| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 505.154, Local Government Code, as |
|---|
| 11 | 11 | | effective April 1, 2009, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 505.154. PROJECTS RELATED TO WATER SUPPLY FACILITIES |
|---|
| 13 | 13 | | AND WATER CONSERVATION PROGRAMS. For purposes of this chapter, |
|---|
| 14 | 14 | | "project" includes land, buildings, equipment, facilities, and |
|---|
| 15 | 15 | | improvements found by the board of directors to be required or |
|---|
| 16 | 16 | | suitable for: |
|---|
| 17 | 17 | | (1) the development or improvement of water supply |
|---|
| 18 | 18 | | facilities, including dams, transmission lines, well field |
|---|
| 19 | 19 | | developments, and other water supply alternatives; or |
|---|
| 20 | 20 | | (2) the development and institution of water |
|---|
| 21 | 21 | | conservation programs, including incentives to install |
|---|
| 22 | 22 | | water-saving plumbing fixtures, educational programs, brush |
|---|
| 23 | 23 | | control programs, and programs to replace malfunctioning or leaking |
|---|
| 24 | 24 | | water lines and other water facilities, and related roads, streets, |
|---|
| 25 | 25 | | sewer facilities, and stormwater drainage facilities. |

| 26 | 26 | | SECTION 2. This Act takes effect September 1, 2009. |
