88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8335 to read as follows:
1111 CHAPTER 8335. BASTROP COUNTY MUNICIPAL UTILITY DISTRICT NO. 2
1212 SUBCHAPTER A. GENERAL PROVISIONS
1313 Sec. 8335.001. DEFINITIONS. In this chapter:
1414 (1) "Board" means the district's board of directors.
1515 (2) "Director" means a board member.
1616 (3) "District" means the Bastrop County Municipal
1717 Utility District No. 2.
1818 Sec. 8335.002. NATURE OF DISTRICT. The district is a
1919 municipal utility district created under Section 59, Article XVI,
2020 Texas Constitution.
2121 Sec. 8335.003. CONFIRMATION AND DIRECTORS' ELECTION
2222 REQUIRED. The temporary directors shall hold an election to
2323 confirm the creation of the district and to elect five permanent
2424 directors as provided by Section 49.102, Water Code.
2525 Sec. 8335.004. CONSENT OF MUNICIPALITY REQUIRED. The
2626 temporary directors may not hold an election under Section 8335.003
2727 until each municipality in whose corporate limits or
2828 extraterritorial jurisdiction the district is located has
2929 consented by ordinance or resolution to the creation of the
3030 district and to the inclusion of land in the district.
3131 Sec. 8335.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3232 The district is created to serve a public purpose and benefit.
3333 (b) The district is created to accomplish the purposes of:
3434 (1) a municipal utility district as provided by
3535 general law and Section 59, Article XVI, Texas Constitution; and
3636 (2) Section 52, Article III, Texas Constitution, that
3737 relate to the construction, acquisition, improvement, operation,
3838 or maintenance of macadamized, graveled, or paved roads, or
3939 improvements, including storm drainage, in aid of those roads.
4040 Sec. 8335.006. INITIAL DISTRICT TERRITORY. (a) The
4141 district is initially composed of the territory described by
4242 Section 2 of the Act creating this chapter.
4343 (b) The boundaries and field notes contained in Section 2 of
4444 the Act creating this chapter form a closure. A mistake made in the
4545 field notes or in copying the field notes in the legislative process
4646 does not affect the district's:
4747 (1) organization, existence, or validity;
4848 (2) right to issue any type of bond for the purposes
4949 for which the district is created or to pay the principal of and
5050 interest on a bond;
5151 (3) right to impose a tax; or
5252 (4) legality or operation.

5454 SUBCHAPTER B. BOARD OF DIRECTORS
5555 Sec. 8335.051. GOVERNING BODY; TERMS. (a) The district is
5656 governed by a board of five elected directors.
5757 (b) Except as provided by Section 8335.052, directors serve
5858 staggered four-year terms.
5959 Sec. 8335.052. TEMPORARY DIRECTORS. (a) The temporary
6060 board consists of:
6161 (1) William Strawn;
6262 (2) Michael Lamendola;
6363 (3) David Bowen;
6464 (4) Sean Mills; and
6565 (5) Ann Schneider.
6666 (b) Temporary directors serve until the earlier of:
6767 (1) the date permanent directors are elected under
6868 Section 8335.003; or
6969 (2) the fourth anniversary of the effective date of
7070 the Act creating this chapter.
7171 (c) If permanent directors have not been elected under
7272 Section 8335.003 and the terms of the temporary directors have
7373 expired, successor temporary directors shall be appointed or
7474 reappointed as provided by Subsection (d) to serve terms that
7575 expire on the earlier of:
7676 (1) the date permanent directors are elected under
7777 Section 8335.003; or
7878 (2) the fourth anniversary of the date of the
7979 appointment or reappointment.
8080 (d) If Subsection (c) applies, the owner or owners of a
8181 majority of the assessed value of the real property in the district
8282 may submit a petition to the Texas Commission on Environmental
8383 Quality requesting that the commission appoint as successor
8484 temporary directors the five persons named in the petition. The
8585 commission shall appoint as successor temporary directors the five
8686 persons named in the petition.

8888 SUBCHAPTER C. POWERS AND DUTIES
8989 Sec. 8335.101. GENERAL POWERS AND DUTIES. The district has
9090 the powers and duties necessary to accomplish the purposes for
9191 which the district is created.
9292 Sec. 8335.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9393 DUTIES. The district has the powers and duties provided by the
9494 general law of this state, including Chapters 49 and 54, Water Code,
9595 applicable to municipal utility districts created under Section 59,
9696 Article XVI, Texas Constitution.
9797 Sec. 8335.103. AUTHORITY FOR ROAD PROJECTS. Under Section
9898 52, Article III, Texas Constitution, the district may design,
9999 acquire, construct, finance, issue bonds for, improve, operate,
100100 maintain, and convey to this state, a county, or a municipality for
101101 operation and maintenance macadamized, graveled, or paved roads, or
102102 improvements, including storm drainage, in aid of those roads.
103103 Sec. 8335.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
104104 project must meet all applicable construction standards, zoning and
105105 subdivision requirements, and regulations of each municipality in
106106 whose corporate limits or extraterritorial jurisdiction the road
107107 project is located.
108108 (b) If a road project is not located in the corporate limits
109109 or extraterritorial jurisdiction of a municipality, the road
110110 project must meet all applicable construction standards,
111111 subdivision requirements, and regulations of each county in which
112112 the road project is located.
113113 (c) If the state will maintain and operate the road, the
114114 Texas Transportation Commission must approve the plans and
115115 specifications of the road project.
116116 Sec. 8335.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
117117 OR RESOLUTION. The district shall comply with all applicable
118118 requirements of any ordinance or resolution that is adopted under
119119 Section 54.016 or 54.0165, Water Code, and that consents to the
120120 creation of the district or to the inclusion of land in the
121121 district.
122122 Sec. 8335.106. CONTRACT WITH CERTAIN MUNICIPALITIES
123123 REQUIRED. (a) In order to exercise the powers and duties of a
124124 municipal utility district granted by this chapter, the district
125125 shall enter into a written contract with any municipality within
126126 whose extraterritorial jurisdiction the district is wholly or
127127 partly located:
128128 (1) regulating the continuation of the
129129 extraterritorial status of the district and its annexation by the
130130 municipality;
131131 (2) regulating the development within the boundaries
132132 of the district in a manner that the parties agree will further the
133133 health, safety, and welfare of the residents of the district; and
134134 (3) containing other terms and consideration that the
135135 municipality determines to be reasonable and appropriate.
136136 (b) A contract under this section may be renewed or extended
137137 for successive periods not to exceed 15 years.
138138 Sec. 8335.107. LIMITATION ON USE OF EMINENT DOMAIN. The
139139 district may not exercise the power of eminent domain outside the
140140 district to acquire a site or easement for:
141141 (1) a road project authorized by Section 8335.103; or
142142 (2) a recreational facility as defined by Section
143143 49.462, Water Code.

145145 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
146146 Sec. 8335.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
147147 district may issue, without an election, bonds and other
148148 obligations secured by:
149149 (1) revenue other than ad valorem taxes; or
150150 (2) contract payments described by Section 8335.153.
151151 (b) The district must hold an election in the manner
152152 provided by Chapters 49 and 54, Water Code, to obtain voter approval
153153 before the district may impose an ad valorem tax or issue bonds
154154 payable from ad valorem taxes.
155155 (c) The district may not issue bonds payable from ad valorem
156156 taxes to finance a road project unless the issuance is approved by a
157157 vote of a two-thirds majority of the district voters voting at an
158158 election held for that purpose.
159159 Sec. 8335.152. OPERATION AND MAINTENANCE TAX. (a) If
160160 authorized at an election held under Section 8335.151, the district
161161 may impose an operation and maintenance tax on taxable property in
162162 the district in accordance with Section 49.107, Water Code.
163163 (b) The board shall determine the tax rate. The rate may not
164164 exceed the rate approved at the election.
165165 Sec. 8335.153. CONTRACT TAXES. (a) In accordance with
166166 Section 49.108, Water Code, the district may impose a tax other than
167167 an operation and maintenance tax and use the revenue derived from
168168 the tax to make payments under a contract after the provisions of
169169 the contract have been approved by a majority of the district voters
170170 voting at an election held for that purpose.
171171 (b) A contract approved by the district voters may contain a
172172 provision stating that the contract may be modified or amended by
173173 the board without further voter approval.

175175 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
176176 Sec. 8335.201. AUTHORITY TO ISSUE BONDS AND OTHER
177177 OBLIGATIONS. The district may issue bonds or other obligations
178178 payable wholly or partly from ad valorem taxes, impact fees,
179179 revenue, contract payments, grants, or other district money, or any
180180 combination of those sources, to pay for any authorized district
181181 purpose.
182182 Sec. 8335.202. TAXES FOR BONDS. At the time the district
183183 issues bonds payable wholly or partly from ad valorem taxes, the
184184 board shall provide for the annual imposition of a continuing
185185 direct ad valorem tax, without limit as to rate or amount, while all
186186 or part of the bonds are outstanding as required and in the manner
187187 provided by Sections 54.601 and 54.602, Water Code.
188188 Sec. 8335.203. BONDS FOR ROAD PROJECTS. At the time of
189189 issuance, the total principal amount of bonds or other obligations
190190 issued or incurred to finance road projects and payable from ad
191191 valorem taxes may not exceed one-fourth of the assessed value of the
192192 real property in the district.
193193 SECTION 2. The Bastrop County Municipal Utility District
194194 No. 2 initially includes all the territory contained in the
195195 following area:
196196 BEING A PART OF THAT CERTAIN TRACT OF LAND OUT OF AND A PART OF
197197 THE J. A. NAVARRO SURVEY, ABSTRACT 53, SITUATED IN BASTROP COUNTY,
198198 TEXAS, SAID TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED AS
199199 BEING PART OF THAT CERTAIN 723.330 ACRE TRACT OF LAND CONVEYED TO
