66 AN ACT
77 relating to eligibility for the child health plan.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.101(b), Health and Safety Code, is
1010 amended to read as follows:
1111 (b) The commission shall establish income eligibility
1212 levels consistent with Title XXI, Social Security Act (42 U.S.C.
1313 Section 1397aa et seq.), as amended, and any other applicable law or
1414 regulations, and subject to the availability of appropriated money,
1515 so that a child who is younger than 19 years of age and whose net
1616 family income is at or below 300 [200] percent of the federal
1717 poverty level is eligible for health benefits coverage under the
1818 program. In addition, the commission may establish eligibility
1919 standards regarding the amount and types of allowable assets for a
2020 family whose net family income is above 250 [150] percent of the
2121 federal poverty level.
2222 SECTION 2. Section 62.102(b), Health and Safety Code, is
2323 amended to read as follows:
2424 (b) During the sixth month following the date of initial
2525 enrollment or reenrollment of an individual whose net family income
2626 exceeds 285 [185] percent of the federal poverty level, the
2727 commission shall:
2828 (1) review the individual's net family income and may
2929 use electronic technology if available and appropriate; and
3030 (2) continue to provide coverage if the individual's
3131 net family income does not exceed the income eligibility limits
3232 prescribed by this chapter.
3333 SECTION 3. Section 62.101(b), Health and Safety Code, as
3434 amended by this Act, applies to a determination of eligibility of a
3535 person for coverage under the child health plan under Chapter 62,
3636 Health and Safety Code, made on or after the effective date of this
3737 Act, regardless of the date the person applied for that coverage.
3838 SECTION 4. Section 62.102(b), Health and Safety Code, as
3939 amended by this Act, applies to an enrollee under the child health
4040 plan under Chapter 62, Health and Safety Code, beginning on the
4141 effective date of this Act, regardless of the date the enrollment
4242 period began.
4343 SECTION 5. If before implementing any provision of this Act
4444 a state agency determines that a waiver or authorization from a
4545 federal agency is necessary for implementation of that provision,
4646 the agency affected by the provision shall request the waiver or
4747 authorization and may delay implementing that provision until the
4848 waiver or authorization is granted.
4949 SECTION 6. This Act takes effect September 1, 2009.
