77 relating to the creation of Waller Town Center Management District;
88 providing authority to impose an assessment, impose a tax, and
99 issue bonds; and granting a limited power of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1212 Code, is amended by adding Chapter 3877 to read as follows:
1313 CHAPTER 3877. WALLER TOWN CENTER MANAGEMENT DISTRICT
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 3877.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Waller Town Center Management
1919 District.
2020 Sec. 3877.002. NATURE OF DISTRICT. The Waller Town Center
2121 Management District is a special district created under Section 59,
2222 Article XVI, Texas Constitution.
2323 Sec. 3877.003. PURPOSE; DECLARATION OF INTENT. (a) The
2424 creation of the district is essential to accomplish the purposes of
2525 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2626 Texas Constitution, and other public purposes stated in this
2727 chapter. By creating the district and in authorizing the City of
2828 Waller, Harris County, and other political subdivisions to contract
2929 with the district, the legislature has established a program to
3030 accomplish the public purposes set out in Section 52-a, Article
3131 III, Texas Constitution.
3232 (b) The creation of the district is necessary to promote,
3333 develop, encourage, and maintain employment, commerce,
3434 transportation, housing, tourism, recreation, the arts,
3535 entertainment, economic development, safety, and the public
3636 welfare in the district.
3737 (c) This chapter and the creation of the district may not be
3838 interpreted to relieve Harris County from providing the level of
3939 services provided, as of the effective date of the Act enacting this
4040 chapter, to the area in the district. The district is created to
4141 supplement and not to supplant the county services provided in the
4242 area in the district.
4343 Sec. 3877.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
4444 The district is created to serve a public use and benefit.
4545 (b) All land and other property included in the district
4646 will benefit from the improvements and services to be provided by
4747 the district under powers conferred by Sections 52 and 52-a,
4848 Article III, and Section 59, Article XVI, Texas Constitution, and
4949 other powers granted under this chapter.
5050 (c) The creation of the district is in the public interest
5151 and is essential to:
5252 (1) further the public purposes of developing and
5353 diversifying the economy of the state;
5454 (2) eliminate unemployment and underemployment; and
5555 (3) develop or expand transportation and commerce.
5656 (d) The district will:
5757 (1) promote the health, safety, and general welfare of
5858 residents, employers, potential employees, employees, visitors,
5959 and consumers in the district, and of the public;
6060 (2) provide needed funding for the district to
6161 preserve, maintain, and enhance the economic health and vitality of
6262 the district territory as a community and business center;
6363 (3) promote the health, safety, welfare, and enjoyment
6464 of the public by providing pedestrian ways and by landscaping and
6565 developing certain areas in the district, which are necessary for
6666 the restoration, preservation, and enhancement of scenic beauty;
6767 and
6868 (4) provide for water, wastewater, drainage, road, and
6969 recreational facilities for the district.
7070 (e) Pedestrian ways along or across a street, whether at
7171 grade or above or below the surface, and street lighting, street
7272 landscaping, parking, and street art objects are parts of and
7373 necessary components of a street and are considered to be a street
7474 or road improvement.
7575 (f) The district will not act as the agent or
7676 instrumentality of any private interest even though the district
7777 will benefit many private interests as well as the public.
7878 Sec. 3877.005. INITIAL DISTRICT TERRITORY. (a) The
7979 district is initially composed of the territory described by
8080 Section 2 of the Act enacting this chapter.
8181 (b) The boundaries and field notes contained in Section 2 of
8282 the Act enacting this chapter form a closure. A mistake in the
8383 field notes or in copying the field notes in the legislative process
8484 does not affect the district's:
8585 (1) organization, existence, or validity;
8686 (2) right to issue any type of bond for the purposes
8787 for which the district is created or to pay the principal of and
8888 interest on the bond;
8989 (3) right to impose or collect an assessment or tax; or
9090 (4) legality or operation.
9191 Sec. 3877.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9292 All or any part of the area of the district is eligible to be
9393 included in:
9494 (1) a tax increment reinvestment zone created under
9595 Chapter 311, Tax Code;
9696 (2) a tax abatement reinvestment zone created under
9797 Chapter 312, Tax Code; or
9898 (3) an enterprise zone created under Chapter 2303,
9999 Government Code.
100100 Sec. 3877.007. APPLICABILITY OF MUNICIPAL MANAGEMENT
101101 DISTRICTS LAW. Except as otherwise provided by this chapter,
102102 Chapter 375, Local Government Code, applies to the district.
103103 Sec. 3877.008. LIBERAL CONSTRUCTION OF CHAPTER. This
104104 chapter shall be liberally construed in conformity with the
105105 findings and purposes stated in this chapter.

107107 SUBCHAPTER B. BOARD OF DIRECTORS
108108 Sec. 3877.051. GOVERNING BODY; TERMS. (a) The district is
109109 governed by a board of five elected directors.
110110 (b) Except as provided by Section 3877.052, directors serve
111111 staggered four-year terms, with two or three directors elected in
112112 even-numbered years on the uniform election date in May prescribed
113113 by the Election Code.
114114 (c) Section 54.102, Water Code, applies to directors.
115115 Section 375.063, Local Government Code, does not apply to
116116 directors.
117117 Sec. 3877.052. TEMPORARY DIRECTORS. (a) The initial
118118 temporary board consists of:

125125 (b) The temporary directors shall hold an election to elect
126126 five permanent directors.
127127 (c) Temporary directors serve until the earlier of:
128128 (1) the date permanent directors are elected under
129129 Subsection (b); or
130130 (2) the fourth anniversary of the effective date of
131131 the Act enacting this chapter.
132132 (d) If permanent directors have not been elected under
133133 Subsection (b) and the terms of the temporary directors have
134134 expired, successor temporary directors shall be appointed or
135135 reappointed as provided by Subsection (e) to serve terms that
136136 expire on the earlier of:
137137 (1) the date permanent directors are elected under
138138 Subsection (b); or
139139 (2) the fourth anniversary of the date of the
140140 appointment or reappointment.
141141 (e) If Subsection (d) applies, the owner or owners of a
142142 majority of the assessed value of the real property in the district
143143 may submit a petition to the Texas Commission on Environmental
144144 Quality requesting that the commission appoint as successor
145145 temporary directors the five persons named in the petition. The
146146 commission shall appoint as successor temporary directors the five
147147 persons named in the petition.
148148 Sec. 3877.053. COMPENSATION. A director is entitled to
149149 receive fees of office and reimbursement for actual expenses as
150150 provided by Section 49.060, Water Code. Sections 375.069 and
151151 375.070, Local Government Code, do not apply to the board.

153153 SUBCHAPTER C. POWERS AND DUTIES
154154 Sec. 3877.101. DEVELOPMENT CORPORATION POWERS. The
155155 district may exercise the powers given to a development corporation
156156 under Chapter 505, Local Government Code, including the power to
157157 own, operate, acquire, construct, lease, improve, or maintain a
158158 project described by that section.
159159 Sec. 3877.102. NONPROFIT CORPORATION. (a) The board by
160160 resolution may authorize the creation of a nonprofit corporation to
161161 assist and act for the district in implementing a project or
162162 providing a service authorized by this chapter.
163163 (b) The nonprofit corporation:
164164 (1) has each power of and is considered for purposes of
165165 this chapter to be a local government corporation created under
166166 Chapter 431, Transportation Code; and
167167 (2) may implement any project and provide any service
168168 authorized by this chapter.
169169 (c) The board shall appoint the board of directors of the
170170 nonprofit corporation. The board of directors of the nonprofit
171171 corporation shall serve in the same manner as the board of directors
172172 of a local government corporation created under Chapter 431,
173173 Transportation Code, except that a board member is not required to
174174 reside in the district.
175175 Sec. 3877.103. AGREEMENTS; GRANTS. (a) The district may
176176 make an agreement with or accept a gift, grant, or loan from any
177177 person.
178178 (b) The implementation of a project is a governmental
179179 function or service for the purposes of Chapter 791, Government
180180 Code.
181181 Sec. 3877.104. AUTHORITY TO CONTRACT FOR LAW ENFORCEMENT.
182182 To protect the public interest, the district may contract with a
183183 qualified party, including Harris County or the City of Waller, for
184184 the provision of law enforcement services in the district for a fee.
185185 Sec. 3877.105. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
186186 district may join and pay dues to a charitable or nonprofit
187187 organization that performs a service or provides an activity
188188 consistent with the furtherance of a district purpose.
189189 Sec. 3877.106. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
190190 district may establish and provide for the administration of one or
191191 more programs to promote state or local economic development and to
192192 stimulate business and commercial activity in the district,
193193 including programs to:
194194 (1) make loans and grants of public money; and
195195 (2) provide district personnel and services.
196196 (b) The district has all of the powers of a municipality
197197 under Chapter 380, Local Government Code.
198198 Sec. 3877.107. STRATEGIC PARTNERSHIP AGREEMENT. The
199199 district may negotiate and enter into a written strategic
200200 partnership with the City of Waller under Section 43.0751, Local
201201 Government Code.
202202 Sec. 3877.108. LIMITED EMINENT DOMAIN. (a) Section
203203 375.094, Local Government Code, does not apply to the district.
204204 (b) The district may exercise the power of eminent domain in
205205 accordance with Section 49.222, Water Code.
206206 (c) The district may not exercise the power of eminent
207207 domain outside the district boundaries to acquire:
208208 (1) a site for a water treatment plant, potable water
209209 storage facility, wastewater treatment plant, or wastewater
210210 disposal plant;
211211 (2) a recreational facility as defined by Section
212212 49.462, Water Code; or
213213 (3) a site for a road project.
214214 Sec. 3877.109. ANNEXATION OR EXCLUSION OF LAND. (a) The
215215 district may annex land as provided by Subchapter J, Chapter 49,
216216 Water Code.
217217 (b) The district may exclude land as provided by Subchapter
218218 J, Chapter 49, Water Code. Section 375.044(b), Local Government
219219 Code, does not apply to the district.

221221 SUBCHAPTER D. PUBLIC PARKING FACILITIES
222222 Sec. 3877.151. PARKING FACILITIES AUTHORIZED; OPERATION BY
223223 PRIVATE ENTITY; TAX EXEMPTION. (a) The district may acquire, lease
224224 as lessor or lessee, construct, develop, own, operate, and maintain
225225 parking facilities or a system of parking facilities, including:
226226 (1) lots, garages, parking terminals, or other
227227 structures or accommodations for parking motor vehicles off the
228228 streets; and
229229 (2) equipment, entrances, exits, fencing, and other
230230 accessories necessary for safety and convenience in parking
231231 vehicles.
232232 (b) A parking facility of the district may be leased to, or
233233 operated for the district by, an entity other than the district.
234234 (c) The district's parking facilities are a program
235235 authorized by the legislature under Section 52-a, Article III,
236236 Texas Constitution.
237237 (d) The district's parking facilities serve the public
238238 purposes of the district and are owned, used, and held for a public
239239 purpose even if leased or operated by a private entity for a term of
240240 years.
241241 (e) The district's public parking facilities and any lease
242242 to a private entity are exempt from the payment of ad valorem taxes
243243 and state and local sales and use taxes.
244244 Sec. 3877.152. RULES. The district may adopt rules
245245 covering its public parking system.
246246 Sec. 3877.153. FINANCING OF PARKING FACILITIES. (a) The
247247 district may use any of its resources, including revenue,
248248 assessments, taxes, or grant or contract proceeds, to pay the cost
249249 of acquiring or operating public parking facilities.
250250 (b) The district may:
251251 (1) set, charge, impose, and collect fees, charges, or
252252 tolls for the use of the public parking facilities; and
253253 (2) issue bonds or notes to finance the cost of these
254254 facilities.

256256 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
257257 Sec. 3877.201. DISBURSEMENTS AND TRANSFERS OF MONEY. The
258258 board by resolution shall establish the number of directors'
259259 signatures and the procedure required for a disbursement or
260260 transfer of the district's money.
261261 Sec. 3877.202. MONEY USED FOR IMPROVEMENTS OR SERVICES.
262262 The district may acquire, construct, finance, operate, or maintain
263263 any improvement or service authorized under this chapter or Chapter
264264 375, Local Government Code, using any money available to the
265265 district.
266266 Sec. 3877.203. PETITION REQUIRED FOR FINANCING SERVICES AND
267267 IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
268268 service or improvement project with assessments under this chapter
269269 unless a written petition requesting that service or improvement
270270 has been filed with the board.
271271 (b) A petition filed under Subsection (a) must be signed by:
272272 (1) the owners of a majority of the assessed value of
273273 real property in the district subject to assessment according to
274274 the most recent certified tax appraisal roll for Harris County; or
275275 (2) at least 25 persons who own real property in the
276276 district subject to assessment, if more than 25 persons own real
277277 property in the district subject to assessment as determined by the
278278 most recent certified tax appraisal roll for Harris County.
279279 Sec. 3877.204. METHOD OF NOTICE FOR HEARING. The district
280280 may mail the notice required by Section 375.115(c), Local
281281 Government Code, by certified or first class United States mail.
282282 The board shall determine the method of notice.
283283 Sec. 3877.205. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
284284 The board by resolution may impose and collect an assessment for any
285285 purpose authorized by this chapter in all or any part of the
286286 district.
287287 (b) An assessment, a reassessment, or an assessment
288288 resulting from an addition to or correction of the assessment roll
289289 by the district, penalties and interest on an assessment or
290290 reassessment, an expense of collection, and reasonable attorney's
291291 fees incurred by the district:
292292 (1) are a first and prior lien against the property
293293 assessed;
294294 (2) are superior to any other lien or claim other than
295295 a lien or claim for county, school district, or municipal ad valorem
296296 taxes; and
297297 (3) are the personal liability of and a charge against
298298 the owners of the property even if the owners are not named in the
299299 assessment proceedings.
300300 (c) The lien is effective from the date of the board's
301301 resolution imposing the assessment until the date the assessment is
302302 paid. The board may enforce the lien in the same manner that the
303303 board may enforce an ad valorem tax lien against real property.
304304 (d) The board may make a correction to or deletion from the
305305 assessment roll that does not increase the amount of assessment of
306306 any parcel of land without providing notice and holding a hearing in
307307 the manner required for additional assessments.
308308 Sec. 3877.206. UTILITY PROPERTY EXEMPT FROM IMPACT FEES AND
309309 ASSESSMENTS. The district may not impose an impact fee or
310310 assessment on the property, including the equipment,
311311 rights-of-way, facilities, or improvements, of:
312312 (1) an electric utility or a power generation company
313313 as defined by Section 31.002, Utilities Code;
314314 (2) a gas utility as defined by Section 101.003 or
315315 121.001, Utilities Code;
316316 (3) a telecommunications provider as defined by
317317 Section 51.002, Utilities Code; or
318318 (4) a person who provides to the public cable
319319 television or advanced telecommunications services.
320320 Sec. 3877.207. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
321321 Section 375.161, Local Government Code, does not apply to a tax
322322 imposed by the district.
323323 Sec. 3877.208. OPERATION AND MAINTENANCE TAX. (a) If
324324 authorized at an election held in accordance with Section 3877.212,
325325 the district may impose an operation and maintenance tax on taxable
326326 property in the district in accordance with Section 49.107, Water
327327 Code, for any district purpose, including to:
328328 (1) maintain and operate the district;
329329 (2) construct or acquire improvements; or
330330 (3) provide a service.
331331 (b) The board shall determine the tax rate. The rate may not
332332 exceed the rate approved at the election.
333333 (c) Section 49.107(h), Water Code, does not apply to the
334334 district.
335335 Sec. 3877.209. CONTRACT TAXES. (a) In accordance with
336336 Section 49.108, Water Code, the district may impose a tax other than
337337 an operation and maintenance tax and use the revenue derived from
338338 the tax to make payments under a contract after the provisions of
339339 the contract have been approved by a majority of the district voters
340340 voting at an election held for that purpose.
341341 (b) A contract approved by the district voters may contain a
342342 provision stating that the contract may be modified or amended by
343343 the board without further voter approval.
344344 Sec. 3877.210. AUTHORITY TO BORROW MONEY AND TO ISSUE
345345 BONDS. (a) The district may borrow money on terms and conditions
346346 as determined by the board. Section 375.205, Local Government
347347 Code, does not apply to a loan, line of credit, or other borrowing
348348 from a bank or financial institution secured by revenue other than
349349 ad valorem taxes.
350350 (b) The district may issue bonds, notes, or other
351351 obligations payable wholly or partly from ad valorem taxes, sales
352352 and use taxes, assessments, impact fees, revenue, contract
353353 payments, grants, or other district money, or any combination of
354354 those sources of money, to pay for any authorized district purpose.
355355 (c) The limitation on the outstanding principal amount of
356356 bonds, notes, and other obligations provided by Section 49.4645,
357357 Water Code, does not apply to the district.
358358 Sec. 3877.211. TAXES FOR BONDS. At the time the district
359359 issues bonds payable wholly or partly from ad valorem taxes, the
360360 board shall provide for the annual imposition of a continuing
361361 direct ad valorem tax, without limit as to rate or amount, while all
362362 or part of the bonds are outstanding as required and in the manner
363363 provided by Sections 54.601 and 54.602, Water Code.
364364 Sec. 3877.212. ELECTIONS REGARDING TAXES AND BONDS. (a)
365365 The district may issue, without an election, bonds, notes, and
366366 other obligations secured by:
367367 (1) revenue other than ad valorem taxes; or
368368 (2) contract payments described by Section 3877.209.
369369 (b) The district must hold an election in the manner
370370 provided by Subchapter L, Chapter 375, Local Government Code, to
371371 obtain voter approval before the district may impose an ad valorem
372372 tax or sales and use tax or issue bonds payable from ad valorem
373373 taxes.
374374 (c) Section 375.243, Local Government Code, does not apply
375375 to the district.
376376 (d) All or any part of any facilities or improvements that
377377 may be acquired by a district by the issuance of district bonds may
378378 be included in one single proposition to be voted on at the election
379379 or the bonds may be submitted in several propositions.
380380 Sec. 3877.213. COMPETITIVE BIDDING. Subchapter I, Chapter
381381 49, Water Code, applies to the district. Subchapter K, Chapter 375,
382382 Local Government Code, does not apply to the district.
383383 Sec. 3877.214. TAX AND ASSESSMENT ABATEMENTS. The district
384384 may grant in the manner authorized by Chapter 312, Tax Code, an
385385 abatement for a tax or assessment owed to the district.

387387 SUBCHAPTER F. TAXES FOR CERTAIN DEFINED AREAS AND DESIGNATED
388388 PROPERTY
389389 Sec. 3877.251. AUTHORITY TO ESTABLISH DEFINED AREAS OR
390390 DESIGNATED PROPERTY. The district may define areas or designate
391391 certain property of the district to pay for improvements,
392392 facilities, or services that primarily benefit that area or
393393 property and do not generally and directly benefit the district as a
394394 whole.
395395 Sec. 3877.252. PROCEDURE FOR ELECTION. (a) Before the
396396 district may impose an ad valorem tax or issue bonds payable from ad
397397 valorem taxes of the defined area or designated property, the board
398398 shall hold an election in the defined area or within the boundaries
399399 of the designated property only.
400400 (b) The election shall be conducted as provided by Section
401401 3877.212.
402402 (c) The board may submit the issues to the voters on the same
403403 ballot to be used in another election.
404404 Sec. 3877.253. DECLARING RESULT AND ISSUING ORDER. (a) If
405405 a majority of the voters voting at the election approve the
406406 proposition or propositions, the board shall declare the results
407407 and, by order, shall establish the defined area and describe it by
408408 metes and bounds or designate the specific property.
409409 (b) The board's order is not subject to judicial review
410410 except on the ground of fraud, palpable error, or arbitrary and
411411 confiscatory abuse of discretion.
412412 Sec. 3877.254. TAXES FOR IMPROVEMENTS AND FACILITIES IN
413413 DEFINED AREAS OR DESIGNATED PROPERTY. On voter approval and
414414 adoption of the order described in Section 3877.253, the district
415415 may apply separately, differently, equitably, and specifically its
416416 taxing power and lien authority to the defined area or designated
417417 property to provide money to construct, administer, maintain, and
418418 operate services, improvements, and facilities that primarily
419419 benefit the defined area or designated property.
420420 Sec. 3877.255. ISSUANCE OF BONDS AND LEVY OF TAXES FOR
421421 DEFINED AREA OR DESIGNATED PROPERTY. After the order under Section
422422 3877.253 is adopted, the district may issue bonds to provide for any
423423 land, improvements, facilities, plants, equipment, and appliances
424424 for the defined area or designated property.

426426 SUBCHAPTER G. SALES AND USE TAX
427427 Sec. 3877.301. MEANINGS OF WORDS AND PHRASES. Words and
428428 phrases used in this subchapter that are defined by Chapters 151 and
429429 321, Tax Code, have the meanings assigned by Chapters 151 and 321,
430430 Tax Code.
431431 Sec. 3877.302. APPLICABILITY OF CERTAIN TAX CODE
432432 PROVISIONS. (a) Except as otherwise provided by this subchapter,
433433 Subtitles A and B, Title 2, Tax Code, and Chapter 151, Tax Code,
434434 apply to taxes imposed under this subchapter and to the
435435 administration and enforcement of those taxes in the same manner
436436 that those laws apply to state taxes.
437437 (b) Chapter 321, Tax Code, relating to municipal sales and
438438 use taxes, applies to the application, collection, change, and
439439 administration of a sales and use tax imposed under this subchapter
440440 to the extent consistent with this chapter, as if references in
441441 Chapter 321, Tax Code, to a municipality referred to the district
442442 and references to a governing body referred to the board.
443443 (c) Sections 321.106, 321.401, 321.402, 321.403, 321.404,
444444 321.406, 321.409, 321.506, 321.507, and 321.508, Tax Code, do not
445445 apply to a tax imposed under this subchapter.
446446 Sec. 3877.303. AUTHORIZATION; ELECTION. (a) The district
447447 may adopt a sales and use tax to serve the purposes of the district
448448 after an election in which a majority of the voters of the district
449449 voting in the election authorize the adoption of the tax.
450450 (b) The board by order may call an election to authorize a
451451 sales and use tax. The election may be held with any other district
452452 election.
453453 (c) The district shall provide notice of the election and
454454 shall hold the election in the manner prescribed by Section
455455 3877.212.
456456 (d) The ballots shall be printed to provide for voting for
457457 or against the proposition: "Authorization of a sales and use tax
458458 in the Waller Town Center Management District at a rate not to
459459 exceed ___ percent."
460460 Sec. 3877.304. ABOLISHING SALES AND USE TAX. (a) Except as
461461 provided by Subsection (b), the board may abolish the sales and use
462462 tax without an election.
463463 (b) The board may not abolish the sales and use tax if the
464464 district has outstanding debt secured by the tax.
465465 Sec. 3877.305. SALES AND USE TAX RATE. (a) On adoption of
466466 the tax authorized by this subchapter, there is imposed a tax on the
467467 receipts from the sale at retail of taxable items within the
468468 district, and an excise tax on the use, storage, or other
469469 consumption in the district of taxable items purchased, leased, or
470470 rented from a retailer in the district during the period that the
471471 tax is in effect.
472472 (b) The board shall determine the rate of the tax, which may
473473 be in one-eighth of one percent increments not to exceed the maximum
474474 rate authorized by the district voters at the election. The board
475475 may lower the tax rate to the extent it does not impair any
476476 outstanding debt or obligations payable from the tax.
477477 (c) The rate of the excise tax is the same as the rate of the
478478 sales tax portion of the tax and is applied to the sales price of the
479479 taxable item.

11201120 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
11211121 Government Code.
11221122 (b) The governor, one of the required recipients, has
11231123 submitted the notice and Act to the Texas Commission on
11241124 Environmental Quality.
11251125 (c) The Texas Commission on Environmental Quality has filed
11261126 its recommendations relating to this Act with the governor,
11271127 lieutenant governor, and speaker of the house of representatives
11281128 within the required time.
11291129 (d) The general law relating to consent by political
11301130 subdivisions to the creation of districts with conservation,
11311131 reclamation, and road powers and the inclusion of land in those
11321132 districts has been complied with.
11331133 (e) All requirements of the constitution and laws of this
11341134 state and the rules and procedures of the legislature with respect
11351135 to the notice, introduction, and passage of this Act have been
11361136 fulfilled and accomplished.
11371137 SECTION 4. This Act takes effect immediately if it receives
11381138 a vote of two-thirds of all the members elected to each house, as
11391139 provided by Section 39, Article III, Texas Constitution. If this
11401140 Act does not receive the vote necessary for immediate effect, this
11411141 Act takes effect September 1, 2009.
