77 relating to the contents of a receipt issued for payment of a good
88 or service; providing a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 501, Business & Commerce
1111 Code, as effective April 1, 2009, is amended by adding Section
1212 501.1011 to read as follows:
1313 Sec. 501.1011. SALES RECEIPT CONTAINING DRIVER'S LICENSE OR
1414 SOCIAL SECURITY NUMBER PROHIBITED. A person may not print an
1515 individual's driver's license or social security number on a
1616 receipt or other document that evidences payment for a sale of goods
1717 or services and is provided to the individual.
1818 SECTION 2. Section 501.102, Business & Commerce Code, as
1919 effective April 1, 2009, is amended by amending Subsection (a) and
2020 adding Subsection (a-1) to read as follows:
2121 (a) A person who violates Section 501.101 [this subchapter]
2222 is liable to this state for a civil penalty in an amount not to
2323 exceed $500 for each violation. The attorney general or the
2424 prosecuting attorney in the county in which the violation occurs
2525 may bring an action to recover the civil penalty imposed under this
2626 subsection [section].
2727 (a-1) A person who violates Section 501.1011 is liable to
2828 this state for a civil penalty in an amount not to exceed $500 for
2929 each calendar month in which a violation occurs. The civil penalty
3030 may not be imposed for more than one violation that occurs in a
3131 month. The attorney general or the prosecuting attorney in the
3232 county in which the violation occurs may bring an action to recover
3333 the civil penalty imposed under this subsection.
3434 SECTION 3. This Act takes effect January 1, 2010.
