| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 55.1751(d) and (e), Education Code, are |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (d) Notwithstanding Subsection (a), The Texas A&M |
|---|
| 14 | 14 | | University System may not issue bonds under this section for |
|---|
| 15 | 15 | | facilities at Texas A&M University--Central Texas until the Texas |
|---|
| 16 | 16 | | Higher Education Coordinating Board certifies that enrollment at |
|---|
| 17 | 17 | | Texas A&M University--Central Texas has reached an enrollment |
|---|
| 18 | 18 | | equivalent of 1,500 full-time students for one semester. [If that |
|---|
| 19 | 19 | | enrollment is not reached by January 1, 2010, the system's |
|---|
| 20 | 20 | | authority to issue bonds for Texas A&M University--Central Texas |
|---|
| 21 | 21 | | under this section expires on that date.] |
|---|
| 22 | 22 | | (e) Notwithstanding Subsection (a), The Texas A&M |
|---|
| 23 | 23 | | University System may not issue bonds under this section for |
|---|
| 24 | 24 | | facilities at Texas A&M University--San Antonio until the Texas |
|---|
| 25 | 25 | | Higher Education Coordinating Board certifies that enrollment at |

| 26 | 26 | | Texas A&M University--San Antonio has reached an enrollment |

| 27 | 27 | | equivalent of 1,500 full-time students for one semester. [If that |

| 35 | 35 | | at the University of North Texas Dallas Campus until the Texas |
|---|
| 36 | 36 | | Higher Education Coordinating Board certifies that enrollment at |
|---|
| 37 | 37 | | the University of North Texas Dallas Campus has reached an |
|---|
| 38 | 38 | | enrollment equivalent of 1,500 full-time students for one |
|---|
| 39 | 39 | | semester. [If that enrollment is not reached by January 1, 2010, |
|---|
| 40 | 40 | | the system's authority to issue bonds for the University of North |
|---|
| 41 | 41 | | Texas Dallas Campus under this section expires on that date.] |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2009. |
