77 relating to the creation of the Brazoria County Municipal Utility
88 District No. 63; providing authority to impose a tax and issue
99 bonds; granting a limited power of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8365 to read as follows:
1313 CHAPTER 8365. BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 63
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8365.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Brazoria County Municipal
1919 Utility District No. 63.
2020 Sec. 8365.002. NATURE OF DISTRICT. The district is a
2121 municipal utility district created under Section 59, Article XVI,
2222 Texas Constitution.
2323 Sec. 8365.003. CONFIRMATION AND DIRECTORS' ELECTION
2424 REQUIRED. The temporary directors shall hold an election to
2525 confirm the creation of the district and to elect five permanent
2626 directors as provided by Section 49.102, Water Code.
2727 Sec. 8365.004. CONSENT OF MUNICIPALITY REQUIRED. The
2828 temporary directors may not hold an election under Section 8365.003
2929 until each municipality in whose corporate limits or
3030 extraterritorial jurisdiction the district is located has
3131 consented by ordinance or resolution to the creation of the
3232 district and to the inclusion of land in the district.
3333 Sec. 8365.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3434 The district is created to serve a public purpose and benefit.
3535 (b) The district is created to accomplish the purposes of:
3636 (1) a municipal utility district as provided by
3737 general law and Section 59, Article XVI, Texas Constitution; and
3838 (2) Section 52, Article III, Texas Constitution, that
3939 relate to the construction, acquisition, or improvement of
4040 macadamized, graveled, or paved roads described by Section 54.234,
4141 Water Code, or improvements, including storm drainage, in aid of
4242 those roads.
4343 Sec. 8365.006. INITIAL DISTRICT TERRITORY. (a) The
4444 district is initially composed of the territory described by
4545 Section 2 of the Act creating this chapter.
4646 (b) The boundaries and field notes contained in Section 2 of
4747 the Act creating this chapter form a closure. A mistake made in the
4848 field notes or in copying the field notes in the legislative process
4949 does not affect the district's:
5050 (1) organization, existence, or validity;
5151 (2) right to issue any type of bond for the purposes
5252 for which the district is created or to pay the principal of and
5353 interest on a bond;
5454 (3) right to impose a tax; or
5555 (4) legality or operation.

5757 SUBCHAPTER B. BOARD OF DIRECTORS
5858 Sec. 8365.051. GOVERNING BODY; TERMS. (a) The district is
5959 governed by a board of five elected directors.
6060 (b) Except as provided by Section 8365.052, directors serve
6161 staggered four-year terms.
6262 Sec. 8365.052. TEMPORARY DIRECTORS. (a) On or after the
6363 effective date of the Act creating this chapter, the owner or owners
6464 of a majority of the assessed value of the real property in the
6565 district may submit a petition to the Texas Commission on
6666 Environmental Quality requesting that the commission appoint as
6767 temporary directors the five persons named in the petition. The
6868 commission shall appoint as temporary directors the five persons
6969 named in the petition.
7070 (b) Temporary directors serve until the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 8365.003; or
7373 (2) the fourth anniversary of the effective date of
7474 the Act creating this chapter.
7575 (c) If permanent directors have not been elected under
7676 Section 8365.003 and the terms of the temporary directors have
7777 expired, successor temporary directors shall be appointed or
7878 reappointed as provided by Subsection (d) to serve terms that
7979 expire on the earlier of:
8080 (1) the date permanent directors are elected under
8181 Section 8365.003; or
8282 (2) the fourth anniversary of the date of the
8383 appointment or reappointment.
8484 (d) If Subsection (c) applies, the owner or owners of a
8585 majority of the assessed value of the real property in the district
8686 may submit a petition to the Texas Commission on Environmental
8787 Quality requesting that the commission appoint as successor
8888 temporary directors the five persons named in the petition. The
8989 commission shall appoint as successor temporary directors the five
9090 persons named in the petition.

9292 SUBCHAPTER C. POWERS AND DUTIES
9393 Sec. 8365.101. GENERAL POWERS AND DUTIES. The district has
9494 the powers and duties necessary to accomplish the purposes for
9595 which the district is created.
9696 Sec. 8365.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9797 DUTIES. The district has the powers and duties provided by the
9898 general law of this state, including Chapters 49 and 54, Water Code,
9999 applicable to municipal utility districts created under Section 59,
100100 Article XVI, Texas Constitution.
101101 Sec. 8365.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
102102 Section 52, Article III, Texas Constitution, the district may
103103 design, acquire, construct, finance, issue bonds for, improve, and
104104 convey to this state, a county, or a municipality for operation and
105105 maintenance macadamized, graveled, or paved roads described by
106106 Section 54.234, Water Code, or improvements, including storm
107107 drainage, in aid of those roads.
108108 (b) The district may exercise the powers provided by this
109109 section without submitting a petition to or obtaining approval from
110110 the Texas Commission on Environmental Quality as required by
111111 Section 54.234, Water Code.
112112 Sec. 8365.104. APPROVAL OF ROAD PROJECT. (a) The district
113113 may not undertake a road project authorized by Section 8365.103
114114 unless:
115115 (1) each municipality or county that will operate and
116116 maintain the road has approved the plans and specifications of the
117117 road project, if a municipality or county will operate and maintain
118118 the road; or
119119 (2) the Texas Transportation Commission has approved
120120 the plans and specifications of the road project, if the state will
121121 operate and maintain the road.
122122 (b) Except as provided by Subsection (a), the district is
123123 not required to obtain approval from the Texas Transportation
124124 Commission to design, acquire, construct, finance, issue bonds for,
125125 improve, or convey a road project.
126126 Sec. 8365.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
127127 OR RESOLUTION. The district shall comply with all applicable
128128 requirements of any ordinance or resolution that is adopted under
129129 Section 54.016 or 54.0165, Water Code, and that consents to the
130130 creation of the district or to the inclusion of land in the
131131 district.
132132 Sec. 8365.106. LIMITATION ON USE OF EMINENT DOMAIN. The
133133 district may not exercise the power of eminent domain outside the
134134 district to acquire a site or easement for:
135135 (1) a road project authorized by Section 8365.103; or
136136 (2) a recreational facility as defined by Section
137137 49.462, Water Code.
138138 Sec. 8365.107. DIVISION OF DISTRICT. (a) The district may
139139 be divided into two or more new districts only if the district:
140140 (1) has no outstanding bonded debt; and
141141 (2) is not imposing ad valorem taxes.
142142 (b) This chapter applies to any new district created by the
143143 division of the district, and a new district has all the powers and
144144 duties of the district.
145145 (c) Any new district created by the division of the district
146146 may not, at the time the new district is created, contain any land
147147 outside the area described by Section 2 of the Act creating this
148148 chapter.
149149 (d) The board, on its own motion or on receipt of a petition
150150 signed by the owner or owners of a majority of the assessed value of
151151 the real property in the district, may adopt an order dividing the
152152 district.
153153 (e) The board may adopt an order dividing the district
154154 before or after the date the board holds an election under Section
155155 8365.003 to confirm the district's creation.
156156 (f) An order dividing the district shall:
157157 (1) name each new district;
158158 (2) include the metes and bounds description of the
159159 territory of each new district;
160160 (3) appoint temporary directors for each new district,
161161 or provide that the owner or owners of a majority of the assessed
162162 value of the real property in the district may submit a petition to
163163 the Texas Commission on Environmental Quality requesting that the
164164 commission appoint as temporary directors the five persons named in
165165 the petition;
166166 (4) provide for the division of assets and liabilities
167167 between or among the new districts; and
168168 (5) be subject to a confirmation election in each new
169169 district.
170170 (g) On or before the 30th day after the date of adoption of
171171 an order dividing the district, the district shall file the order
172172 with the Texas Commission on Environmental Quality and record the
173173 order in the real property records of each county in which the
174174 district is located.
175175 (h) Any new district created by the division of the district
176176 shall hold a confirmation and directors' election as required by
177177 Section 8365.003. The results of that election must be filed as
178178 required by Sections 49.102(e) and (f), Water Code. If the voters
179179 of a new district do not confirm the creation of the new district,
180180 the assets, liabilities, territory, and governance of the new
181181 district revert to the original district.
182182 (i) Municipal consent to the creation of the district and to
183183 the inclusion of land in the district granted under Section
184184 8365.004 acts as municipal consent to the creation of any new
185185 district created by the division of the district and to the
186186 inclusion of land in the new district.
187187 (j) Any new district created by the division of the district
188188 must hold an election as required by this chapter to obtain voter
189189 approval before the district may impose a maintenance tax or issue
190190 bonds payable wholly or partly from ad valorem taxes.

192192 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
193193 Sec. 8365.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
194194 district may issue, without an election, bonds and other
195195 obligations secured by:
196196 (1) revenue other than ad valorem taxes; or
197197 (2) contract payments described by Section 8365.153.
198198 (b) The district must hold an election in the manner
199199 provided by Chapters 49 and 54, Water Code, to obtain voter approval
200200 before the district may impose an ad valorem tax or issue bonds
201201 payable from ad valorem taxes.
202202 (c) The district may not issue bonds payable from ad valorem
203203 taxes to finance a road project unless the issuance is approved by a
204204 vote of a two-thirds majority of the district voters voting at an
205205 election held for that purpose.
206206 Sec. 8365.152. OPERATION AND MAINTENANCE TAX. (a) If
207207 authorized at an election held under Section 8365.151, the district
208208 may impose an operation and maintenance tax on taxable property in
209209 the district in accordance with Section 49.107, Water Code.
210210 (b) The board shall determine the tax rate. The rate may not
211211 exceed the rate approved at the election.
212212 Sec. 8365.153. CONTRACT TAXES. (a) In accordance with
213213 Section 49.108, Water Code, the district may impose a tax other than
214214 an operation and maintenance tax and use the revenue derived from
215215 the tax to make payments under a contract after the provisions of
216216 the contract have been approved by a majority of the district voters
217217 voting at an election held for that purpose.
218218 (b) A contract approved by the district voters may contain a
219219 provision stating that the contract may be modified or amended by
220220 the board without further voter approval.

222222 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
223223 Sec. 8365.201. AUTHORITY TO ISSUE BONDS AND OTHER
224224 OBLIGATIONS. The district may issue bonds or other obligations
225225 payable wholly or partly from ad valorem taxes, impact fees,
226226 revenue, contract payments, grants, or other district money, or any
227227 combination of those sources, to pay for any authorized district
228228 purpose.
229229 Sec. 8365.202. TAXES FOR BONDS. At the time the district
230230 issues bonds payable wholly or partly from ad valorem taxes, the
231231 board shall provide for the annual imposition of a continuing
232232 direct ad valorem tax, without limit as to rate or amount, while all
233233 or part of the bonds are outstanding as required and in the manner
234234 provided by Sections 54.601 and 54.602, Water Code.
235235 Sec. 8365.203. BONDS FOR ROAD PROJECTS. At the time of
236236 issuance, the total principal amount of bonds or other obligations
237237 issued or incurred to finance road projects and payable from ad
238238 valorem taxes may not exceed one-fourth of the assessed value of the
239239 real property in the district.
240240 SECTION 2. The Brazoria County Municipal Utility District
241241 No. 63 initially includes all the territory contained in the
242242 following area:
243243 EIGHT TRACTS OF LAND TOTALING 960.05 ACRES DESCRIBED AS FOLLOWS:
244244 TRACT 1:
245245 A survey of 185.59 acres of land, being a part of that certain
246246 called 325.54 Acre Tract containing Lots 12, 13, and 14, and those
247247 platted roads lying between said Lots, of the Bogart and Taylor
248248 Subdivision of the West 1/2 of the W.D.C. Hall League, Abstract 69,
249249 Brazoria County, Texas, according to the Plat recorded in Volume 1,
250250 Page 64, Plat Records, and Volume 16, Pages 518-519, Deed Records of
251251 Brazoria County, Texas (B.C.D.R), and being a part of that certain
252252 called 326.04 Acre Tract described in a deed from Elmer M. Cannon,
253253 Jr. to Tehama Communities, LLP recorded in Clerk's File (C.F.)
254254 2006-074531, said 185.59 Acre Tract being more particularly
255255 described as follows:
256256 BEGINNING at a 1/2 inch iron rod found in the West
257257 right-of-way line of County Road 48 (60.0 feet wide), said point
258258 being a Northeast corner of this tract and the Southeast corner of a
259259 tract described as Tract One in a deed to Allen W. Gibson recorded
260260 in C.F. 2001-017726, said point being located South 03 degrees 02
261261 minutes 44 seconds East, 990.09 feet, from a sucker rod found at the
262262 intersection of the West right-of-way line of County Road 48 with
263263 the South right-of-way line of County Road 841 (60.0 feet wide);
264264 THENCE South 03 degrees 02 minutes 44 seconds East, along
265265 said West right-of-way line of County Road 48, 330.0 feet, to a
266266 point for corner a the Northeast corner of the Ann M. Doggett Tract
267267 described in Volume 1474, Page 244, B.C.D.R.;
268268 THENCE South 86 degrees 56 minutes 42 seconds West, along the
269269 North line of said Doggett Tract, at 7.0 feet pass a 1/2 inch iron
270270 rod set for reference, and continue for a total distance of 1,318.61
271271 feet to a 1/2 inch iron rod found inside a 3 inch iron pipe at the
272272 Northwest corner of said Doggett Tract;
273273 THENCE South 02 degrees 56 minutes 25 seconds East, along the
274274 West line of said Doggett Tract, 330.30 feet, to a 1/2 inch iron rod
275275 found inside a 3 inch iron pipe at the Southwest corner of said

348348 Brazoria County, Texas (B.C.D.R.), and being that 264.533 Acre
349349 Tract described in a deed from Buffet Inc. to Tehama Communities,
350350 LLP recorded in Clerk's File (C.F.) 2005-069871, said 160.92 acres
351351 tract of land being more particularly described as follows:
352352 BEGINNING at a 4 -inch square concrete monument found at the
353353 Northeast corner of said Lot 10, said concrete monument being the
354354 same described in that certain deed to Claud B. Hamill recorded in
355355 Volume 1121, at Page 386 of the B.C.D.R., being also the Northwest
356356 corner of Lot 9 of said Bogart and Taylor Subdivision;

380380 Records of Brazoria County, Texas (B.C.M.R), and being more
381381 particularly described by metes and bounds as follows:
382382 BEGINNING at a set 1/2 inch iron rod with a cap in the
383383 Northwest corner of Lot 9 set on the South right-of way line of
384384 Adams Road / County Road 841, a public road, presently unopened, for
385385 the Northwest corner of this tract and the POINT OF BEGINNING;
386386 THENCE North 86 degrees 57 minutes 02 seconds East, along the
387387 South line of said public road, a distance of 700.55 feet for the
388388 Northeast corner of this tract;
389389 THENCE South 03 degrees 00 minutes 50 seconds East, a
390390 distance of 2,657.47 feet for the Southeast corner of this tract,
391391 said point being in the South lines of Lot 9;
392392 THENCE South 86 degrees 57 minutes 14 seconds West, along the
393393 centerline of Ditch 316-00-00 as recorded in Iowa Colony Drainage
394394 District No. 5, a distance of 707.48 feet for the Southwest corner

396396 THENCE North 02 degrees 51 minutes 52 seconds West, along the
397397 West lines of Lot 9, same being the East line of that tract of land
398398 (Lots 10, 11, and 19, Bogart and Taylor) as described by deed
399399 recorded in B.C.C.F. No. 85030634, a distance of 2,657.44 feet to
400400 the POINT OF BEGINNING and containing 42.95 acres of land, more or
401401 less, and being a part of the same property described in the deed
402402 "Tract C" as described in the Clerk's File No. 2008-037928 of
403403 Brazoria County, Texas, to which deed and the record thereof

409409 the Map Records of Brazoria County, Texas (B.C.M.R.), and being
410410 more particularly described by metes and bounds as follows:
411411 BEGINNING at a found 1 inch pipe the Northwest corner of Lot
412412 4, said point being located in the East right-of-way line of Airline
413413 Road / County Road 48, with said point also being the Northwest
414414 corner of this tract and the POINT OF BEGINNING;
415415 THENCE North 86 degrees 57 minutes 02 seconds East, along the
416416 North line of Lots 4, 5, and 6, same being the South lines of that
417417 called 70.96 Acre Tract as described by deed recorded in B.C.C.F.
418418 No. 03-004685 out of Lots 47-50 of the CS Palmer Subdivision of

695695 (b) The governor, one of the required recipients, has
696696 submitted the notice and Act to the Texas Commission on

698698 (c) The Texas Commission on Environmental Quality has filed
699699 its recommendations relating to this Act with the governor, the
700700 lieutenant governor, and the speaker of the house of
