55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring courts to report the number of frivolous
88 lawsuits filed each year.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 10, Civil Practice and Remedies Code, is
1111 amended by adding Section 10.007 to read as follows:
1212 Sec. 10.007. NOTICE TO OFFICE OF COURT ADMINISTRATION;
1313 DISSEMINATION OF LIST. (a) A clerk of a court shall provide the
1414 Office of Court Administration of the Texas Judicial System a copy
1515 of any signed pleading or motion that a court has determined to
1616 constitute conduct violating Section 10.001.
1717 (b) The Office of Court Administration of the Texas Judicial
1818 System shall maintain a list of litigants signing frivolous
1919 pleadings or motions in violation of Section 10.001 and shall
2020 annually send the list to the general counsel of the State Bar of
2121 Texas, who may use the information to determine whether an attorney
2222 involved in conduct violating Section 10.001 is subject to
2323 discipline by the state bar.
2424 SECTION 2. This Act applies only to a pleading or a motion
2525 in an action commenced on or after the effective date of this Act. A
2626 pleading or motion in an action commenced before the effective date
2727 of this Act is governed by the law applicable to the pleading or
2828 motion immediately before the effective date of this Act, and that
2929 law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2009.
