| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1024.105, Special District Local Laws |
|---|
| 10 | 10 | | Code, as effective April 1, 2009, is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 1024.105. PURCHASING AND ACCOUNTING PROCEDURES. (a) |
|---|
| 12 | 12 | | The board may prescribe: |
|---|
| 13 | 13 | | (1) the method of making purchases and expenditures by |
|---|
| 14 | 14 | | and for the district; and |
|---|
| 15 | 15 | | (2) accounting and control procedures for the |
|---|
| 16 | 16 | | district. |
|---|
| 17 | 17 | | (b) The board may act as a governmental entity under |
|---|
| 18 | 18 | | Subchapter H, Chapter 271, Local Government Code, for purposes of |
|---|
| 19 | 19 | | using the procurement procedures authorized by that chapter. For |
|---|
| 20 | 20 | | purposes of this subsection, notice under Section 271.112(d), Local |
|---|
| 21 | 21 | | Government Code, must be provided by the district in the same manner |
|---|
| 22 | 22 | | as provided for a conservation and reclamation district created |
|---|
| 23 | 23 | | under Section 59, Article XVI, Texas Constitution. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
