| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 1C, Chapter 19, Acts of the 55th | |
| 11 | 11 | Legislature, Regular Session, 1957, is amended to read as follows: | |
| 12 | 12 | Sec. 1C. (a) Except as provided by Subsection (b) of this | |
| 13 | 13 | section, notwithstanding [Notwithstanding] other provisions of | |
| 14 | 14 | this Act, the Panhandle Groundwater Conservation District may | |
| 15 | 15 | regulate any underground water resources inside of the boundaries | |
| 16 | 16 | of the district, including any aquifer, perched water formation, or | |
| 17 | 17 | alluvium deposit, in the manner provided by Sections 2 and 3 of this | |
| 18 | 18 | Act and general law governing groundwater conservation districts. | |
| 19 | 19 | (b) The district may not regulate underground water | |
| 20 | 20 | resources in Hemphill County. | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2009. |
