| 7 | 7 | | relating to additional sick leave for certain peace officers and |

| 8 | 8 | | corrections officers who work overtime. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter G, Chapter 661, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 661.2021 to read as follows: |
|---|
| 12 | 12 | | Sec. 661.2021. ADDITIONAL SICK LEAVE FOR PEACE OFFICERS AND |
|---|
| 13 | 13 | | CORRECTIONS OFFICERS. (a) This section applies only to: |
|---|
| 14 | 14 | | (1) a state employee who is a peace officer under |
|---|
| 15 | 15 | | Article 2.12, Code of Criminal Procedure, and commissioned by a |
|---|
| 16 | 16 | | state officer or state agency; and |
|---|
| 17 | 17 | | (2) a member of the class of employees of the |
|---|
| 18 | 18 | | institutional division or the state jail division of the Texas |
|---|
| 19 | 19 | | Department of Criminal Justice formally designated as custodial |
|---|
| 20 | 20 | | personnel under Section 615.006 by the Texas Board of Criminal |
|---|
| 21 | 21 | | Justice or its predecessor in function. |
|---|
| 22 | 22 | | (b) In addition to the sick leave provided under Section |
|---|
| 23 | 23 | | 661.202(c), a person described by Subsection (a) who works overtime |
|---|
| 24 | 24 | | during a month accrues additional sick leave for the month as |
|---|
| 25 | 25 | | follows: |
|---|
| 26 | 26 | | (1) less than 20 hours of overtime during the month, |
|---|
| 27 | 27 | | one hour of sick leave; |
|---|
| 28 | 28 | | (2) at least 20 hours but less than 40 hours of |
|---|
| 29 | 29 | | overtime during the month, two hours of sick leave; |
|---|
| 30 | 30 | | (3) at least 40 hours but less than 60 hours of |
|---|
| 31 | 31 | | overtime during the month, three hours of sick leave; |
|---|
| 32 | 32 | | (4) at least 60 hours but less than 80 hours of |
|---|
| 33 | 33 | | overtime during the month, four hours of sick leave; and |
|---|
| 34 | 34 | | (5) 80 hours or more of overtime during the month, five |
|---|
| 35 | 35 | | hours of sick leave. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
