88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8369 to read as follows:
1111 CHAPTER 8369. SAN GABRIEL MUNICIPAL UTILITY DISTRICT NO. 1
1212 SUBCHAPTER A. GENERAL PROVISIONS
1313 Sec. 8369.001. DEFINITIONS. In this chapter:
1414 (1) "Board" means the district's board of directors.
1515 (2) "Director" means a board member.
1616 (3) "District" means the San Gabriel Municipal Utility
1717 District No. 1.
1818 Sec. 8369.002. NATURE OF DISTRICT. The district is a
1919 municipal utility district created under Section 59, Article XVI,
2020 Texas Constitution.
2121 Sec. 8369.003. CONFIRMATION AND DIRECTORS' ELECTION
2222 REQUIRED. The temporary directors shall hold an election to
2323 confirm the creation of the district and to elect five permanent
2424 directors as provided by Section 49.102, Water Code.
2525 Sec. 8369.004. CONSENT OF MUNICIPALITY REQUIRED. The
2626 temporary directors may not hold an election under Section 8369.003
2727 until each municipality in whose corporate limits or
2828 extraterritorial jurisdiction the district is located has
2929 consented by ordinance or resolution to the creation of the
3030 district and to the inclusion of land in the district.
3131 Sec. 8369.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3232 The district is created to serve a public purpose and benefit.
3333 (b) The district is created to accomplish the purposes of:
3434 (1) a municipal utility district as provided by
3535 general law and Section 59, Article XVI, Texas Constitution; and
3636 (2) Section 52, Article III, Texas Constitution, that
3737 relate to the construction, acquisition, improvement, operation,
3838 or maintenance of macadamized, graveled, or paved roads, or
3939 improvements, including storm drainage, in aid of those roads.
4040 Sec. 8369.006. INITIAL DISTRICT TERRITORY. (a) The
4141 district is initially composed of the territory described by
4242 Section 2 of the Act creating this chapter.
4343 (b) The boundaries and field notes contained in Section 2 of
4444 the Act creating this chapter form a closure. A mistake made in the
4545 field notes or in copying the field notes in the legislative process
4646 does not affect the district's:
4747 (1) organization, existence, or validity;
4848 (2) right to issue any type of bond for the purposes
4949 for which the district is created or to pay the principal of and
5050 interest on a bond;
5151 (3) right to impose a tax; or
5252 (4) legality or operation.

5454 SUBCHAPTER B. BOARD OF DIRECTORS
5555 Sec. 8369.051. GOVERNING BODY; TERMS. (a) The district is
5656 governed by a board of five elected directors.
5757 (b) Except as provided by Section 8369.052, directors serve
5858 staggered four-year terms.
5959 Sec. 8369.052. TEMPORARY DIRECTORS. (a) The temporary
6060 board consists of:
6161 (1) Mark Barker;
6262 (2) Mike Mayben;
6363 (3) Raudel Hinojosa;
6464 (4) John Weddige; and
6565 (5) Sammie Joseph III.
6666 (b) Temporary directors serve until the earlier of:
6767 (1) the date permanent directors are elected under
6868 Section 8369.003; or
6969 (2) September 1, 2013.
7070 (c) If permanent directors have not been elected under
7171 Section 8369.003 and the terms of the temporary directors have
7272 expired, successor temporary directors shall be appointed or
7373 reappointed as provided by Subsection (d) to serve terms that
7474 expire on the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8369.003; or
7777 (2) the fourth anniversary of the date of the
7878 appointment or reappointment.
7979 (d) If Subsection (c) applies, the owner or owners of a
8080 majority of the assessed value of the real property in the district
8181 may submit a petition to the Texas Commission on Environmental
8282 Quality requesting that the commission appoint as successor
8383 temporary directors the five persons named in the petition. The
8484 commission shall appoint as successor temporary directors the five
8585 persons named in the petition.

8787 SUBCHAPTER C. POWERS AND DUTIES
8888 Sec. 8369.101. GENERAL POWERS AND DUTIES. The district has
8989 the powers and duties necessary to accomplish the purposes for
9090 which the district is created.
9191 Sec. 8369.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9292 DUTIES. The district has the powers and duties provided by the
9393 general law of this state, including Chapters 49 and 54, Water Code,
9494 applicable to municipal utility districts created under Section 59,
9595 Article XVI, Texas Constitution.
9696 Sec. 8369.103. AUTHORITY FOR ROAD PROJECTS. Under Section
9797 52, Article III, Texas Constitution, the district may design,
9898 acquire, construct, finance, issue bonds for, improve, operate,
9999 maintain, and convey to this state, a county, or a municipality for
100100 operation and maintenance macadamized, graveled, or paved roads, or
101101 improvements, including storm drainage, in aid of those roads.
102102 Sec. 8369.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
103103 project must meet all applicable construction standards, zoning and
104104 subdivision requirements, and regulations of each municipality in
105105 whose corporate limits or extraterritorial jurisdiction the road
106106 project is located.
107107 (b) If a road project is not located in the corporate limits
108108 or extraterritorial jurisdiction of a municipality, the road
109109 project must meet all applicable construction standards,
110110 subdivision requirements, and regulations of each county in which
111111 the road project is located.
112112 (c) If the state will maintain and operate the road, the
113113 Texas Transportation Commission must approve the plans and
114114 specifications of the road project.
115115 Sec. 8369.105. STREET REPAIR AND MAINTENANCE. (a) After
116116 September 1, 2019, the district, at the district's expense, shall
117117 repair and maintain any streets in the district.
118118 (b) A district's repair and maintenance of streets under
119119 this section must meet all applicable construction standards and
120120 regulations of Williamson County.
121121 Sec. 8369.106. REGIONAL WASTE DISPOSAL POWERS AND DUTIES.
122122 The district has the powers and duties applicable to a district
123123 under Chapter 30, Water Code.
124124 Sec. 8369.107. WASTEWATER TREATMENT FACILITY DESIGN
125125 APPROVAL. The district must obtain the approval of the Brazos River
126126 Authority for the design of any district wastewater treatment
127127 facility.
128128 Sec. 8369.108. WASTEWATER SERVICE PROVIDERS. Only the
129129 Brazos River Authority or a provider approved by the Brazos River
130130 Authority may provide wastewater service in the district.
131131 Sec. 8369.109. COMPLIANCE WITH FEBRUARY 2005 AGREEMENT.
132132 The district shall comply with the terms of the "Agreement
133133 Regarding Sewer Services Areas and Customers" among the Lower
134134 Colorado River Authority, the Brazos River Authority, the City of
135135 Georgetown, the City of Liberty Hill, and the Chisholm Trail
136136 Special Utility District dated February 1, 2005.
137137 Sec. 8369.110. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
138138 OR RESOLUTION. The district shall comply with all applicable
139139 requirements of any ordinance or resolution that is adopted under
140140 Section 54.016 or 54.0165, Water Code, and that consents to the
141141 creation of the district or to the inclusion of land in the
142142 district.
143143 Sec. 8369.111. LIMITATION ON USE OF EMINENT DOMAIN. The
144144 district may not exercise the power of eminent domain outside the
145145 district to acquire a site or easement for:
146146 (1) a road project authorized by Section 8369.103; or
147147 (2) a recreational facility as defined by Section
148148 49.462, Water Code.

150150 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
151151 Sec. 8369.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
152152 district may issue, without an election, bonds and other
153153 obligations secured by:
154154 (1) revenue other than ad valorem taxes; or
155155 (2) contract payments described by Section 8369.153.
156156 (b) The district must hold an election in the manner
157157 provided by Chapters 49 and 54, Water Code, to obtain voter approval
158158 before the district may impose an ad valorem tax or issue bonds
159159 payable from ad valorem taxes.
160160 (c) The district may not issue bonds payable from ad valorem
161161 taxes to finance a road project unless the issuance is approved by a
162162 vote of a two-thirds majority of the district voters voting at an
163163 election held for that purpose.
164164 Sec. 8369.152. OPERATION AND MAINTENANCE TAX. (a) If
165165 authorized at an election held under Section 8369.151, the district
166166 may impose an operation and maintenance tax on taxable property in
167167 the district in accordance with Section 49.107, Water Code.
168168 (b) The board shall determine the tax rate. The rate may not
169169 exceed the rate approved at the election.
170170 Sec. 8369.153. CONTRACT TAXES. (a) In accordance with
171171 Section 49.108, Water Code, the district may impose a tax other than
172172 an operation and maintenance tax and use the revenue derived from
173173 the tax to make payments under a contract after the provisions of
174174 the contract have been approved by a majority of the district voters
175175 voting at an election held for that purpose.
176176 (b) A contract approved by the district voters may contain a
177177 provision stating that the contract may be modified or amended by
178178 the board without further voter approval.

180180 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
181181 Sec. 8369.201. AUTHORITY TO ISSUE BONDS AND OTHER
182182 OBLIGATIONS. The district may issue bonds or other obligations
183183 payable wholly or partly from ad valorem taxes, impact fees,
184184 revenue, contract payments, grants, or other district money, or any
185185 combination of those sources, to pay for any authorized district
186186 purpose.
187187 Sec. 8369.202. TAXES FOR BONDS. At the time the district
188188 issues bonds payable wholly or partly from ad valorem taxes, the
189189 board shall provide for the annual imposition of a continuing
190190 direct ad valorem tax, without limit as to rate or amount, while all
191191 or part of the bonds are outstanding as required and in the manner
192192 provided by Sections 54.601 and 54.602, Water Code.
193193 Sec. 8369.203. BONDS FOR ROAD PROJECTS. At the time of
194194 issuance, the total principal amount of bonds or other obligations
195195 issued or incurred to finance road projects and payable from ad
196196 valorem taxes may not exceed one-fourth of the assessed value of the
197197 real property in the district.
