55 relating to liability arising out of the filing of a mechanic's,
66 contractor's, or materialman's lien.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 12.002, Civil Practice and Remedies
99 Code, is amended by adding Subsection (c) to read as follows:
1010 (c) A person claiming a lien under Chapter 53, Property
1111 Code, is not liable under this section for the making,
1212 presentation, or use of a document or other record in connection
1313 with the assertion of the claim unless the person acts with intent
1414 to defraud.
1515 SECTION 2. The change in law made by this Act applies only
1616 to a cause of action that accrues on or after the effective date of
1717 this Act. A cause of action that accrues before the effective date
1818 of this Act is governed by the law in effect immediately before that
1919 date, and that law is continued in effect for that purpose.
2020 SECTION 3. This Act takes effect September 1, 2009.
