| 5 | 5 | | relating to the eligibility requirements for volunteer deputy |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Section 13.031(d), Election Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (d) To be eligible for appointment as a volunteer deputy |
|---|
| 11 | 11 | | registrar, a person must: |
|---|
| 12 | 12 | | (1) be 18 years of age or older; and |
|---|
| 13 | 13 | | (2) not have been finally convicted of a felony or, if |
|---|
| 14 | 14 | | so convicted, must have: |
|---|
| 15 | 15 | | (A) fully discharged the person's sentence, |
|---|
| 16 | 16 | | including any term of incarceration, parole, or supervision, or |
|---|
| 17 | 17 | | completed a period of probation ordered by any court; or |
|---|
| 18 | 18 | | (B) been pardoned or otherwise released from the |
|---|
| 19 | 19 | | resulting disability to vote. |
|---|
| 20 | 20 | | SECTION 2. Section 13.032, Election Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | Sec. 13.032. PROHIBITION ON REFUSING TO APPOINT. A |
|---|
| 23 | 23 | | registrar may not refuse to appoint as a volunteer deputy |
|---|
| 24 | 24 | | registrar: |
|---|
| 25 | 25 | | (1) a person eligible for appointment under Section |
|---|
| 26 | 26 | | 13.031(d) [resident of the county served by the registrar]; or |
|---|
| 27 | 27 | | (2) any person on the basis of sex, race, creed, color, |
|---|
| 28 | 28 | | or national origin or ancestry. |
|---|
| 29 | 29 | | SECTION 3. The appointment of a person serving as a |
|---|
| 30 | 30 | | volunteer deputy registrar who does not meet the eligibility |
|---|
| 31 | 31 | | requirements of Section 13.031(d), Election Code, as amended by |
|---|
| 32 | 32 | | this Act, expires on the effective date of this Act. The secretary |
|---|
| 33 | 33 | | of state shall prescribe procedures necessary to implement this |
|---|
| 34 | 34 | | section. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2009. |
