66 AN ACT
77 relating to requiring governmental entities to participate in the
88 federal electronic verification of work authorization program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1111 by adding Chapter 619 to read as follows:
1212 CHAPTER 619. VERIFICATION OF EMPLOYEE INFORMATION
1313 Sec. 619.001. DEFINITIONS. In this chapter:
1414 (1) "Electronic status verification system" means the
1515 electronic verification of work authorization program of Section
1616 403(a) of the federal Illegal Immigration Reform and Immigrant
1717 Responsibility Act of 1996 (Pub. L. No. 104-208, reprinted in note,
1818 8 U.S.C. Section 1324a), operated by the United States Department
1919 of Homeland Security and known as the Basic Pilot Program or
2020 E-Verify.
2121 (2) "Governmental entity" means:
2222 (A) the state; or
2323 (B) a political subdivision of the state,
2424 including a municipality, a county, or any kind of district.
2525 Sec. 619.002. VERIFICATION. A governmental entity shall
2626 register and participate in the electronic status verification
2727 system to verify information of all new employees.
2828 Sec. 619.003. RULES. The Texas Workforce Commission shall
2929 adopt rules and prescribe forms to implement this chapter.
3030 Sec. 619.004. TERMINATION OF EMPLOYMENT. An employee of a
3131 governmental entity who is responsible for verifying information of
3232 new employees of the governmental entity as required by Section
3333 619.002 is subject to immediate termination of employment if the
3434 employee fails to comply with that section.
3535 SECTION 2. This Act takes effect September 1, 2009.
