66 AN ACT
77 relating to a person's eligibility for appointment as a volunteer
88 deputy voter registrar.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.031(d), Election Code, is amended to
1111 read as follows:
1212 (d) To be eligible for appointment as a volunteer deputy
1313 registrar, a person must:
1414 (1) be a qualified voter; and
1515 (2) not have been finally convicted of an offense
1616 under Section 32.51, Penal Code [18 years of age or older].
1717 SECTION 2. Section 13.033(b), Election Code, is amended to
1818 read as follows:
1919 (b) If a person is to be appointed, the registrar shall
2020 prepare a certificate of appointment in duplicate containing:
2121 (1) the date of appointment;
2222 (2) the statement: "I, _____________, Voter Registrar
2323 for _____________ County, do hereby appoint _______________ as a
2424 volunteer deputy registrar for _____________ County.";
2525 (3) the person's residence address;
2626 (4) the person's voter registration number, if any;
2727 (5) a statement that the term of the appointment
2828 expires December 31 of an even-numbered year; and
2929 (6) a statement that the appointment:
3030 (A) terminates on the person's final conviction
3131 for an offense:
3232 (i) for failure to deliver a registration
3333 application; or
3434 (ii) under Section 32.51, Penal Code; and
3535 (B) may terminate on the registrar's
3636 determination that the person failed to adequately review a
3737 registration application.
3838 SECTION 3. Section 13.036(a), Election Code, is amended to
3939 read as follows:
4040 (a) An appointment as a volunteer deputy registrar is
4141 terminated on:
4242 (1) the expiration of the volunteer deputy's term of
4343 appointment; or
4444 (2) the final conviction of the volunteer deputy for
4545 an offense prescribed by Section 13.043 of this code or Section
4646 32.51, Penal Code.
4747 SECTION 4. The change in law made by this Act applies only
4848 to the appointment of a volunteer deputy voter registrar on or after
4949 the effective date of this Act. The appointment of a volunteer
5050 deputy voter registrar before the effective date of this Act is
5151 governed by the law in effect when the registrar was appointed, and
5252 the former law is continued in effect for that purpose.
5353 SECTION 5. This Act takes effect September 1, 2009.
