| 7 | 7 | | relating to reports of incidents of bullying at public schools and |

| 8 | 8 | | at public school activities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 37.083, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-2) to read as follows: |
|---|
| 12 | 12 | | (a-2) In accordance with rules adopted by the commissioner, |
|---|
| 13 | 13 | | each school district shall report annually to the agency |
|---|
| 14 | 14 | | information regarding each incident of bullying that occurred |
|---|
| 15 | 15 | | during the preceding school year in the district on school |
|---|
| 16 | 16 | | property, in a school vehicle, or at a school-sponsored or |
|---|
| 17 | 17 | | school-related activity, including at a school bus stop. The |
|---|
| 18 | 18 | | agency shall include the information in the comprehensive annual |
|---|
| 19 | 19 | | report required by Section 39.182. For purposes of this subsection, |
|---|
| 20 | 20 | | "bullying" has the meaning assigned by Section 25.0342. |
|---|
| 21 | 21 | | SECTION 2. (a) Each school district shall submit to the |
|---|
| 22 | 22 | | Texas Education Agency information as required under Section |
|---|
| 23 | 23 | | 37.083(a-2), Education Code, as added by this Act, beginning with |
|---|
| 24 | 24 | | the 2010-2011 school year based on incidents of bullying during the |
|---|
| 25 | 25 | | 2009-2010 school year. |
|---|
| 26 | 26 | | (b) The Texas Education Agency shall include the |
|---|
| 27 | 27 | | information required under Section 37.083(a-2), Education Code, as |
|---|
| 28 | 28 | | added by this Act, in the comprehensive annual report required by |
|---|
| 29 | 29 | | Section 39.182, Education Code, beginning with the report required |
|---|
| 30 | 30 | | to be submitted not later than December 1, 2010. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
