| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 36.0151, Water Code, is amended by | |
| 11 | 11 | amending Subsection (a) and adding Subsection (c) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (a) Except as provided by Subsection (c), if [If] the | |
| 14 | 14 | commission is required to create a district under Section | |
| 15 | 15 | 35.012(b), it shall, without an evidentiary hearing, issue an order | |
| 16 | 16 | creating the district and shall provide in its order that temporary | |
| 17 | 17 | directors be appointed under Section 36.016 and that an election be | |
| 18 | 18 | called by the temporary directors to authorize the district to | |
| 19 | 19 | assess taxes and to elect permanent directors. | |
| 20 | 20 | (c) Before September 2, 2011, the commission may not create | |
| 21 | 21 | a groundwater conservation district in Dallas County. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2009. |
