88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 142.001(3), Education Code, is amended
1010 to read as follows:
1111 (3) "Eligible institution" means:
1212 (A) an institution of higher education, as
1313 defined by Section 61.003; or
1414 (B) a private or independent institution of
1515 higher education, as defined by Section 61.003 [61.003(8) of this
1616 code].
1717 SECTION 2. This Act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 Act does not receive the vote necessary for immediate effect, this
2121 Act takes effect September 1, 2009.
