66 AN ACT
77 relating to the preexisting condition exclusion period under the
88 Texas Health Insurance Risk Pool.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1506.155(a), Insurance Code, is amended
1111 to read as follows:
1212 (a) Except as provided by this section and Section 1506.056,
1313 pool coverage excludes charges or expenses incurred before the
1414 expiration of 90 days from [first anniversary of] the effective
1515 date of coverage with regard to any condition for which:
1616 (1) the existence of symptoms would cause an
1717 ordinarily prudent person to seek diagnosis, care, or treatment
1818 within the six-month period preceding the effective date of
1919 coverage; or
2020 (2) medical advice, care, or treatment was recommended
2121 or received during the six-month period preceding the effective
2222 date of coverage.
2323 SECTION 2. This Act applies only to an application for
2424 coverage under the Texas Health Insurance Risk Pool that is filed
2525 with the pool on or after the effective date of this Act. An
2626 application filed before the effective date of this Act is governed
2727 by the law in effect on the date the application was filed, and that
2828 law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
