| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 10, Civil Practice and Remedies Code, is |
|---|
| 11 | 11 | | amended by adding Section 10.007 to read as follows: |
|---|
| 12 | 12 | | Sec. 10.007. NOTICE TO OFFICE OF COURT ADMINISTRATION; |
|---|
| 13 | 13 | | DISSEMINATION OF LIST. (a) A clerk of a court shall provide the |
|---|
| 14 | 14 | | Office of Court Administration of the Texas Judicial System a copy |
|---|
| 15 | 15 | | of any signed pleading or motion that a court has determined to |
|---|
| 16 | 16 | | constitute conduct violating Section 10.001. |
|---|
| 17 | 17 | | (b) The Office of Court Administration of the Texas Judicial |
|---|
| 18 | 18 | | System shall maintain a list of litigants signing frivolous |
|---|
| 19 | 19 | | pleadings or motions in violation of Section 10.001 and shall |
|---|
| 20 | 20 | | annually send the list to the general counsel of the State Bar of |
|---|
| 21 | 21 | | Texas, who may use the information to determine whether an attorney |
|---|
| 22 | 22 | | involved in conduct violating Section 10.001 is subject to |
|---|
| 23 | 23 | | discipline by the state bar. |
|---|
| 24 | 24 | | SECTION 2. This Act applies only to a pleading or a motion |
|---|
| 25 | 25 | | in an action commenced on or after the effective date of this Act. A |
|---|
| 26 | 26 | | pleading or motion in an action commenced before the effective date |
|---|
| 27 | 27 | | of this Act is governed by the law applicable to the pleading or |
|---|
| 28 | 28 | | motion immediately before the effective date of this Act, and that |
|---|
| 29 | 29 | | law is continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
