7 | 7 | | relating to staff development requirements in public schools. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 21.451, Education Code, is amended by |
---|
10 | 10 | | amending Subsection (d) and adding Subsections (e), (f), and (g) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (d) The staff development [may]: |
---|
13 | 13 | | (1) may include training in: |
---|
14 | 14 | | (A) technology; |
---|
15 | 15 | | (B) conflict resolution; and |
---|
16 | 16 | | (C) discipline strategies, including classroom |
---|
17 | 17 | | management, district discipline policies, and the student code of |
---|
18 | 18 | | conduct adopted under Section 37.001 and Chapter 37; and |
---|
19 | 19 | | (2) subject to Subsection (e), must include |
---|
20 | 20 | | research-based training that: |
---|
21 | 21 | | (A) relates to instruction of students with |
---|
22 | 22 | | disabilities; and |
---|
23 | 23 | | (B) is designed for educators who work primarily |
---|
24 | 24 | | outside the area of special education. |
---|
25 | 25 | | (e) A school district is required to provide the training |
---|
26 | 26 | | described by Subsection (d)(2) to an educator who works primarily |
---|
27 | 27 | | outside the area of special education only on the recommendation of |
---|
28 | 28 | | the admission, review, and dismissal committee for a student |
---|
29 | 29 | | receiving instruction from the educator. |
---|
30 | 30 | | (f) In developing the training required by Subsection |
---|
31 | 31 | | (d)(2), a school district must consult with persons with expertise |
---|
32 | 32 | | in research-based practices for students with disabilities. |
---|
33 | 33 | | Persons who may be consulted under this subsection include |
---|
34 | 34 | | colleges, universities, private and nonprofit organizations, |
---|
35 | 35 | | regional education service centers, and any other persons |
---|
36 | 36 | | identified as qualified by the district. This subsection applies |
---|
37 | 37 | | to all training required by Subsection (d)(2), regardless of |
---|
38 | 38 | | whether the training is provided at the campus or district level. |
---|
39 | 39 | | (g) The staff development may[; and |
---|
40 | 40 | | [(3)] include instruction as to what is permissible |
---|
41 | 41 | | under law, including opinions of the United States Supreme Court |
---|
42 | 42 | | and guidance from the United States Department of Education, |
---|
43 | 43 | | regarding prayer in public school. |
---|
44 | 44 | | SECTION 2. This Act applies beginning with the 2009-2010 |
---|
45 | 45 | | school year. |
---|
46 | 46 | | SECTION 3. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 50 | | Act takes effect September 1, 2009. |
