9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 501, Business & Commerce |
---|
11 | 11 | | Code, as effective April 1, 2009, is amended by adding Section |
---|
12 | 12 | | 501.1011 to read as follows: |
---|
13 | 13 | | Sec. 501.1011. SALES RECEIPT CONTAINING DRIVER'S LICENSE OR |
---|
14 | 14 | | SOCIAL SECURITY NUMBER PROHIBITED. A person may not print an |
---|
15 | 15 | | individual's driver's license or social security number on a |
---|
16 | 16 | | receipt or other document that evidences payment for a sale of goods |
---|
17 | 17 | | or services and is provided to the individual. |
---|
18 | 18 | | SECTION 2. Section 501.102, Business & Commerce Code, as |
---|
19 | 19 | | effective April 1, 2009, is amended by amending Subsection (a) and |
---|
20 | 20 | | adding Subsection (a-1) to read as follows: |
---|
21 | 21 | | (a) A person who violates Section 501.101 [this subchapter] |
---|
22 | 22 | | is liable to this state for a civil penalty in an amount not to |
---|
23 | 23 | | exceed $500 for each violation. The attorney general or the |
---|
24 | 24 | | prosecuting attorney in the county in which the violation occurs |
---|
25 | 25 | | may bring an action to recover the civil penalty imposed under this |
---|
26 | 26 | | subsection [section]. |
---|
27 | 27 | | (a-1) A person who violates Section 501.1011 is liable to |
---|
28 | 28 | | this state for a civil penalty in an amount not to exceed $500 for |
---|
29 | 29 | | each calendar month in which a violation occurs. The civil penalty |
---|
30 | 30 | | may not be imposed for more than one violation that occurs in a |
---|
31 | 31 | | month. The attorney general or the prosecuting attorney in the |
---|
32 | 32 | | county in which the violation occurs may bring an action to recover |
---|
33 | 33 | | the civil penalty imposed under this subsection. |
---|
34 | 34 | | SECTION 3. This Act takes effect January 1, 2010. |
