| 8 | 8 | | Brazoria Drainage District Number Four. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 9, Chapter 991, Acts of the 74th |
|---|
| 11 | 11 | | Legislature, Regular Session, 1995, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 9. COMPENSATION AND PER DIEM OF COMMISSIONERS. (a) In |
|---|
| 13 | 13 | | this section, "performing the duties of a commissioner" means |
|---|
| 14 | 14 | | acting in substantive performance of the management or business of |
|---|
| 15 | 15 | | the district and includes participation in: |
|---|
| 16 | 16 | | (1) board and committee meetings and other activities |
|---|
| 17 | 17 | | involving the substantive deliberation of district business; and |
|---|
| 18 | 18 | | (2) pertinent educational programs. |
|---|
| 19 | 19 | | (b) Notwithstanding provisions found elsewhere in this Act, |
|---|
| 20 | 20 | | the salary of a commissioner shall be set at $30 per day or a greater |
|---|
| 21 | 21 | | amount not to exceed $100 per day if the greater amount is approved |
|---|
| 22 | 22 | | by a majority vote of the board. It is further provided that a |
|---|
| 23 | 23 | | commissioner shall receive a per diem of $10 or a greater amount not |
|---|
| 24 | 24 | | to exceed $50 per day if the greater amount is approved by a |
|---|
| 25 | 25 | | majority vote of the board. The salary and per diem are payable for |
|---|
| 26 | 26 | | each day the commissioner actually spends performing the duties of |
|---|
| 27 | 27 | | a commissioner. |
|---|
| 28 | 28 | | (c) [(b)] Section 49.060 [56.067], Water Code, applies |
|---|
| 29 | 29 | | [does not apply] to the board to the extent that the provisions of |
|---|
| 30 | 30 | | that section do not conflict with Subsection (b) of this section. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
