| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 101.32, Alcoholic Beverage Code, is | |
| 11 | 11 | repealed. | |
| 12 | 12 | SECTION 2. The change in law made by this Act applies to a | |
| 13 | 13 | trial commenced on or after the effective date of this Act | |
| 14 | 14 | regardless of when the offense was committed. A trial commenced | |
| 15 | 15 | before the effective date of this Act is covered by the law in | |
| 16 | 16 | effect when the trial commenced, and the former law is continued in | |
| 17 | 17 | effect for that purpose. | |
| 18 | 18 | SECTION 3. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2009. |
