66 AN ACT
77 relating to the authority of the Harris-Montgomery Counties
88 Municipal Utility District No. 386, formerly known as Harris County
99 Municipal Utility District No. 386, to issue bonds supported by ad
1010 valorem taxes to finance recreational facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 6, Chapter 1381, Acts of the 77th
1313 Legislature, Regular Session, 2001, is amended by adding Subsection
1414 (d) to read as follows:
1515 (d) Section 49.4645(f), Water Code, does not apply to the
1616 district.
1717 SECTION 2. The Harris-Montgomery Counties Municipal
1818 Utility District No. 386, formerly known as Harris County Municipal
1919 Utility District No. 386, retains all the rights, powers,
2020 privileges, authority, duties, and functions that it had before the
2121 effective date of this Act.
2222 SECTION 3. (a) The legal notice of the intention to
2323 introduce this Act, setting forth the general substance of this
2424 Act, has been published as provided by law, and the notice and a
2525 copy of this Act have been furnished to all persons, agencies,
2626 officials, or entities to which they are required to be furnished
2727 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2828 Government Code.
2929 (b) The governor, one of the required recipients, has
3030 submitted the notice and Act to the Texas Commission on
3131 Environmental Quality.
3232 (c) The Texas Commission on Environmental Quality has filed
3333 its recommendations relating to this Act with the governor, the
3434 lieutenant governor, and the speaker of the house of
3535 representatives within the required time.
3636 (d) All requirements of the constitution and laws of this
3737 state and the rules and procedures of the legislature with respect
3838 to the notice, introduction, and passage of this Act are fulfilled
3939 and accomplished.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
