| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 8813.007, Special District Local Laws |
|---|
| 10 | 10 | | Code, is amended by adding Subsection (c) to read as follows: |
|---|
| 11 | 11 | | (c) Chapter 36, Water Code, does not apply to the authority. |
|---|
| 12 | 12 | | SECTION 2. Subchapter C, Chapter 8813, Special District |
|---|
| 13 | 13 | | Local Laws Code, is amended by adding Section 8813.120 to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | Sec. 8813.120. ACTION AGAINST PERSON, DISTRICT, OR |
|---|
| 16 | 16 | | POLITICAL SUBDIVISION. (a) The authority may bring an action in a |
|---|
| 17 | 17 | | district court against a person, including a district or other |
|---|
| 18 | 18 | | political subdivision located in the authority's territory or |
|---|
| 19 | 19 | | included in the authority's groundwater reduction plan, to: |
|---|
| 20 | 20 | | (1) recover any fees, rates, charges, assessments, |
|---|
| 21 | 21 | | collection expenses, attorney's fees, interest, penalties, or |
|---|
| 22 | 22 | | administrative penalties due the authority; or |
|---|
| 23 | 23 | | (2) enforce the authority's rules or orders. |
|---|
| 24 | 24 | | (b) Governmental immunity from suit or liability of a |
|---|
| 25 | 25 | | district or other political subdivision is waived for the purposes |
|---|
| 26 | 26 | | of an action under this section. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
