1010 AN ACT
1111 relating to the creation of the Harris County Municipal Utility
1212 District No. 524; providing authority to impose a tax and issue
1313 bonds; granting a limited power of eminent domain.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1616 Code, is amended by adding Chapter 8354 to read as follows:
1717 CHAPTER 8354. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 524
1818 SUBCHAPTER A. GENERAL PROVISIONS
1919 Sec. 8354.001. DEFINITIONS. In this chapter:
2020 (1) "Board" means the district's board of directors.
2121 (2) "Director" means a board member.
2222 (3) "District" means the Harris County Municipal
2323 Utility District No. 524.
2424 Sec. 8354.002. NATURE OF DISTRICT. The district is a
2525 municipal utility district created under Section 59, Article XVI,
2626 Texas Constitution.
2727 Sec. 8354.003. CONFIRMATION AND DIRECTORS' ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect five permanent
3030 directors as provided by Section 49.102, Water Code.
3131 Sec. 8354.004. CONSENT OF MUNICIPALITY REQUIRED. The
3232 temporary directors may not hold an election under Section 8354.003
3333 until each municipality in whose corporate limits or
3434 extraterritorial jurisdiction the district is located has
3535 consented by ordinance or resolution to the creation of the
3636 district and to the inclusion of land in the district.
3737 Sec. 8354.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3838 The district is created to serve a public purpose and benefit.
3939 (b) The district is created to accomplish the purposes of:
4040 (1) a municipal utility district as provided by
4141 general law and Section 59, Article XVI, Texas Constitution; and
4242 (2) Section 52, Article III, Texas Constitution, that
4343 relate to the construction, acquisition, or improvement of
4444 macadamized, graveled, or paved roads described by Section 54.234,
4545 Water Code, or improvements, including storm drainage, in aid of
4646 those roads.
4747 Sec. 8354.006. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act creating this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act creating this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.

6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8354.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8354.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8354.052. TEMPORARY DIRECTORS. (a) On or after the
6767 effective date of the Act creating this chapter, the owner or owners
6868 of a majority of the assessed value of the real property in the
6969 district may submit a petition to the Texas Commission on
7070 Environmental Quality requesting that the commission appoint as
7171 temporary directors the five persons named in the petition. The
7272 commission shall appoint as temporary directors the five persons
7373 named in the petition.
7474 (b) Temporary directors serve until the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8354.003; or
7777 (2) the fourth anniversary of the effective date of
7878 the Act creating this chapter.
7979 (c) If permanent directors have not been elected under
8080 Section 8354.003 and the terms of the temporary directors have
8181 expired, successor temporary directors shall be appointed or
8282 reappointed as provided by Subsection (d) to serve terms that
8383 expire on the earlier of:
8484 (1) the date permanent directors are elected under
8585 Section 8354.003; or
8686 (2) the fourth anniversary of the date of the
8787 appointment or reappointment.
8888 (d) If Subsection (c) applies, the owner or owners of a
8989 majority of the assessed value of the real property in the district
9090 may submit a petition to the Texas Commission on Environmental
9191 Quality requesting that the commission appoint as successor
9292 temporary directors the five persons named in the petition. The
9393 commission shall appoint as successor temporary directors the five
9494 persons named in the petition.

9696 SUBCHAPTER C. POWERS AND DUTIES
9797 Sec. 8354.101. GENERAL POWERS AND DUTIES. The district has
9898 the powers and duties necessary to accomplish the purposes for
9999 which the district is created.
100100 Sec. 8354.102. MUNICIPAL UTILITY DISTRICT POWERS AND
101101 DUTIES. The district has the powers and duties provided by the
102102 general law of this state, including Chapters 49 and 54, Water Code,
103103 applicable to municipal utility districts created under Section 59,
104104 Article XVI, Texas Constitution.
105105 Sec. 8354.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
106106 Section 52, Article III, Texas Constitution, the district may
107107 design, acquire, construct, finance, issue bonds for, improve, and
108108 convey to this state, a county, or a municipality for operation and
109109 maintenance macadamized, graveled, or paved roads described by
110110 Section 54.234, Water Code, or improvements, including storm
111111 drainage, in aid of those roads.
112112 (b) The district may exercise the powers provided by this
113113 section without submitting a petition to or obtaining approval from
114114 the Texas Commission on Environmental Quality as required by
115115 Section 54.234, Water Code.
116116 Sec. 8354.104. APPROVAL OF ROAD PROJECT. (a) The district
117117 may not undertake a road project authorized by Section 8354.103
118118 unless:
119119 (1) each municipality or county that will operate and
120120 maintain the road has approved the plans and specifications of the
121121 road project, if a municipality or county will operate and maintain
122122 the road; or
123123 (2) the Texas Transportation Commission has approved
124124 the plans and specifications of the road project, if the state will
125125 operate and maintain the road.
126126 (b) Except as provided by Subsection (a), the district is
127127 not required to obtain approval from the Texas Transportation
128128 Commission to design, acquire, construct, finance, issue bonds for,
129129 improve, or convey a road project.
130130 Sec. 8354.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
131131 OR RESOLUTION. The district shall comply with all applicable
132132 requirements of any ordinance or resolution that is adopted under
133133 Section 54.016 or 54.0165, Water Code, and that consents to the
134134 creation of the district or to the inclusion of land in the
135135 district.
136136 Sec. 8354.106. LIMITATION ON USE OF EMINENT DOMAIN. The
137137 district may not exercise the power of eminent domain outside the
138138 district to acquire a site or easement for:
139139 (1) a road project authorized by Section 8354.103; or
140140 (2) a recreational facility as defined by Section
141141 49.462, Water Code.
142142 Sec. 8354.107. DIVISION OF DISTRICT. (a) The district may
143143 be divided into two or more new districts only if the district:
144144 (1) has no outstanding bonded debt; and
145145 (2) is not imposing ad valorem taxes.
146146 (b) This chapter applies to any new district created by the
147147 division of the district, and a new district has all the powers and
148148 duties of the district.
149149 (c) Any new district created by the division of the district
150150 may not, at the time the new district is created, contain any land
151151 outside the area described by Section 2 of the Act creating this
152152 chapter.
153153 (d) The board, on its own motion or on receipt of a petition
154154 signed by the owner or owners of a majority of the assessed value of
155155 the real property in the district, may adopt an order dividing the
156156 district.
157157 (e) The board may adopt an order dividing the district
158158 before or after the date the board holds an election under Section
159159 8354.003 to confirm the district's creation.
160160 (f) An order dividing the district:
161161 (1) shall:
162162 (A) name each new district;
163163 (B) include the metes and bounds of each new
164164 district;
165165 (C) appoint temporary directors for each new
166166 district, or provide that the owner or owners of a majority of the
167167 assessed value of the real property in each new district may submit
168168 a petition to the Texas Commission on Environmental Quality
169169 requesting that the commission appoint as temporary directors the
170170 five persons named in the petition; and
171171 (D) provide for the division of assets and
172172 liabilities between or among the new districts; and
173173 (2) is subject to a confirmation election in each new
174174 district.
175175 (g) On or before the 30th day after the date of adoption of
176176 an order dividing the district, the district shall file the order
177177 with the Texas Commission on Environmental Quality and record the
178178 order in the real property records of each county in which the
179179 district is located.
180180 (h) Any new district created by the division of the district
181181 shall hold a confirmation and directors' election as required by
182182 Section 8354.003. The results of that election must be filed as
183183 required by Sections 49.102(e) and (f), Water Code. If the voters
184184 of a new district do not confirm the creation of the new district,
185185 the assets, liabilities, territory, and governance of the new
186186 district revert to the original district.
187187 (i) Municipal consent to the creation of the district and to
188188 the inclusion of land in the district granted under Section
189189 8354.004 acts as municipal consent to the creation of any new
190190 district created by the division of the district and to the
191191 inclusion of land in the new district.
192192 (j) Any new district created by the division of the district
193193 must hold an election as required by this chapter to obtain voter
194194 approval before the district may impose a maintenance tax or issue
195195 bonds payable wholly or partly from ad valorem taxes.
196196 Sec. 8354.108. FIREFIGHTING AND EMERGENCY MEDICAL
197197 SERVICES. Subchapter L, Chapter 49, Water Code, applies to the
198198 district.

200200 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
201201 Sec. 8354.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
202202 district may issue, without an election, bonds and other
203203 obligations secured by:
204204 (1) revenue other than ad valorem taxes; or
205205 (2) contract payments described by Section 8354.153.
206206 (b) The district must hold an election in the manner
207207 provided by Chapters 49 and 54, Water Code, to obtain voter approval
208208 before the district may impose an ad valorem tax or issue bonds
209209 payable from ad valorem taxes.
210210 (c) The district may not issue bonds payable from ad valorem
211211 taxes to finance a road project unless the issuance is approved by a
212212 vote of a two-thirds majority of the district voters voting at an
213213 election held for that purpose.
214214 Sec. 8354.152. OPERATION AND MAINTENANCE TAX. (a) If
215215 authorized at an election held under Section 8354.151, the district
216216 may impose an operation and maintenance tax on taxable property in
217217 the district in accordance with Section 49.107, Water Code.
218218 (b) The board shall determine the tax rate. The rate may not
219219 exceed the rate approved at the election.
220220 Sec. 8354.153. CONTRACT TAXES. (a) In accordance with
221221 Section 49.108, Water Code, the district may impose a tax other than
222222 an operation and maintenance tax and use the revenue derived from
223223 the tax to make payments under a contract after the provisions of
224224 the contract have been approved by a majority of the district voters
225225 voting at an election held for that purpose.
226226 (b) A contract approved by the district voters may contain a
227227 provision stating that the contract may be modified or amended by
228228 the board without further voter approval.

230230 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
231231 Sec. 8354.201. AUTHORITY TO ISSUE BONDS AND OTHER
232232 OBLIGATIONS. The district may issue bonds or other obligations
233233 payable wholly or partly from ad valorem taxes, impact fees,
234234 revenue, contract payments, grants, or other district money, or any
235235 combination of those sources, to pay for any authorized district
236236 purpose.
237237 Sec. 8354.202. TAXES FOR BONDS. At the time the district
238238 issues bonds payable wholly or partly from ad valorem taxes, the
239239 board shall provide for the annual imposition of a continuing
240240 direct ad valorem tax, without limit as to rate or amount, while all
241241 or part of the bonds are outstanding as required and in the manner
242242 provided by Sections 54.601 and 54.602, Water Code.
243243 Sec. 8354.203. BONDS FOR ROAD PROJECTS. At the time of
244244 issuance, the total principal amount of bonds or other obligations
245245 issued or incurred to finance road projects and payable from ad
246246 valorem taxes may not exceed one-fourth of the assessed value of the
247247 real property in the district.
248248 SECTION 2. The Harris County Municipal Utility District No.
249249 524 initially includes all the territory contained in the following
250250 area: 990.804 acres in 5 non-contiguous tracts out of Sections 9,
251251 10, 15, and 16 of Harris County School Land Survey, Abstract No 332,
252252 recorded in Vol 17, Pg 222 of the Deed Records of Harris County,
253253 Texas and including within Tracts 1, 2, 3, and 4 an unnamed 66 foot
254254 roadway as shown on the plat of said Harris County School Land being
255255 granted by Commissioners Award recorded in Vol 7448, Pg 181, HCDR;
256256 said roadway does not exist physically on the ground: (All bearings
257257 used herein are based on Highway Right-of-Way Maps provided by the
258258 Texas Department of Transportation)

260260 A tract or parcel of land containing 255.572 acres (11,132,730
261261 square feet) out of Lots 9, 10, 15, and 16 of Section 9 and Lots 1,
262262 2, 7, & 8 of Section 16 of said Harris County School Land Survey,
263263 Abstract No 332, Harris County, Texas; said 255.572 acres being
264264 that same tract of land called 257.230 acres described by deed

268268 COMMENCING at a State Department of Highways and Public
269269 Transportation Horizontal Control Monument located in the

698698 (c) The Texas Commission on Environmental Quality has filed
699699 its recommendations relating to this Act with the governor, the
