66 AN ACT
77 relating to certain costs on conviction in certain intoxication and
88 drug cases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 102.0178(a), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (a) In addition to other costs on conviction imposed by this
1313 chapter, a person shall pay $60 [$50] as a court cost on conviction
1414 of an offense punishable as a Class B misdemeanor or any higher
1515 category of offense under:
1616 (1) Chapter 49, Penal Code; or
1717 (2) Chapter 481, Health and Safety Code.
1818 SECTION 2. (a) Section 102.021, Government Code, is
1919 amended to conform to Chapter 1263 (H.B. 3060), Acts of the 80th
2020 Legislature, Regular Session, 2007, and is further amended to read
2121 as follows:
2222 Sec. 102.021. COURT COSTS ON CONVICTION: CODE OF CRIMINAL
2323 PROCEDURE. A person convicted of an offense shall pay the following
2424 under the Code of Criminal Procedure, in addition to all other
2525 costs:
2626 (1) court cost on conviction of any offense, other
2727 than a conviction of an offense relating to a pedestrian or the
2828 parking of a motor vehicle (Art. 102.0045, Code of Criminal

101101 (b) Section 102.0215, Government Code, is repealed.
102102 SECTION 3. The change in law made by this Act applies only
103103 to an offense committed on or after the effective date of this Act.
104104 An offense committed before the effective date of this Act is
105105 covered by the law in effect when the offense was committed, and the
106106 former law is continued in effect for that purpose. For purposes of
107107 this section, an offense was committed before the effective date of
108108 this Act if any element of the offense was committed before that
109109 date.
110110 SECTION 4. This Act takes effect September 1, 2009.
