55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment and implementation of a school-based
88 influenza vaccination pilot program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) The Department of State Health Services and
1111 the Texas Education Agency shall jointly establish and implement
1212 for the 2009-2010 school year a school-based influenza vaccination
1313 pilot program using both killed vaccine and live attenuated vaccine
1414 in:
1515 (1) a school district with a student population of
1616 50,000 or more that is at least 85 percent economically
1717 disadvantaged and located in a home-rule municipality with a
1818 population of more than 1.1 million;
1919 (2) a school district with a student population that
2020 is less than five percent economically disadvantaged and located in
2121 a municipality with a population of more than 600,000 and less than
2222 one million; and
2323 (3) two school districts selected by the Texas
2424 Immunization Stakeholder Working Group including:
2525 (A) one school district with a student population
2626 that is at least 90 percent economically disadvantaged and located
2727 in a county with a population of 50,000 or less; and
2828 (B) one school district with a student population
2929 that is at least 90 percent economically disadvantaged and located
3030 in a county on the international border.
3131 (b) The Texas Immunization Stakeholder Working Group shall
3232 establish within the working group a pilot program subcommittee
3333 composed of representatives from:
3434 (1) the Texas Pediatric Society;
3535 (2) the Texas Academy of Family Physicians;
3636 (3) each school district in which the pilot program
3737 will operate, after the selection of those districts under
3838 Subsection (a) of this section;
3939 (4) the state Medicaid medical director; and
4040 (5) each local health department that serves the
4141 geographic area in which a participating school district is
4242 located.
4343 (c) Members of the Texas Immunization Stakeholder Working
4444 Group that do not serve on the pilot program subcommittee shall
4545 serve in an advisory role for the planning and implementation of the
4646 school-based influenza vaccination pilot program.
4747 (d) The Department of State Health Services, the Texas
4848 Education Agency, and the pilot program subcommittee shall plan the
4949 school-based influenza vaccination pilot program established and
5050 implemented under this section.
5151 (e) The Department of State Health Services, the Texas
5252 Education Agency, and the pilot program subcommittee shall:
5353 (1) implement the school-based influenza vaccination
5454 pilot program in the school districts selected under Subsection (a)
5555 of this section for the 2009-2010 school year; and
5656 (2) collect all relevant data related to the program
5757 during the 2009-2010 school year.
5858 (f) Not later than December 1, 2010, the Department of State
5959 Health Services and the Texas Education Agency shall submit to the
6060 governor, lieutenant governor, speaker of the house of
6161 representatives, and presiding officers of each standing committee
6262 of the legislature with jurisdiction over the department and the
6363 agency a jointly written report on the implementation and results
6464 of the school-based influenza vaccination pilot program that
6565 includes:
6666 (1) an analysis of the costs and benefits of
6767 implementing the school-based influenza vaccination pilot program
6868 in each school district listed by Subsection (a) of this section;
6969 (2) identification of barriers to implementing the
7070 pilot program and recommendations for removing those barriers;
7171 (3) a projection of the fiscal impact of implementing
7272 a statewide school-based influenza vaccination program; and
7373 (4) an analysis of the pilot program's impact on
7474 private practice physicians who administer influenza vaccination
7575 in this state.
7676 (g) The Department of State Health Services and the Texas
7777 Education Agency may seek, receive, and spend money received
7878 through an appropriation, grant, donation, or reimbursement from
7979 any public or private source to implement the school-based
8080 influenza vaccination pilot program.
8181 SECTION 2. This Act expires September 1, 2011.
8282 SECTION 3. This Act takes effect immediately if it receives
8383 a vote of two-thirds of all the members elected to each house, as
8484 provided by Section 39, Article III, Texas Constitution. If this
8585 Act does not receive the vote necessary for immediate effect, this
8686 Act takes effect September 1, 2009.
