| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter F, Chapter 1701, Occupations Code, is |
|---|
| 12 | 12 | | amended by adding Section 1701.258 to read as follows: |
|---|
| 13 | 13 | | Sec. 1701.258. EDUCATION AND TRAINING PROGRAMS ON |
|---|
| 14 | 14 | | TRAFFICKING OF PERSONS. (a) The commission by rule shall require an |
|---|
| 15 | 15 | | officer first licensed by the commission on or after January 1, |
|---|
| 16 | 16 | | 2011, to complete within a reasonable time after obtaining the |
|---|
| 17 | 17 | | license a one-time basic education and training program on the |
|---|
| 18 | 18 | | trafficking of persons. The program must: |
|---|
| 19 | 19 | | (1) consist of at least four hours of training; and |
|---|
| 20 | 20 | | (2) include a review of the substance of Sections |
|---|
| 21 | 21 | | 20A.02 and 43.05, Penal Code. |
|---|
| 22 | 22 | | (b) The commission shall make available to each officer a |
|---|
| 23 | 23 | | voluntary advanced education, instruction, and training program on |
|---|
| 24 | 24 | | the trafficking of persons, sex trafficking, and compelling |
|---|
| 25 | 25 | | prostitution prohibited under Sections 20A.02 and 43.05, Penal |
|---|
| 26 | 26 | | Code. |
|---|
| 27 | 27 | | (c) Not later than January 1, 2011, the commission shall |
|---|
| 28 | 28 | | begin offering the basic and advanced programs established under |
|---|
| 29 | 29 | | this section. This subsection expires September 1, 2011. |
|---|
| 30 | 30 | | SECTION 2. Not later than December 1, 2010, the Commission |
|---|
| 31 | 31 | | on Law Enforcement Officer Standards and Education shall adopt the |
|---|
| 32 | 32 | | rules necessary to implement Section 1701.258, Occupations Code, as |
|---|
| 33 | 33 | | added by this Act. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2009. |
