| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 253.035, Election Code, is amended by | |
| 11 | 11 | adding Subsection (j) to read as follows: | |
| 12 | 12 | (j) "Personal use" includes the use of contributions to pay | |
| 13 | 13 | a civil penalty imposed by the commission. | |
| 14 | 14 | SECTION 2. The change in law made by Section 253.035(j), | |
| 15 | 15 | Election Code, as added by this Act, applies to payment of a civil | |
| 16 | 16 | penalty imposed by the Texas Ethics Commission regardless of | |
| 17 | 17 | whether the penalty is imposed before, on, or after the effective | |
| 18 | 18 | date of this Act. | |
| 19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
