55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to additional sick leave for certain peace officers and
88 corrections officers who work overtime.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 661, Government Code, is
1111 amended by adding Section 661.2021 to read as follows:
1212 Sec. 661.2021. ADDITIONAL SICK LEAVE FOR PEACE OFFICERS AND
1313 CORRECTIONS OFFICERS. (a) This section applies only to:
1414 (1) a state employee who is a peace officer under
1515 Article 2.12, Code of Criminal Procedure, and commissioned by a
1616 state officer or state agency; and
1717 (2) a member of the class of employees of the
1818 institutional division or the state jail division of the Texas
1919 Department of Criminal Justice formally designated as custodial
2020 personnel under Section 615.006 by the Texas Board of Criminal
2121 Justice or its predecessor in function.
2222 (b) In addition to the sick leave provided under Section
2323 661.202(c), a person described by Subsection (a) who works overtime
2424 during a month accrues additional sick leave for the month as
2525 follows:
2626 (1) less than 20 hours of overtime during the month,
2727 one hour of sick leave;
2828 (2) at least 20 hours but less than 40 hours of
2929 overtime during the month, two hours of sick leave;
3030 (3) at least 40 hours but less than 60 hours of
3131 overtime during the month, three hours of sick leave;
3232 (4) at least 60 hours but less than 80 hours of
3333 overtime during the month, four hours of sick leave; and
3434 (5) 80 hours or more of overtime during the month, five
3535 hours of sick leave.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
