| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 7, Chapter 653, Acts of the 71st |
|---|
| 12 | 12 | | Legislature, Regular Session, 1989, is amended by amending |
|---|
| 13 | 13 | | Subsection (a) and adding Subsection (f) to read as follows: |
|---|
| 14 | 14 | | (a) The district is governed by a board of five directors. A |
|---|
| 15 | 15 | | director must be 18 years of age or older and must be a resident of |
|---|
| 16 | 16 | | the district. |
|---|
| 17 | 17 | | (f) Section 141.001(a)(5), Election Code, and Section |
|---|
| 18 | 18 | | 36.059(b), Water Code, do not apply to the district. |
|---|
| 19 | 19 | | SECTION 2. Section 10(b), Chapter 653, Acts of the 71st |
|---|
| 20 | 20 | | Legislature, Regular Session, 1989, is amended to read as follows: |
|---|
| 21 | 21 | | (b) On the uniform election date [first Saturday] in May of |
|---|
| 22 | 22 | | each odd-numbered [the second] year [after the year in which the |
|---|
| 23 | 23 | | district is authorized to be created at a confirmation election], |
|---|
| 24 | 24 | | an election shall be held in the district for the election of the |
|---|
| 25 | 25 | | appropriate number of directors. [Directors elected from district |
|---|
| 26 | 26 | | precincts 2 and 4 shall each serve two-year terms and directors |
|---|
| 27 | 27 | | elected from district precincts 1 and 3 and the district at large |
|---|
| 28 | 28 | | shall each serve four-year terms. Thereafter, on the same date in |
|---|
| 29 | 29 | | each subsequent second year, the appropriate number of directors |
|---|
| 30 | 30 | | shall be elected to the board.] |

| 31 | 31 | | SECTION 3. Section 10(c), Chapter 653, Acts of the 71st |
|---|
| 32 | 32 | | Legislature, Regular Session, 1989, is repealed. |
|---|
| 33 | 33 | | SECTION 4. (a) The legal notice of the intention to |
|---|
| 34 | 34 | | introduce this Act, setting forth the general substance of this |
|---|
| 35 | 35 | | Act, has been published as provided by law, and the notice and a |
|---|
| 36 | 36 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 37 | 37 | | officials, or entities to which they are required to be furnished |
|---|
| 38 | 38 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 39 | 39 | | Government Code. |
|---|
| 40 | 40 | | (b) The governor, one of the required recipients, has |
|---|
| 41 | 41 | | submitted the notice and Act to the Texas Commission on |
|---|
| 42 | 42 | | Environmental Quality. |
|---|
| 43 | 43 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 44 | 44 | | its recommendations relating to this Act with the governor, the |
|---|
| 45 | 45 | | lieutenant governor, and the speaker of the house of |
|---|
| 46 | 46 | | representatives within the required time. |
|---|
| 47 | 47 | | (d) All requirements of the constitution and laws of this |
|---|
| 48 | 48 | | state and the rules and procedures of the legislature with respect |
|---|
| 49 | 49 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 50 | 50 | | and accomplished. |
|---|
| 51 | 51 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 52 | 52 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 53 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 54 | 54 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 55 | 55 | | Act takes effect September 1, 2009. |
