7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 12.002, Civil Practice and Remedies |
---|
9 | 9 | | Code, is amended by adding Subsection (c) to read as follows: |
---|
10 | 10 | | (c) A person claiming a lien under Chapter 53, Property |
---|
11 | 11 | | Code, is not liable under this section for the making, |
---|
12 | 12 | | presentation, or use of a document or other record in connection |
---|
13 | 13 | | with the assertion of the claim unless the person acts with intent |
---|
14 | 14 | | to defraud. |
---|
15 | 15 | | SECTION 2. The change in law made by this Act applies only |
---|
16 | 16 | | to a cause of action that accrues on or after the effective date of |
---|
17 | 17 | | this Act. A cause of action that accrues before the effective date |
---|
18 | 18 | | of this Act is governed by the law in effect immediately before that |
---|
19 | 19 | | date, and that law is continued in effect for that purpose. |
---|
20 | 20 | | SECTION 3. This Act takes effect September 1, 2009. |
