77 relating to election and qualifications of members of the board of
88 directors of the Santa Rita Underground Water Conservation
99 District.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7, Chapter 653, Acts of the 71st
1212 Legislature, Regular Session, 1989, is amended by amending
1313 Subsection (a) and adding Subsection (f) to read as follows:
1414 (a) The district is governed by a board of five directors. A
1515 director must be 18 years of age or older and must be a resident of
1616 the district.
1717 (f) Section 141.001(a)(5), Election Code, and Section
1818 36.059(b), Water Code, do not apply to the district.
1919 SECTION 2. Section 10(b), Chapter 653, Acts of the 71st
2020 Legislature, Regular Session, 1989, is amended to read as follows:
2121 (b) On the uniform election date [first Saturday] in May of
2222 each odd-numbered [the second] year [after the year in which the
2323 district is authorized to be created at a confirmation election],
2424 an election shall be held in the district for the election of the
2525 appropriate number of directors. [Directors elected from district
2626 precincts 2 and 4 shall each serve two-year terms and directors
2727 elected from district precincts 1 and 3 and the district at large
2828 shall each serve four-year terms. Thereafter, on the same date in
2929 each subsequent second year, the appropriate number of directors
3030 shall be elected to the board.]
3131 SECTION 3. Section 10(c), Chapter 653, Acts of the 71st
3232 Legislature, Regular Session, 1989, is repealed.
3333 SECTION 4. (a) The legal notice of the intention to
3434 introduce this Act, setting forth the general substance of this
3535 Act, has been published as provided by law, and the notice and a
3636 copy of this Act have been furnished to all persons, agencies,
3737 officials, or entities to which they are required to be furnished
3838 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3939 Government Code.
4040 (b) The governor, one of the required recipients, has
4141 submitted the notice and Act to the Texas Commission on
4242 Environmental Quality.
4343 (c) The Texas Commission on Environmental Quality has filed
4444 its recommendations relating to this Act with the governor, the
4545 lieutenant governor, and the speaker of the house of
4646 representatives within the required time.
4747 (d) All requirements of the constitution and laws of this
4848 state and the rules and procedures of the legislature with respect
4949 to the notice, introduction, and passage of this Act are fulfilled
5050 and accomplished.
5151 SECTION 5. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2009.
