| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 172.022(a), Election Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (a) An application for a place on the general primary | |
| 13 | 13 | election ballot must be filed with: | |
| 14 | 14 | (1) the state chair, for an office filled by voters of | |
| 15 | 15 | more than one county; [or] | |
| 16 | 16 | (2) the county chair or the secretary, if any, of the | |
| 17 | 17 | county executive committee, for an office other than state senator | |
| 18 | 18 | or state representative filled by voters of a single county; or | |
| 19 | 19 | (3) the state chair or the county chair or the | |
| 20 | 20 | secretary, if any, of the county executive committee, for the | |
| 21 | 21 | office of state senator or state representative filled by the | |
| 22 | 22 | voters of a single county. | |
| 23 | 23 | SECTION 2. Section 172.052(b), Election Code, is amended to | |
| 24 | 24 | read as follows: | |
| 25 | 25 | (b) A withdrawal request for the general primary must be | |
| 26 | 26 | filed with the authority with whom the withdrawing candidate's | |
| 27 | 27 | application for a place on the ballot was [is required to be] filed. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2009. |
