66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 521.001(a), Transportation Code, is
88 amended by adding Subdivisions (3-a) and (8-a) to read as follows:
99 (3-a) "Federal judge" means:
1010 (A) a judge of a United States court of appeals;
1111 (B) a judge of a United States district court;
1212 (C) a judge of a United States bankruptcy court;
1313 or
1414 (D) a magistrate judge of a United States
1515 district court.
1616 (8-a) "State judge" means:
1717 (A) the judge of an appellate court, a district
1818 court, or a county court at law of this state; or
1919 (B) an associate judge appointed under Chapter
2020 201, Family Code.
2121 SECTION 2. Sections 521.054(a) and (b), Transportation
2222 Code, are amended to read as follows:
2323 (a) This section applies to a person who:
2424 (1) after applying for or being issued a [the] license
2525 or certificate moves to a new residence [from the] address [stated
2626 in the person's application for a license or certificate];
2727 (2) has used the procedure under Section 521.121(c)
2828 and whose status as a federal judge, a state judge, or the spouse of
2929 a federal or state judge becomes inapplicable [moves from the
3030 address shown on the license or certificate held by the person]; or
3131 (3) changes the person's name by marriage or
3232 otherwise.
3333 (b) A person subject to this section shall notify the
3434 department of the change not later than the 30th day after the date
3535 on which the change takes effect and apply for a duplicate license
3636 or certificate as provided by Section 521.146. The duplicate
3737 license must include the person's current residence address.
3838 SECTION 3. Section 521.121, Transportation Code, is amended
3939 by amending Subsection (a) and adding Subsection (c) to read as
4040 follows:
4141 (a) The driver's license must include:
4242 (1) a distinguishing number assigned by the department
4343 to the license holder;
4444 (2) a color photograph of the entire face of the
4545 holder;
4646 (3) the full name and[,] date of birth[, and residence
4747 address] of the holder; [and]
4848 (4) a brief description of the holder; and
4949 (5) the license holder's residence address or, for a
5050 license holder using the procedure under Subsection (c), the street
5151 address of the courthouse in which the license holder or license
5252 holder's spouse serves as a federal judge or state judge.
5353 (c) The department shall establish a procedure for a federal
5454 judge, a state judge, or the spouse of a federal or state judge to
5555 omit the license holder's residence address on the license and to
5656 include, in lieu of that address, the street address of the
5757 courthouse in which the license holder or license holder's spouse
5858 serves as a federal judge or state judge. In establishing the
5959 procedure, the department shall require sufficient documentary
6060 evidence to establish the license holder's status as a federal
6161 judge, a state judge, or the spouse of a federal or state judge.
6262 SECTION 4. Section 521.142(c), Transportation Code, is
6363 amended to read as follows:
6464 (c) The application must state:
6565 (1) the sex of the applicant;
6666 (2) the residence address of the applicant, or if the
6767 applicant is a federal judge, a state judge, or the spouse of a
6868 federal or state judge using the procedure developed under Section
6969 521.121(c), the street address of the courthouse in which the
7070 applicant or the applicant's spouse serves as a federal judge or a
7171 state judge;
7272 (3) whether the applicant has been licensed to drive a
7373 motor vehicle before;
7474 (4) if previously licensed, when and by what state or
7575 country;
7676 (5) whether that license has been suspended or revoked
7777 or a license application denied;
7878 (6) the date and reason for the suspension,
7979 revocation, or denial;
8080 (7) whether the applicant is a citizen of the United
8181 States; and
8282 (8) the county of residence of the applicant.
8383 SECTION 5. Section 411.179(c), Government Code, as added by
8484 Chapter 1222 (H.B. 2300), Acts of the 80th Legislature, Regular
8585 Session, 2007, is amended to read as follows:
8686 (c) In adopting the form of the license under Subsection
8787 (a), the department shall establish a procedure for the license of a
8888 qualified handgun instructor or of a judge, justice, prosecuting
8989 attorney, or assistant prosecuting attorney, as described by
9090 Section 46.15(a)(4) or (6), Penal Code, to indicate on the license
9191 the license holder's status as a qualified handgun instructor or as
9292 a judge, justice, district attorney, criminal district attorney, or
9393 county attorney. In establishing the procedure, the department
9494 shall require sufficient documentary evidence to establish the
9595 license holder's status under this subsection.
9696 SECTION 6. Sections 411.181(a) and (b), Government Code, as
9797 amended by Chapters 594 (H.B. 41) and 1222 (H.B. 2300), Acts of the
9898 80th Legislature, Regular Session, 2007, are reenacted and amended
9999 to read as follows:
100100 (a) If a person who is a current license holder moves from
101101 any residence [the] address stated on the license [to a new
102102 residence address], if the name of the person is changed by marriage
103103 or otherwise, or if the person's status [as a judge, justice,
104104 district attorney, prosecuting attorney, or assistant prosecuting
105105 attorney, as a federal judge, a state judge, or the spouse of a
106106 federal judge or state judge,] becomes inapplicable for purposes of
107107 the information required to be displayed on the license under
108108 Section 411.179 [411.179(c)], the person shall, not later than the
109109 30th day after the date of the address, name, or status change,
110110 notify the department and provide the department with the number of
111111 the person's license and, as applicable, the person's:
112112 (1) former and new addresses; [or]
113113 (2) former and new names; or
114114 (3) former and new status.
115115 (b) If the name of the license holder is changed by marriage
116116 or otherwise, or if the person's status [as a federal judge or state
117117 judge, or the spouse of a federal judge or state judge] becomes
118118 inapplicable as described by Subsection (a), the person shall apply
119119 for a duplicate license. The duplicate license must reflect
120120 [include] the person's current name, residence address, and status.
121121 SECTION 7. Section 411.187(a), Government Code, is amended
122122 to read as follows:
123123 (a) A license may be suspended under this section if the
124124 license holder:
125125 (1) is charged with the commission of a Class A or
126126 Class B misdemeanor or an offense under Section 42.01, Penal Code,
127127 or of a felony under an information or indictment;
128128 (2) fails to display a license as required by Section
129129 411.205;
130130 (3) fails to notify the department of a change of
131131 address, [or] name, or status as required by Section 411.181;
132132 (4) carries a concealed handgun under the authority of
133133 this subchapter of a different category than the license holder is
134134 licensed to carry;
135135 (5) fails to return a previously issued license after
136136 a license is modified as required by Section 411.184(d);
137137 (6) commits an act of family violence and is the
138138 subject of an active protective order rendered under Title 4,
139139 Family Code; or
140140 (7) is arrested for an offense involving family
141141 violence or an offense under Section 42.072, Penal Code, and is the
142142 subject of an order for emergency protection issued under Article
143143 17.292, Code of Criminal Procedure.
144144 SECTION 8. This Act takes effect September 1, 2009.
