66 AN ACT
77 relating to the permissible uses of the state highway fund.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 222.001, Transportation Code, is amended
1010 to read as follows:
1111 Sec. 222.001. USE OF STATE HIGHWAY FUND. Money that is
1212 required to be used for public roadways by the Texas Constitution or
1313 federal law and that is deposited in the state treasury to the
1414 credit of the state highway fund, including money deposited to the
1515 credit of the state highway fund under Title 23, United States Code,
1616 may be used only:
1717 (1) to improve the state highway system; or
1818 (2) to mitigate adverse environmental effects that
1919 result directly from construction or maintenance of a state highway
2020 by the department[; or
2121 [(3) by the Department of Public Safety to police the
2222 state highway system and to administer state laws relating to
2323 traffic and safety on public roads].
2424 SECTION 2. Subchapter A, Chapter 222, Transportation Code,
2525 is amended by adding Section 222.0025 to read as follows:
2626 Sec. 222.0025. LIMITATION ON USE OF STATE HIGHWAY FUND.
2727 Notwithstanding any other law, money in the state highway fund that
2828 is described by Section 222.001 or 222.002 may not be transferred to
2929 or appropriated for use by:
3030 (1) the Department of Public Safety;
3131 (2) the Texas Department of Criminal Justice;
3232 (3) the Texas Transportation Institute;
3333 (4) the Department of State Health Services;
3434 (5) the Department of Aging and Disability Services;
3535 (6) the Department of Assistive and Rehabilitative
3636 Services;
3737 (7) the Department of Family and Protective Services;
3838 (8) the Health and Human Services Commission or any
3939 other health and human services agency or entity;
4040 (9) the Texas Historical Commission;
4141 (10) the Texas Commission on the Arts;
4242 (11) the Texas Higher Education Coordinating Board;
4343 (12) the Texas Education Agency; or
4444 (13) the Texas Workforce Commission.
4545 SECTION 3. This Act takes effect September 1, 2009.
