88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8315 to read as follows:
1111 CHAPTER 8315. BURNET COUNTY MUNICIPAL UTILITY DISTRICT NO. 3
1212 SUBCHAPTER A. GENERAL PROVISIONS
1313 Sec. 8315.001. DEFINITIONS. In this chapter:
1414 (1) "Board" means the district's board of directors.
1515 (2) "Director" means a board member.
1616 (3) "District" means the Burnet County Municipal
1717 Utility District No. 3.
1818 Sec. 8315.002. NATURE OF DISTRICT. The district is a
1919 municipal utility district created under Section 59, Article XVI,
2020 Texas Constitution.
2121 Sec. 8315.003. CONFIRMATION AND DIRECTORS' ELECTION
2222 REQUIRED. The temporary directors shall hold an election to
2323 confirm the creation of the district and to elect five permanent
2424 directors as provided by Section 49.102, Water Code.
2525 Sec. 8315.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
2626 temporary directors may not hold an election under Section 8315.003
2727 until each municipality in whose corporate limits or
2828 extraterritorial jurisdiction the district is located has
2929 consented by ordinance or resolution to the creation of the
3030 district and to the inclusion of land in the district.
3131 (b) A municipality may not provide consent under Subsection
3232 (a) until the municipality and the owner or owners of the territory
3333 described by Section 2 of the Act creating this chapter have
3434 executed an annexation agreement governing the municipality's
3535 eventual annexation of the territory. The municipality may
3636 incorporate any of the terms of the annexation agreement into the
3737 ordinance or resolution described by Subsection (a).
3838 Sec. 8315.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3939 The district is created to serve a public purpose and benefit.
4040 (b) The district is created to accomplish the purposes of:
4141 (1) a municipal utility district as provided by
4242 general law and Section 59, Article XVI, Texas Constitution; and
4343 (2) Section 52, Article III, Texas Constitution, that
4444 relate to the construction, acquisition, improvement, operation,
4545 or maintenance of macadamized, graveled, or paved roads, or
4646 improvements, including storm drainage, in aid of those roads.
4747 Sec. 8315.006. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act creating this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act creating this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.

6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8315.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8315.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8315.052. TEMPORARY DIRECTORS. (a) On or after the
6767 effective date of the Act creating this chapter, the owner or owners
6868 of a majority of the assessed value of the real property in the
6969 district may submit a petition to the Texas Commission on
7070 Environmental Quality requesting that the commission appoint as
7171 temporary directors the five persons named in the petition. The
7272 commission shall appoint as temporary directors the five persons
7373 named in the petition.
7474 (b) Temporary directors serve until the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8315.003; or
7777 (2) the fourth anniversary of the effective date of
7878 the Act creating this chapter.
7979 (c) If permanent directors have not been elected under
8080 Section 8315.003 and the terms of the temporary directors have
8181 expired, successor temporary directors shall be appointed or
8282 reappointed as provided by Subsection (d) to serve terms that
8383 expire on the earlier of:
8484 (1) the date permanent directors are elected under
8585 Section 8315.003; or
8686 (2) the fourth anniversary of the date of the
8787 appointment or reappointment.
8888 (d) If Subsection (c) applies, the owner or owners of a
8989 majority of the assessed value of the real property in the district
9090 may submit a petition to the Texas Commission on Environmental
9191 Quality requesting that the commission appoint as successor
9292 temporary directors the five persons named in the petition. The
9393 commission shall appoint as successor temporary directors the five
9494 persons named in the petition.

9696 SUBCHAPTER C. POWERS AND DUTIES
9797 Sec. 8315.101. GENERAL POWERS AND DUTIES. The district has
9898 the powers and duties necessary to accomplish the purposes for
9999 which the district is created.
100100 Sec. 8315.102. MUNICIPAL UTILITY DISTRICT POWERS AND
101101 DUTIES. The district has the powers and duties provided by the
102102 general law of this state, including Chapters 49 and 54, Water Code,
103103 applicable to municipal utility districts created under Section 59,
104104 Article XVI, Texas Constitution.
105105 Sec. 8315.103. AUTHORITY FOR ROAD PROJECTS. Under Section
106106 52, Article III, Texas Constitution, the district may design,
107107 acquire, construct, finance, issue bonds for, improve, operate,
108108 maintain, and convey to this state, a county, or a municipality for
109109 operation and maintenance macadamized, graveled, or paved roads, or
110110 improvements, including storm drainage, in aid of those roads.
111111 Sec. 8315.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
112112 project must meet all applicable construction standards, zoning and
113113 subdivision requirements, and regulations of each municipality in
114114 whose corporate limits or extraterritorial jurisdiction the road
115115 project is located.
116116 (b) If a road project is not located in the corporate limits
117117 or extraterritorial jurisdiction of a municipality, the road
118118 project must meet all applicable construction standards,
119119 subdivision requirements, and regulations of each county in which
120120 the road project is located.
121121 (c) If the state will maintain and operate the road, the
122122 Texas Transportation Commission must approve the plans and
123123 specifications of the road project.
124124 Sec. 8315.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
125125 OR RESOLUTION. (a) The district shall comply with all applicable
126126 requirements of any ordinance or resolution that is adopted under
127127 Section 54.016 or 54.0165, Water Code, and that consents to the
128128 creation of the district or to the inclusion of land in the
129129 district.
130130 (b) In addition to all the rights and remedies provided by
131131 other law, if the district violates the terms of an ordinance or
132132 resolution described by Subsection (a), the municipality is
133133 entitled to injunctive relief or a writ of mandamus issued by a
134134 court requiring the district and the district's officials to
135135 observe and comply with the terms of the ordinance or resolution.
136136 Sec. 8315.106. ANNEXATION OF DISTRICT BY MUNICIPALITY. (a)
137137 A municipality may annex all or part of the territory of the
138138 district or any new district created by the division of the district
139139 only as provided by an annexation agreement described by Section
140140 8315.004(b).
141141 (b) A municipality is not required to annex any part of the
142142 district's territory that is outside the corporate boundaries of
143143 the municipality.
144144 (c) A municipality is not required to assume control and
145145 operation of the district or a new district created by division of
146146 the district on annexation of all or part of the territory of the
147147 district or new district, but the municipality may assume control
148148 and operation of the district or a new district and dissolve the
149149 district or new district if:
150150 (1) the municipality has annexed all of the territory
151151 of the district or new district;
152152 (2) the water and wastewater facilities required to
153153 serve at least 95 percent of the lots in the district or new
154154 district, as set out by a final plat, have been completed; and
155155 (3) the municipality has complied with the
156156 requirements of Section 43.075, Local Government Code.
157157 (d) Notwithstanding Section 54.016(f)(2), Water Code, a
158158 contract between a municipality and the district or new district
159159 that provides for the allocation of the taxes or revenues of the
160160 district and the municipality following the date of inclusion of
161161 all or part of the district's territory in the corporate limits of
162162 the municipality, may provide that the total annual ad valorem
163163 taxes collected by the municipality and the district from taxable
164164 property in the district may exceed the city's ad valorem tax on the
165165 property.
166166 Sec. 8315.107. LIMITATION ON CREATION OF OTHER MUNICIPAL
167167 UTILITY DISTRICTS. Before December 31, 2011, the Texas Commission
168168 on Environmental Quality may not grant a petition under Chapter 54,
169169 Water Code, to create a municipal utility district if the district
170170 contains any territory described by Section 2 of the Act creating
171171 this chapter.
172172 Sec. 8315.108. LIMITATION ON ANNEXATION OF LAND BY
173173 DISTRICT. (a) The district or any new district created by the
174174 division of the district may not annex land unless:
175175 (1) the owner or owners of the land have provided
176176 written consent to the annexation; and
177177 (2) the land is adjacent to the district or new
178178 district.
179179 (b) The district must complete an annexation authorized by
180180 this section not later than the first anniversary of the date the
181181 district or new district receives written consent from the owner or
182182 owners of the land.
183183 (c) An owner of land may revoke the owner's consent to
184184 annexation before the annexation is completed by notifying the
185185 district or new district in writing that the consent is revoked.
186186 (d) For purposes of this section, a petition by an owner of
187187 land for annexation to the district that meets the requirements of
188188 Chapter 49, Water Code, satisfies the requirement of written
189189 consent under Subsection (a).
190190 Sec. 8315.109. LIMITATION ON USE OF EMINENT DOMAIN. The
191191 district may not exercise the power of eminent domain outside the
192192 district to acquire a site or easement for:
193193 (1) a road project authorized by Section 8315.103; or
194194 (2) a recreational facility as defined by Section
195195 49.462, Water Code.
196196 Sec. 8315.110. DIVISION OF DISTRICT. (a) The district may
197197 be divided into two or more new districts only if the district:
198198 (1) has no outstanding bonded debt; and
199199 (2) is not imposing ad valorem taxes.
200200 (b) This chapter applies to any new district created by the
201201 division of the district, and a new district has all the powers and
202202 duties of the district.
203203 (c) Any new district created by the division of the district
204204 may not, at the time the new district is created, contain any land
205205 outside the area described by Section 2 of the Act creating this
206206 chapter.
207207 (d) The board, on its own motion or on receipt of a petition
208208 signed by the owner or owners of a majority of the assessed value of
209209 the real property in the district, may adopt an order dividing the
210210 district.
211211 (e) The board may adopt an order dividing the district
212212 before or after the date the board holds an election under Section
213213 8315.003 to confirm the district's creation.
214214 (f) An order dividing the district shall:
215215 (1) name each new district;
216216 (2) include the metes and bounds description of the
217217 territory of each new district;
218218 (3) appoint temporary directors for each new district
219219 or provide that the owner or owners of a majority of the assessed
220220 value of the real property in each new district may submit a
221221 petition to the Texas Commission on Environmental Quality
222222 requesting that the commission appoint as temporary directors the
223223 five persons named in the petition; and
224224 (4) provide for the division of assets and liabilities
225225 between or among the new districts.
226226 (g) On or before the 30th day after the date of adoption of
227227 an order dividing the district, the district shall file the order
228228 with the Texas Commission on Environmental Quality and record the
229229 order in the real property records of each county in which the
230230 district is located.
231231 (h) Any new district created by the division of the district
232232 shall hold a confirmation and directors' election as required by
233233 Section 8315.003. A new district that is not confirmed is subject
234234 to dissolution under general law.
235235 (i) Municipal consent to the creation of the district and to
236236 the inclusion of land in the district granted under Section
237237 8315.004 acts as municipal consent to the creation of any new
238238 district created by the division of the district and to the
239239 inclusion of land in the new district.
240240 (j) Any new district created by the division of the district
241241 must hold an election as required by this chapter to obtain voter
242242 approval before the district may impose a maintenance tax or issue
243243 bonds payable wholly or partly from ad valorem taxes.

245245 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
246246 Sec. 8315.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
247247 district may issue, without an election, bonds and other
248248 obligations secured by:
249249 (1) revenue other than ad valorem taxes; or
250250 (2) contract payments described by Section 8315.153.
251251 (b) The district must hold an election in the manner
252252 provided by Chapters 49 and 54, Water Code, to obtain voter approval
253253 before the district may impose an ad valorem tax or issue bonds
254254 payable from ad valorem taxes.
255255 (c) The district may not issue bonds payable from ad valorem
256256 taxes to finance a road project unless the issuance is approved by a
257257 vote of a two-thirds majority of the district voters voting at an
258258 election held for that purpose.
259259 Sec. 8315.152. OPERATION AND MAINTENANCE TAX. (a) If
260260 authorized at an election held under Section 8315.151, the district
261261 may impose an operation and maintenance tax on taxable property in
262262 the district in accordance with Section 49.107, Water Code.
263263 (b) The board shall determine the tax rate. The rate may not
264264 exceed the rate approved at the election.
265265 Sec. 8315.153. CONTRACT TAXES. (a) In accordance with
266266 Section 49.108, Water Code, the district may impose a tax other than
267267 an operation and maintenance tax and use the revenue derived from
268268 the tax to make payments under a contract after the provisions of
269269 the contract have been approved by a majority of the district voters
270270 voting at an election held for that purpose.
271271 (b) A contract approved by the district voters may contain a
272272 provision stating that the contract may be modified or amended by
273273 the board without further voter approval.

275275 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
276276 Sec. 8315.201. AUTHORITY TO ISSUE BONDS AND OTHER
277277 OBLIGATIONS. The district may issue bonds or other obligations
278278 payable wholly or partly from ad valorem taxes, impact fees,
279279 revenue, contract payments, grants, or other district money, or any
280280 combination of those sources, to pay for any authorized district
281281 purpose.
282282 Sec. 8315.202. TAXES FOR BONDS. At the time the district
283283 issues bonds payable wholly or partly from ad valorem taxes, the
284284 board shall provide for the annual imposition of a continuing
285285 direct ad valorem tax, without limit as to rate or amount, while all
286286 or part of the bonds are outstanding as required and in the manner
287287 provided by Sections 54.601 and 54.602, Water Code.
288288 Sec. 8315.203. BONDS FOR ROAD PROJECTS. At the time of
289289 issuance, the total principal amount of bonds or other obligations
290290 issued or incurred to finance road projects and payable from ad
291291 valorem taxes may not exceed one-fourth of the assessed value of the
292292 real property in the district.
293293 SECTION 2. The Burnet County Municipal Utility District No.
294294 3 initially includes all the territory contained in the following
295295 area:
296296 TRACT NO. 1
297297 BEING 144.14 acres of land out of the Arthur Luckey Survey No. 23
298298 Abstract No. 530 in Burnet County, Texas and being comprised of part
299299 of that 147 acre tract conveyed to Troy Ben Fox in Vol. 1294 at Page
300300 957 of the OFFICIAL PUBLIC RECORDS of Burnet County, Texas and part
301301 of that 36.65 acre tract conveyed to Troy Ben Fox in Vol. 1294 at
302302 Page 957 of the OFFICIAL PUBLIC RECORDS of Burnet County, Texas and
303303 including Lot Nos. 18 through 30 in CIRCLE B ESTATES, Section 1, a
304304 subdivision of record in Vol. 2 at Page 90 of the PLAT RECORDS of
305305 Burnet County, Texas, said 144.14 acres being more particularly
306306 described as follows:
307307 BEGINNING at a reentrant corner of said 36.65 acre tract and the
308308 Southwest corner of that 184.31 acre tract described in Release of
309309 Lien to Troy Ben Fox as recorded in Vol. 1273 at Page 888 of the
310310 OFFICIAL PUBLIC RECORDS of Burnet County, Texas for a Northwesterly
311311 corner hereof;
312312 THENCE N 64 01' 47" E along the common boundary of said 184.31 acre
313313 tract 2625.76 ft., to the Southeast corner of said 184.31 acre tract
314314 and a westerly corner of that 131.606 acre tract described in Deed
315315 to the City of Granite Shoals as recorded in Document No. 0803603 of
316316 the OFFICIAL PUBLIC RECORDS of Burnet County, Texas in the easterly
