55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reports of incidents of bullying at public schools and
88 at public school activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.083, Education Code, is amended by
1111 adding Subsection (a-2) to read as follows:
1212 (a-2) In accordance with rules adopted by the commissioner,
1313 each school district shall report annually to the agency
1414 information regarding each incident of bullying that occurred
1515 during the preceding school year in the district on school
1616 property, in a school vehicle, or at a school-sponsored or
1717 school-related activity, including at a school bus stop. The
1818 agency shall include the information in the comprehensive annual
1919 report required by Section 39.182. For purposes of this subsection,
2020 "bullying" has the meaning assigned by Section 25.0342.
2121 SECTION 2. (a) Each school district shall submit to the
2222 Texas Education Agency information as required under Section
2323 37.083(a-2), Education Code, as added by this Act, beginning with
2424 the 2010-2011 school year based on incidents of bullying during the
2525 2009-2010 school year.
2626 (b) The Texas Education Agency shall include the
2727 information required under Section 37.083(a-2), Education Code, as
2828 added by this Act, in the comprehensive annual report required by
2929 Section 39.182, Education Code, beginning with the report required
3030 to be submitted not later than December 1, 2010.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
