| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 81.001, Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 81.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "Commission" means the Texas Energy [Railroad] |
|---|
| 14 | 14 | | Commission [of Texas]. |
|---|
| 15 | 15 | | (2) "Commissioner" means any member of the Texas |
|---|
| 16 | 16 | | Energy [Railroad] Commission [of Texas]. |
|---|
| 17 | 17 | | SECTION 2. Subchapter A, Chapter 81, Natural Resources |
|---|
| 18 | 18 | | Code, is amended by adding Section 81.002 to read as follows: |
|---|
| 19 | 19 | | Sec. 81.002. TEXAS ENERGY COMMISSION. (a) The Railroad |
|---|
| 20 | 20 | | Commission of Texas is renamed the Texas Energy Commission. |
|---|
| 21 | 21 | | (b) A reference in law to the Railroad Commission of Texas |
|---|
| 22 | 22 | | means the Texas Energy Commission. |
|---|
| 23 | 23 | | SECTION 3. (a) Effective January 1, 2010: |
|---|
| 24 | 24 | | (1) the name of the Railroad Commission of Texas is |
|---|
| 25 | 25 | | changed to the Texas Energy Commission, and all powers, duties, |
|---|
| 26 | 26 | | rights, and obligations of the Railroad Commission of Texas are the |
|---|
| 27 | 27 | | powers, duties, rights, and obligations of the Texas Energy |
|---|
| 28 | 28 | | Commission; |
|---|
| 29 | 29 | | (2) a member of the Railroad Commission of Texas is a |
|---|
| 30 | 30 | | member of the Texas Energy Commission; and |
|---|
| 31 | 31 | | (3) any appropriation to the Railroad Commission of |
|---|
| 32 | 32 | | Texas is an appropriation to the Texas Energy Commission. |
|---|
| 33 | 33 | | (b) Effective January 1, 2010, a reference in law to the |
|---|
| 34 | 34 | | Railroad Commission of Texas is a reference to the Texas Energy |
|---|
| 35 | 35 | | Commission. |
|---|
| 36 | 36 | | (c) The Texas Energy Commission is the successor to the |
|---|
| 37 | 37 | | Railroad Commission of Texas in all respects. All personnel, |
|---|
| 38 | 38 | | equipment, data, documents, facilities, contracts, items, other |
|---|
| 39 | 39 | | property, rules, decisions, and proceedings of or involving the |
|---|
| 40 | 40 | | Railroad Commission of Texas are unaffected by the change in the |
|---|
| 41 | 41 | | name of the agency. |
|---|
| 42 | 42 | | (d) The Railroad Commission of Texas shall adopt a timetable |
|---|
| 43 | 43 | | for phasing in the change of the agency's name so as to minimize the |
|---|
| 44 | 44 | | fiscal impact of the name change. Until January 1, 2010, to allow |
|---|
| 45 | 45 | | for phasing in the change of the agency's name and in accordance |
|---|
| 46 | 46 | | with the timetable established as required by this section, the |
|---|
| 47 | 47 | | agency may perform any act authorized by law for the Railroad |
|---|
| 48 | 48 | | Commission of Texas as the Railroad Commission of Texas or as the |
|---|
| 49 | 49 | | Texas Energy Commission. Any act of the Railroad Commission of |
|---|
| 50 | 50 | | Texas acting as the Texas Energy Commission after the effective |
|---|
| 51 | 51 | | date of this Act and before January 1, 2010, is an act of the |
|---|
| 52 | 52 | | Railroad Commission of Texas. |
|---|
| 53 | 53 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 57 | | Act takes effect September 1, 2009. |
|---|
