8 | 8 | | districts to prepare public school students to take required |

9 | 9 | | end-of-course assessment instruments. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 39, Education Code, is |
---|
12 | 12 | | amended by adding Section 39.0251 to read as follows: |
---|
13 | 13 | | Sec. 39.0251. END-OF-COURSE ASSESSMENT INSTRUMENT |
---|
14 | 14 | | INTENSIVE PREPARATION ACADEMIES. (a) This section applies only to |
---|
15 | 15 | | a school district with an enrollment of 5,000 or more students. |
---|
16 | 16 | | (b) For any school year in which state funds are |
---|
17 | 17 | | appropriated for purposes of this section, a school district in |
---|
18 | 18 | | which five percent or more of the students fail to perform |
---|
19 | 19 | | satisfactorily on an assessment instrument required under Section |
---|
20 | 20 | | 39.025(a) shall, at the end of the school year, operate an intensive |
---|
21 | 21 | | preparation academy to prepare those students to retake the |
---|
22 | 22 | | assessment instrument. |
---|
23 | 23 | | (c) An intensive preparation academy must: |
---|
24 | 24 | | (1) be operated for at least 30 school days; |
---|
25 | 25 | | (2) include instruction in the curriculum material |
---|
26 | 26 | | most likely to be included in the assessment instruments required |
---|
27 | 27 | | under Section 39.025(a); and |
---|
28 | 28 | | (3) include instruction in strategies for performing |
---|
29 | 29 | | satisfactorily on the assessment instruments. |
---|
30 | 30 | | (d) A student who fails to perform satisfactorily on an |
---|
31 | 31 | | assessment instrument required under Section 39.025(a) shall |
---|
32 | 32 | | attend each portion of an intensive preparation academy under this |
---|
33 | 33 | | section relating to that assessment instrument or to strategies |
---|
34 | 34 | | described by Subsection (c)(3). |
---|
35 | 35 | | (e) For purposes of this section, satisfactory performance |
---|
36 | 36 | | on an assessment instrument is determined by the State Board of |
---|
37 | 37 | | Education under Section 39.024. |
---|
38 | 38 | | SECTION 2. Section 25.085(d), Education Code, is amended to |
---|
39 | 39 | | read as follows: |
---|
40 | 40 | | (d) Unless specifically exempted by Section 25.086, a |
---|
41 | 41 | | student enrolled in a school district must attend: |
---|
42 | 42 | | (1) an extended-year program for which the student is |
---|
43 | 43 | | eligible that is provided by the district for students identified |
---|
44 | 44 | | as likely not to be promoted to the next grade level or tutorial |
---|
45 | 45 | | classes required by the district under Section 29.084; |
---|
46 | 46 | | (2) an accelerated reading instruction program to |
---|
47 | 47 | | which the student is assigned under Section 28.006(g); |
---|
48 | 48 | | (3) an accelerated instruction program to which the |
---|
49 | 49 | | student is assigned under Section 28.0211; |
---|
50 | 50 | | (4) a basic skills program to which the student is |
---|
51 | 51 | | assigned under Section 29.086; [or] |
---|
52 | 52 | | (5) a summer program provided under Section 37.008(l) |
---|
53 | 53 | | or Section 37.021; or |
---|
54 | 54 | | (6) an intensive preparation academy to which the |
---|
55 | 55 | | student is assigned under Section 39.0251. |
---|
56 | 56 | | SECTION 3. This Act applies beginning with the 2009-2010 |
---|
57 | 57 | | school year. |
---|
58 | 58 | | SECTION 4. This Act takes effect immediately if it receives |
---|
59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
---|
60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
---|
62 | 62 | | Act takes effect September 1, 2009. |
