DUTIES. The district has the powers and duties provided by the
116116 general law of this state, including Chapters 49 and 54, Water Code,
117117 applicable to municipal utility districts created under Section 59,
118118 Article XVI, Texas Constitution.
119119 Sec. 3870.103. ROAD PROJECTS. Under Section 52, Article
120120 III, Texas Constitution, the district may design, acquire,
121121 construct, finance, improve, operate, and maintain macadamized,
122122 graveled, or paved roads, or improvements, including storm
123123 drainage, in aid of those roads, and may convey those roads or
124124 improvements to this state, a county, or a municipality to operate
125125 and maintain.
126126 Sec. 3870.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
127127 project must meet all applicable construction standards, zoning and
128128 subdivision requirements, and regulatory ordinances of a
129129 municipality in whose corporate limits or extraterritorial
130130 jurisdiction the road project is located.
131131 (b) If a road project is not located in the corporate limits
132132 or extraterritorial jurisdiction of a municipality, the road
133133 project must meet all applicable construction standards, zoning and
134134 subdivision requirements, and orders of a county in which the road
135135 project is located.
136136 (c) If the state will maintain and operate the road, the
137137 Texas Transportation Commission must approve the plans and
138138 specifications of the road project.
139139 Sec. 3870.105. COMPLIANCE WITH MUNICIPAL CONSENT
140140 ORDINANCES OR RESOLUTIONS. The district shall comply with all
141141 applicable requirements of any ordinance or resolution adopted by
142142 the governing body of a municipality under Section 54.016 or
143143 54.0165, Water Code, that consents to the creation of the district
144144 or to the inclusion of land in the district.
145145 Sec. 3870.106. LIMITATION ON USE OF EMINENT DOMAIN. The
146146 district may exercise the power of eminent domain only inside the
147147 district's boundaries.
148148 Sec. 3870.107. AGREEMENTS; GRANTS. (a) The district may
149149 make an agreement with or accept a gift, grant, or loan from any
150150 person.
151151 (b) The board may enter into a contract with another
152152 political subdivision or the state to share the costs of
153153 construction, acquisition, operation, or maintenance of a
154154 transportation improvement, including a road, a bridge, a culvert,
155155 a parking facility, or another public improvement.
156156 (c) The implementation of a district project is a
157157 governmental function or service for the purposes of Chapter 791,
158158 Government Code.
159159 Sec. 3870.108. DIVISION OF DISTRICT. (a) The district may
160160 be divided into two or more new districts only if the district:
161161 (1) has no outstanding bonded debt; and
162162 (2) is not imposing ad valorem taxes.
163163 (b) This chapter applies to any new district created by the
164164 division of the district, and a new district has all the powers and
165165 duties of the district.
166166 (c) Any new district created by the division of the district
167167 may not, at the time the new district is created, contain any land
168168 outside the area described by Section 2 of the Act creating this
169169 chapter.
170170 (d) The board, on its own motion or on receipt of a petition
171171 signed by the owners of a majority of the assessed value of real
172172 property in the district according to the most recent certified
173173 appraisal roll for the county in which the district is located, may
174174 adopt an order dividing the district. An order dividing the
175175 district may be adopted before or after an election to confirm the
176176 district as required by Section 3870.003.
177177 (e) The board may adopt an order dividing the district
178178 before or after the date the board holds an election under Section
179179 3870.003 to confirm the district's creation.
180180 (f) An order dividing the district shall:
181181 (1) name each new district;
182182 (2) include the metes and bounds of each new district;
183183 (3) appoint temporary directors for each new district;
184184 and
185185 (4) provide for the division of assets and liabilities
186186 between each new district.
187187 (g) On or before the 30th day after the adoption of an order
188188 dividing the district, the district shall file the order dividing
189189 the district with the Texas Commission on Environmental Quality and
190190 record the order in the real property records of the county in which
191191 the district is located.
192192 (h) Any new district created by the division of the district
193193 shall hold a confirmation and directors' election as required by
194194 Section 49.102, Water Code.
195195 (i) Municipal consent to the creation of the district and to
196196 the inclusion of land in the district granted under Section
197197 3870.004 acts as municipal consent to the creation of any new
198198 district created by the division of the district and to the
199199 inclusion of land in the new district.
200200 (j) Any new district created by the division of the district
201201 must hold an election in the manner provided by Chapters 49 and 54,
202202 Water Code, to obtain voter approval before the district may impose
203203 a maintenance tax or issue bonds payable wholly or partly from ad
204204 valorem taxes.

206206 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
207207 Sec. 3870.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
208208 district may issue, without an election, bonds and other
209209 obligations secured by:
210210 (1) revenue other than ad valorem taxes; or
211211 (2) contract payments described by Section 3870.153.
212212 (b) The district must hold an election in the manner
213213 provided by Chapters 49 and 54, Water Code, to obtain voter approval
214214 before the district may impose an ad valorem tax or issue bonds
215215 payable from ad valorem taxes.
216216 (c) The district may not issue bonds payable from ad valorem
217217 taxes to finance a road project unless the issuance is approved by a
218218 vote of a two-thirds majority of the district voters voting at an
219219 election held for that purpose.
220220 Sec. 3870.152. OPERATION AND MAINTENANCE TAX. (a) If
221221 authorized at an election held under Section 3870.151, the district
222222 may impose an operation and maintenance tax on taxable property in
223223 the district as provided by Section 49.107, Water Code.
224224 (b) The board shall determine the tax rate. The rate may not
225225 exceed the rate approved at the election.
226226 Sec. 3870.153. CONTRACT TAXES. (a) As provided by Section
227227 49.108, Water Code, the district may impose a tax other than an
228228 operation and maintenance tax and use the revenue derived from the
229229 tax to make payments under a contract after the provisions of the
230230 contract have been approved by a majority of the district voters
231231 voting at an election held for that purpose.
232232 (b) A contract approved by the district voters may contain a
233233 provision stating that the contract may be modified or amended by
234234 the board without further voter approval.
235235 Sec. 3870.154. POWERS OF COUNTY DEVELOPMENT DISTRICT. The
236236 district has the powers of a county development district provided
237237 by Chapter 383, Local Government Code.
238238 Sec. 3870.155. SALES AND USE TAX; ELECTION. (a) The
239239 district may adopt a sales and use tax as provided by Chapter 383,
240240 Local Government Code, after an election in which the majority of
241241 the voters of the district voting in the election authorize the
242242 adoption of the tax.
243243 (b) The board by order may call an election to authorize a
244244 sales and use tax. The election may be held with any other district
245245 election.
246246 (c) The district shall provide notice of the election and
247247 shall hold the election in the manner prescribed by Section
248248 3870.151.
249249 Sec. 3870.156. SALES AND USE TAX RATE. (a) On adoption of
250250 the tax authorized by Section 3870.155, there is imposed a tax on
251251 the receipts from the sale at retail of taxable items within the
252252 district, and an excise tax on the use, storage, or other
253253 consumption in the district of taxable items purchased, leased, or
254254 rented from a retailer in the district during the period after the
255255 tax is in effect.
256256 (b) The board shall determine the rate of the tax, which may
257257 be in one-eighth of one percent increments not to exceed the maximum
258258 rate authorized by the district voters at the election. The board
259259 may lower the tax rate to the extent it does not impair any
260260 outstanding debt or obligations payable from the tax.
261261 Sec. 3870.157. HOTEL OCCUPANCY TAX. (a) In this section,
262262 "hotel" has the meaning assigned by Section 156.001, Tax Code.
263263 (b) For purposes of this section, a reference in Subchapter
264264 A, Chapter 352, Tax Code, to a county is a reference to the district
265265 and a reference in Subchapter A, Chapter 352, Tax Code, to the
266266 county's officers or governing body is a reference to the board.
267267 (c) Except as inconsistent with this section, Subchapter A,
268268 Chapter 352, Tax Code, governs a hotel occupancy tax authorized by
269269 this section, including the collection of the tax, subject to the
270270 limitations prescribed by Sections 352.002(b) and (c), Tax Code.
271271 (d) The district may impose a hotel occupancy tax for any
272272 district purpose, including to:
273273 (1) maintain and operate the district;
274274 (2) construct or acquire improvements; and
275275 (3) provide a service.
276276 (e) The district may examine and receive information
277277 related to the imposition of hotel occupancy taxes to the same
278278 extent as if the district were a county.

280280 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
281281 Sec. 3870.201. AUTHORITY TO ISSUE BONDS AND OTHER
282282 OBLIGATIONS. The district may issue bonds or other obligations
283283 payable wholly or partly from ad valorem taxes, impact fees,
284284 revenue, contract payments, grants, or other district money, or any
285285 combination of those sources, to pay for any authorized district
286286 purpose.
287287 Sec. 3870.202. TAXES FOR BONDS. At the time the district
288288 issues bonds payable wholly or partly from ad valorem taxes, the
289289 board shall provide for the annual imposition of a continuing
290290 direct ad valorem tax, without limit as to rate or amount, while all
291291 or part of the bonds are outstanding as required and in the manner
292292 provided by Sections 54.601 and 54.602, Water Code.
293293 Sec. 3870.203. BONDS FOR ROAD PROJECTS. At the time of
294294 issuance, the total principal amount of bonds or other obligations
295295 issued or incurred to finance road projects and payable from ad
296296 valorem taxes may not exceed one-fourth of the assessed value of the
297297 real property in the district.

609609 SECTION 3. (a) The legal notice of the intention to
610610 introduce this Act, setting forth the general substance of this
611611 Act, has been published as provided by law, and the notice and a
612612 copy of this Act have been furnished to all persons, agencies,
613613 officials, or entities to which they are required to be furnished
614614 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
615615 Government Code.
616616 (b) The governor, one of the required recipients, has
617617 submitted the notice and Act to the Texas Commission on
618618 Environmental Quality.
619619 (c) The Texas Commission on Environmental Quality has filed
620620 its recommendations relating to this Act with the governor, the
621621 lieutenant governor, and the speaker of the house of
622622 representatives within the required time.
623623 (d) All requirements of the constitution and laws of this
624624 state and the rules and procedures of the legislature with respect
625625 to the notice, introduction, and passage of this Act are fulfilled
626626 and accomplished.
627627 SECTION 4. This Act takes effect September 1, 2009.
