| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 39.352, Utilities Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (c-1) to read as follows: |
|---|
| 11 | 11 | | (c-1) Subject to Subsection (d), a retail electric provider |
|---|
| 12 | 12 | | shall at all times maintain compliance with the requirements for |
|---|
| 13 | 13 | | certification prescribed by Subsection (b) and with all other |
|---|
| 14 | 14 | | applicable requirements prescribed by this title or by a commission |
|---|
| 15 | 15 | | order or rule, including customer protection requirements, |
|---|
| 16 | 16 | | disclosure requirements, and marketing guidelines. At least |
|---|
| 17 | 17 | | annually and at any other time the commission may require, a retail |
|---|
| 18 | 18 | | electric provider shall submit a report to the commission |
|---|
| 19 | 19 | | concerning the financial viability of the retail electric provider. |
|---|
| 20 | 20 | | At any time, the commission, on its own motion or on complaint, may: |
|---|
| 21 | 21 | | (1) investigate the financial, managerial, and |
|---|
| 22 | 22 | | technical performance of a retail electric provider; and |
|---|
| 23 | 23 | | (2) inspect the books and records of a retail electric |
|---|
| 24 | 24 | | provider. |

| 25 | 25 | | SECTION 2. Section 39.352(e), Utilities Code, is repealed. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2009. |
