5	5	relating to the eligibility of private or independent institutions
6	6	of higher education to participate in the advanced research program
7	7	administered by the Texas Higher Education Coordinating Board.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 142.001(3), Education Code, is amended
10	10	to read as follows:
11	11	(3) "Eligible institution" means:
12	12	(A) an institution of higher education, as
13	13	defined by Section 61.003; or
14	14	(B) a private or independent institution of
15	15	higher education, as defined by Section 61.003 [61.003(8) of this
16	16	code].
17	17	SECTION 2. This Act takes effect immediately if it receives
18	18	a vote of two-thirds of all the members elected to each house, as
19	19	provided by Section 39, Article III, Texas Constitution. If this
20	20	Act does not receive the vote necessary for immediate effect, this
21	21	Act takes effect September 1, 2009.
