| 7 | 7 | | relating to the permissible uses of the state highway fund. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 222.001, Transportation Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | Sec. 222.001. USE OF STATE HIGHWAY FUND. Money that is |
|---|
| 12 | 12 | | required to be used for public roadways by the Texas Constitution or |
|---|
| 13 | 13 | | federal law and that is deposited in the state treasury to the |
|---|
| 14 | 14 | | credit of the state highway fund, including money deposited to the |
|---|
| 15 | 15 | | credit of the state highway fund under Title 23, United States Code, |
|---|
| 16 | 16 | | may be used only: |
|---|
| 17 | 17 | | (1) to improve the state highway system; or |
|---|
| 18 | 18 | | (2) to mitigate adverse environmental effects that |
|---|
| 19 | 19 | | result directly from construction or maintenance of a state highway |
|---|
| 20 | 20 | | by the department[; or |
|---|
| 21 | 21 | | [(3) by the Department of Public Safety to police the |
|---|
| 22 | 22 | | state highway system and to administer state laws relating to |
|---|
| 23 | 23 | | traffic and safety on public roads]. |
|---|
| 24 | 24 | | SECTION 2. Subchapter A, Chapter 222, Transportation Code, |
|---|
| 25 | 25 | | is amended by adding Section 222.0025 to read as follows: |
|---|
| 26 | 26 | | Sec. 222.0025. LIMITATION ON USE OF STATE HIGHWAY FUND. |
|---|
| 27 | 27 | | Notwithstanding any other law, money in the state highway fund that |
|---|
| 28 | 28 | | is described by Section 222.001 or 222.002 may not be transferred to |
|---|
| 29 | 29 | | or appropriated for use by: |
|---|
| 30 | 30 | | (1) the Department of Public Safety; |
|---|
| 31 | 31 | | (2) the Texas Department of Criminal Justice; |
|---|
| 32 | 32 | | (3) the Texas Transportation Institute; |
|---|
| 33 | 33 | | (4) the Department of State Health Services; |
|---|
| 34 | 34 | | (5) the Department of Aging and Disability Services; |
|---|
| 35 | 35 | | (6) the Department of Assistive and Rehabilitative |
|---|
| 36 | 36 | | Services; |
|---|
| 37 | 37 | | (7) the Department of Family and Protective Services; |
|---|
| 38 | 38 | | (8) the Health and Human Services Commission or any |
|---|
| 39 | 39 | | other health and human services agency or entity; |
|---|
| 40 | 40 | | (9) the Texas Historical Commission; |
|---|
| 41 | 41 | | (10) the Texas Commission on the Arts; |
|---|
| 42 | 42 | | (11) the Texas Higher Education Coordinating Board; |
|---|
| 43 | 43 | | (12) the Texas Education Agency; or |
|---|
| 44 | 44 | | (13) the Texas Workforce Commission. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2009. |
