77 relating to the creation of the Montgomery County Municipal Utility
88 District No. 118; providing authority to impose a tax and issue
99 bonds; granting a limited power of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8366 to read as follows:
1313 CHAPTER 8366. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 118
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8366.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Montgomery County Municipal
1919 Utility District No. 118.
2020 Sec. 8366.002. NATURE OF DISTRICT. The district is a
2121 municipal utility district created under Section 59, Article XVI,
2222 Texas Constitution.
2323 Sec. 8366.003. CONFIRMATION AND DIRECTORS' ELECTION
2424 REQUIRED. The temporary directors shall hold an election to
2525 confirm the creation of the district and to elect five permanent
2626 directors as provided by Section 49.102, Water Code.
2727 Sec. 8366.004. CONSENT OF MUNICIPALITY REQUIRED. The
2828 temporary directors may not hold an election under Section 8366.003
2929 until each municipality in whose corporate limits or
3030 extraterritorial jurisdiction the district is located has
3131 consented by ordinance or resolution to the creation of the
3232 district and to the inclusion of land in the district.
3333 Sec. 8366.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3434 The district is created to serve a public purpose and benefit.
3535 (b) The district is created to accomplish the purposes of:
3636 (1) a municipal utility district as provided by
3737 general law and Section 59, Article XVI, Texas Constitution; and
3838 (2) Section 52, Article III, Texas Constitution, that
3939 relate to the construction, acquisition, improvement, operation,
4040 or maintenance of macadamized, graveled, or paved roads, or
4141 improvements, including storm drainage, in aid of those roads.
4242 Sec. 8366.006. INITIAL DISTRICT TERRITORY. (a) The
4343 district is initially composed of the territory described by
4444 Section 2 of the Act creating this chapter.
4545 (b) The boundaries and field notes contained in Section 2 of
4646 the Act creating this chapter form a closure. A mistake made in the
4747 field notes or in copying the field notes in the legislative process
4848 does not affect the district's:
4949 (1) organization, existence, or validity;
5050 (2) right to issue any type of bond for the purposes
5151 for which the district is created or to pay the principal of and
5252 interest on a bond;
5353 (3) right to impose a tax; or
5454 (4) legality or operation.

5656 SUBCHAPTER B. BOARD OF DIRECTORS
5757 Sec. 8366.051. GOVERNING BODY; TERMS. (a) The district is
5858 governed by a board of five elected directors.
5959 (b) Except as provided by Section 8366.052, directors serve
6060 staggered four-year terms.
6161 Sec. 8366.052. TEMPORARY DIRECTORS. (a) On or after the
6262 effective date of the Act creating this chapter, the owner or owners
6363 of a majority of the assessed value of the real property in the
6464 district may submit a petition to the Texas Commission on
6565 Environmental Quality requesting that the commission appoint as
6666 temporary directors the five persons named in the petition. The
6767 commission shall appoint as temporary directors the five persons
6868 named in the petition.
6969 (b) Temporary directors serve until the earlier of:
7070 (1) the date permanent directors are elected under
7171 Section 8366.003; or
7272 (2) the fourth anniversary of the effective date of
7373 the Act creating this chapter.
7474 (c) If permanent directors have not been elected under
7575 Section 8366.003 and the terms of the temporary directors have
7676 expired, successor temporary directors shall be appointed or
7777 reappointed as provided by Subsection (d) to serve terms that
7878 expire on the earlier of:
7979 (1) the date permanent directors are elected under
8080 Section 8366.003; or
8181 (2) the fourth anniversary of the date of the
8282 appointment or reappointment.
8383 (d) If Subsection (c) applies, the owner or owners of a
8484 majority of the assessed value of the real property in the district
8585 may submit a petition to the Texas Commission on Environmental
8686 Quality requesting that the commission appoint as successor
8787 temporary directors the five persons named in the petition. The
8888 commission shall appoint as successor temporary directors the five
8989 persons named in the petition.

9191 SUBCHAPTER C. POWERS AND DUTIES
9292 Sec. 8366.101. GENERAL POWERS AND DUTIES. The district has
9393 the powers and duties necessary to accomplish the purposes for
9494 which the district is created.
9595 Sec. 8366.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9696 DUTIES. The district has the powers and duties provided by the
9797 general law of this state, including Chapters 49 and 54, Water Code,
9898 applicable to municipal utility districts created under Section 59,
9999 Article XVI, Texas Constitution.
100100 Sec. 8366.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
101101 Section 52, Article III, Texas Constitution, the district may
102102 design, acquire, construct, finance, issue bonds for, improve, and
103103 convey to this state, a county, or a municipality for operation and
104104 maintenance macadamized, graveled, or paved roads described by
105105 Section 54.234, Water Code, or improvements, including storm
106106 drainage, in aid of those roads.
107107 (b) The district may exercise the powers provided by this
108108 section without submitting a petition to or obtaining approval from
109109 the Texas Commission on Environmental Quality as required by
110110 Section 54.234, Water Code.
111111 Sec. 8366.104. APPROVAL OF ROAD PROJECT. (a) The district
112112 may not undertake a road project authorized by Section 8366.103
113113 unless:
114114 (1) each municipality or county that will operate and
115115 maintain the road has approved the plans and specifications of the
116116 road project, if a municipality or county will operate and maintain
117117 the road; or
118118 (2) the Texas Transportation Commission has approved
119119 the plans and specifications of the road project, if the state will
120120 operate and maintain the road.
121121 (b) Except as provided by Subsection (a), the district is
122122 not required to obtain approval from the Texas Transportation
123123 Commission to design, acquire, construct, finance, issue bonds for,
124124 improve, or convey a road project.
125125 Sec. 8366.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
126126 OR RESOLUTION. The district shall comply with all applicable
127127 requirements of any ordinance or resolution that is adopted under
128128 Section 54.016 or 54.0165, Water Code, and that consents to the
129129 creation of the district or to the inclusion of land in the
130130 district.
131131 Sec. 8366.106. LIMITATION ON USE OF EMINENT DOMAIN. The
132132 district may not exercise the power of eminent domain outside the
133133 district to acquire a site or easement for:
134134 (1) a road project authorized by Section 8366.103; or
135135 (2) a recreational facility as defined by Section
136136 49.462, Water Code.

138138 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
139139 Sec. 8366.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
140140 district may issue, without an election, bonds and other
141141 obligations secured by:
142142 (1) revenue other than ad valorem taxes; or
143143 (2) contract payments described by Section 8366.153.
144144 (b) The district must hold an election in the manner
145145 provided by Chapters 49 and 54, Water Code, to obtain voter approval
146146 before the district may impose an ad valorem tax or issue bonds
147147 payable from ad valorem taxes.
148148 (c) The district may not issue bonds payable from ad valorem
149149 taxes to finance a road project unless the issuance is approved by a
150150 vote of a two-thirds majority of the district voters voting at an
151151 election held for that purpose.
152152 Sec. 8366.152. OPERATION AND MAINTENANCE TAX. (a) If
153153 authorized at an election held under Section 8366.151, the district
154154 may impose an operation and maintenance tax on taxable property in
155155 the district in accordance with Section 49.107, Water Code.
156156 (b) The board shall determine the tax rate. The rate may not
157157 exceed the rate approved at the election.
158158 Sec. 8366.153. CONTRACT TAXES. (a) In accordance with
159159 Section 49.108, Water Code, the district may impose a tax other than
160160 an operation and maintenance tax and use the revenue derived from
161161 the tax to make payments under a contract after the provisions of
162162 the contract have been approved by a majority of the district voters
163163 voting at an election held for that purpose.
164164 (b) A contract approved by the district voters may contain a
165165 provision stating that the contract may be modified or amended by
166166 the board without further voter approval.

168168 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
169169 Sec. 8366.201. AUTHORITY TO ISSUE BONDS AND OTHER
170170 OBLIGATIONS. The district may issue bonds or other obligations
171171 payable wholly or partly from ad valorem taxes, impact fees,
172172 revenue, contract payments, grants, or other district money, or any
173173 combination of those sources, to pay for any authorized district
174174 purpose.
175175 Sec. 8366.202. TAXES FOR BONDS. At the time the district
176176 issues bonds payable wholly or partly from ad valorem taxes, the
177177 board shall provide for the annual imposition of a continuing
178178 direct ad valorem tax, without limit as to rate or amount, while all
179179 or part of the bonds are outstanding as required and in the manner
180180 provided by Sections 54.601 and 54.602, Water Code.
181181 Sec. 8366.203. BONDS FOR ROAD PROJECTS. At the time of
182182 issuance, the total principal amount of bonds or other obligations
183183 issued or incurred to finance road projects and payable from ad
184184 valorem taxes may not exceed one-fourth of the assessed value of the
185185 real property in the district.
186186 SECTION 2. The Montgomery County Municipal Utility District
187187 No. 118 initially includes all the territory contained in the
188188 following area:
189189 All that certain 875.426 acre (38,133,574 square feet) parcel
190190 of land situated in the Joseph A. Parker Survey, Abstract Number
191191 418, in Montgomery County, Texas, and being a portion of that
192192 certain call 2,086.441 acre tract described in a Warranty Deed to
193193 Pacific Indio Properties, Inc. recorded in Montgomery County
194194 Clerk's File (M.C.C.F.) Number 2005-116973 of the Official Public
195195 Records of Real Property at Montgomery County, Texas
196196 (O.P.R.R.P.M.C.T), and being all of that certain call 347.750 net
197197 acres described in a Warranty Deed to Pacific Indio Properties in
198198 M.C.C.F. Number 2006-026099 of the O.P.R.R.P.M.C.T, SAVE AND EXCEPT
199199 that certain call 14.9 acres described in a deed to the City of
200200 Houston in Volume 287, Page 22, of the M.C.D.R. and resulting in a
201201 net acreage of 860.526 acres (37,484,513 square feet), said 875.426
202202 acre tract being more particularly described by metes and bounds as
203203 follows: (All bearings are referenced to the Texas State Plane
204204 Coordinate System, South Central Zone)
205205 COMMENCING at a 90d nail found for an interior corner of said
206206 2,086.441 acre tract and the northwest corner of said 347.750 acre
207207 tract;
208208 THENCE, generally along a barbed wire fence line marking the
209209 occupied southerly line of said 2,086.441 acre tract and the
210210 occupied northerly line of said 347.750 acre tract, the following
211211 three (3) courses:
212212 1) North 76 Degrees 42 Minutes 28 Seconds East, a
213213 distance of 1,639.86 feet to a 5/8-inch iron rod with plastic cap
214214 stamped "BENCHMARK ENGR." found for an angle point;

602602 SECTION 3. (a) The legal notice of the intention to
603603 introduce this Act, setting forth the general substance of this
604604 Act, has been published as provided by law, and the notice and a
605605 copy of this Act have been furnished to all persons, agencies,
606606 officials, or entities to which they are required to be furnished
607607 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
608608 Government Code.
609609 (b) The governor, one of the required recipients, has
610610 submitted the notice and Act to the Texas Commission on
611611 Environmental Quality.
612612 (c) The Texas Commission on Environmental Quality has filed
613613 its recommendations relating to this Act with the governor, the
614614 lieutenant governor, and the speaker of the house of
615615 representatives within the required time.
616616 (d) All requirements of the constitution and laws of this
617617 state and the rules and procedures of the legislature with respect
618618 to the notice, introduction, and passage of this Act are fulfilled
619619 and accomplished.
620620 SECTION 4. This Act takes effect immediately if it receives
621621 a vote of two-thirds of all the members elected to each house, as
622622 provided by Section 39, Article III, Texas Constitution. If this
623623 Act does not receive the vote necessary for immediate effect, this
624624 Act takes effect September 1, 2009.
